児童手当法

児童
A person up to the first 31 March on or after the day they turn 18 who has an address (住所) in Japan, or who has none in Japan for study abroad or another reason set by Cabinet Office Order (内閣府令).
十八歳に達する日以後の最初の三月三十一日までの間にある者であつて、日本国内に住所を有するもの又は留学その他の内閣府令で定める理由により日本国内に住所を有しないもの
施設等受給資格者
A person who meets the requirements for payment of child allowance (児童手当) under Article 4(1)(iv) — a provider of child independent living assistance (児童自立生活援助), an operator of a small-scale residential child care project (小規模住居型児童養育事業), a foster parent (里親), or the founder (設置者) of a facility in which a child placed in a facility, etc. (施設入所等児童) lives — and who must have the certification (認定) of Article 7(2) to be paid it.
受給資格者
A general eligible recipient (一般受給資格者) or facility eligible recipient (施設等受給資格者) who has been certified under Article 7 and is paid child allowance (児童手当) — by the mayor of the municipality (市町村長), or, for a public employee of a class Article 17 names who receives it as a parent or other general recipient, by the authority Article 17 puts in the mayor's place (usually their employer).
被用者
An insured person (被保険者), other than a public employee (公務員), for whom one of the employers and other bodies listed in Article 69(1) of the Act on Support for Children and Child-rearing bears or must pay premiums (保険料).
子ども・子育て支援法第六十九条第一項各号に掲げる者が保険料を負担し、又は納付する義務を負う被保険者であつて公務員でない者
The date Act No. 24 of 2012, the amending Act these supplementary provisions (附則) belong to, comes into effect.
A child receiving child independent living assistance (児童自立生活援助), placed with a small-scale residential child care project (小規模住居型児童養育事業) or a foster parent (里親), or living in one of the facilities Article 3(3) lists — such as a maternal and child living support facility (母子生活支援施設), a residential facility for children with disabilities (障害児入所施設), an infant home (乳児院), a facility designed to support persons with disabilities (障害者支援施設) or a relief facility (救護施設) — other than for a short stay set by Cabinet Office Order (内閣府令) and subject to the further conditions that paragraph sets.
次に掲げる児童
A child (児童) other than a child placed in a facility, etc. (施設入所等児童): the children whose custody and support by a parent, guardian of a minor (未成年後見人) or other person entitle that person to child allowance (児童手当) under items (i) to (iii) of Article 4(1).

In Articles 6, 7, 13 and 14 of the supplementary provisions (附則) of Act No. 24 of 2012, a child who has not completed lower secondary school (中学校修了前の児童), as defined in Article 22-3 of the Child Allowance Act as amended by Article 1 of that Act.
同法第二十二条の三に規定する中学校修了前の児童
Assistance as defined in Article 6-3(1) of the Child Welfare Act — consultation and other help with daily life, life guidance and job support in a shared residence or other place set by Cabinet Office Order (内閣府令) — given to the young people listed there, such as those whose care placement (措置) has ended, other than assistance for a period of up to two months set by Cabinet Office Order.
一般受給資格者
A person who meets the requirements for payment of child allowance (児童手当) under items (i) to (iii) of Article 4(1) — a parent, a guardian of a minor (未成年後見人), a parent's designee (父母指定者) or another person who has custody of and supports a child who is not placed in a facility — and who must have the certification (認定) of Article 7(1) to be paid it.
In Chapter III on costs, the part of child allowance (児童手当) calculated from the number of covered children under three (三歳未満支給対象児童) or children placed in a facility, etc. under three (三歳未満施設入所等児童), or from the amount for a child under three (三歳未満児童算定額), which Article 6(3) sets at 15,000 yen.

The facilities in which a child placed in a facility, etc. (施設入所等児童) lives or is in hospital: maternal and child living support facilities (母子生活支援施設), residential facilities for children with disabilities (障害児入所施設), designated medical institutions for developmental support (指定発達支援医療機関), infant homes and the like (乳児院等), facilities designed to support persons with disabilities (障害者支援施設), Nozominosono (のぞみの園), relief facilities (救護施設), rehabilitation facilities (更生施設), residential facilities for daily living support (日常生活支援住居施設) and women's self-reliance support facilities (女性自立支援施設).
This Act as it stood before Article 1 of Act No. 24 of 2012 amended it.
父母指定者
In the supplementary provisions (附則) of Act No. 24 of 2012, a parent's designee (父母指定者) as defined in Article 4(1)(ii) of the Child Allowance Act as amended by Article 1 of that Act.
第一条の規定による改正後の児童手当法第四条第一項第二号に規定する父母指定者
小規模住居型児童養育事業
The project (事業), as defined in Article 6-3(8) of the Child Welfare Act, in which a person experienced in raising children in need of protection (要保護児童), or another person set by Cabinet Office Order (内閣府令), other than a foster parent (里親), raises such children placed there by a measure (措置) under Article 27(1)(iii) of that Act in their own home.
父母指定者
A person with an address (住所) in Japan whom a parent or guardian (父母等) living outside Japan who supports a child under the requirements for payment (支給要件児童) designates: someone who lives with the child, has custody of it and shares its living expenses — or, where living together is found difficult, has custody of it and shares its living expenses — other than the child's own parent or guardian.
支給対象児童
In Article 6, a child under the requirements for payment (支給要件児童) covered by a general eligible recipient's (一般受給資格者) certification (認定) under Article 7(1).
次条第一項の認定に係る支給要件児童
In Article 17, a full-time national public employee (国家公務員) or another national public employee set by Cabinet Order (政令), other than one working for an administrative execution agency (行政執行法人), or a full-time local public employee (地方公務員) or another set by Cabinet Order, other than one working for a specified local incorporated administrative agency (特定地方独立行政法人); for such a recipient the head of the body they belong to, or a person that head delegates, takes the place of the mayor of the municipality (市町村長) in certifying and paying child allowance (児童手当).
This Act as amended by Act No. 18 of 1994.
In Article 2 of the supplementary provisions (附則) of Act No. 108 of 2004, a child who has passed the first 31 March on or after the day they turn six but not the first 31 March on or after the day they turn nine.
小学校第三学年修了後小学校修了前の児童
In Article 3 of the supplementary provisions (附則) of Act No. 20 of 2006, a child who has passed the first 31 March on or after the day they turn nine but not the first 31 March on or after the day they turn twelve.
The date Act No. 20 of 2006, the amending Act these supplementary provisions (附則) belong to, comes into effect.
In the supplementary provisions (附則) of Act No. 109 of 2007, the Minister of Health, Labour and Welfare, a Director of a Regional Bureau of Health and Welfare or of a Regional Branch Bureau, or the Japan Pension Service (日本年金機構), to whom acts of the Director-General of the Social Insurance Agency and the other social insurance offices (社会保険庁長官等) are transferred.
In the supplementary provisions (附則) of Act No. 109 of 2007, the Director-General of the Social Insurance Agency (社会保険庁長官), a Director of a Regional Social Insurance Bureau (地方社会保険事務局長) or the head of a Social Insurance Office (社会保険事務所長).
In Articles 15 and 16 of the supplementary provisions (附則) of Act No. 24 of 2012, a child who has not completed lower secondary school (中学校修了前の児童), as defined in Article 4(1)(i)(a) of the Child Allowance Act as amended by Article 2 of that Act.

In Articles 15 and 16 of the supplementary provisions (附則) of Act No. 24 of 2012, a facility designed to support persons with disabilities (障害者支援施設) or Nozominosono (のぞみの園) under Article 3(3)(iii), or a relief facility (救護施設), rehabilitation facility (更生施設) or women's protection facility (婦人保護施設) under Article 3(3)(iv), of the Child Allowance Act as amended by Article 2 of that Act.

The date Act No. 47 of 2024, the amending Act these supplementary provisions (附則) belong to, comes into effect.
The project (事業), as defined in Article 6-3(1) of the Child Welfare Act, of giving young people listed there, such as those whose care placement (措置) has ended, consultation and other help with daily life, life guidance and job support in a shared residence or other place set by Cabinet Office Order (内閣府令), and of helping those whose assistance has ended.
A foster parent as defined in Article 6-4 of the Child Welfare Act: a person who wishes to raise children in need of protection (要保護児童) and is registered as a foster parent or adoptive foster parent, or a relative of such a child whom the prefectural governor (都道府県知事) finds suitable to be entrusted with it.
A facility, as defined in Article 5(11) of the Act on Providing Comprehensive Support for the Daily Life and Life in Society of Persons with Disabilities, that gives persons with disabilities residential support (施設入所支援) together with other facility-based disability welfare services (施設障害福祉サービス), other than Nozomi-no-Sono (のぞみの園) and the facilities a Ministerial Order (主務省令) under paragraph (1) of that Article specifies.
障害者の日常生活及び社会生活を総合的に支援するための法律第五条第十一項に規定する障害者支援施設
救護施設
A facility, as defined in Article 38(2) of the Public Assistance Act, that takes in people in need of public assistance (要保護者) for whom a serious physical or mental disability makes daily life difficult, and gives them livelihood assistance (生活扶助).
A facility, as defined in Article 38(3) of the Public Assistance Act, that takes in people in need of public assistance (要保護者) who need care and life guidance for physical or mental reasons, and gives them livelihood assistance (生活扶助).
父母等
In Article 4(1), the father or mother who has custody of a child under the requirements for payment (支給要件児童) and shares its living expenses, or, where the child has a guardian of a minor (未成年後見人), that guardian.
In Article 6, a general eligible recipient (一般受給資格者) other than a corporate eligible recipient (法人受給資格者), that is, other than a corporation acting as a child's guardian of a minor (未成年後見人).
次条第一項に規定する一般受給資格者(第六号において「一般受給資格者」という。)のうち、法人受給資格者以外のもの
三歳以上支給対象児童
A covered child (支給対象児童) aged three or over; a covered child born on the first day of a month counts as one once three years have passed since the day of birth.
三歳以上の支給対象児童(月の初日に生まれた支給対象児童にあつては、出生の日から三年を経過したもの)
三歳未満支給対象児童
A covered child (支給対象児童) under three; a covered child born on the first day of a month counts as one until three years have passed since the day of birth.

法人受給資格者
In Article 6, a general eligible recipient (一般受給資格者) under Article 4(1)(i) that is a corporation acting as a child's guardian of a minor (未成年後見人).
一般受給資格者(第四条第一項第一号に該当する者に限る。)のうち、未成年後見人であり、かつ、法人であるもの
In Chapter III on costs, the part of child allowance (児童手当) other than the child allowance for children under three (三歳未満児童手当).
児童手当のうち、三歳未満児童手当を除いたもの
In Article 18(4), the certification (認定) for child allowance (児童手当) under Article 7, as Article 17(1) reads it for public employees (公務員), given by the head of the ministry, agency or local government they belong to, or by a person that head delegates.
子ども・子育て支援納付金
The levy (納付金) the government collects every fiscal year from 2026 from health insurers and similar bodies under Article 71-3(1) of the Act on Support for Children and Child-rearing, to cover costs that include the grants under Article 19 of this Act, part of which Article 19 funds from it.
In Articles 3 and 4 of the supplementary provisions (附則) of Act No. 24 of 2012, the certification (認定) for child allowance (児童手当) under Article 7(1) or (2) of the Child Allowance Act as amended by Article 1 of that Act, which Article 3 deems certain people already certified for Children's Allowance (子ども手当) under the Act on Special Measures Concerning the Payment of Children's Allowance, etc. in Fiscal 2011 to hold from the date Act No. 24 of 2012 comes into effect.
In Articles 15 and 16 of the supplementary provisions (附則) of Act No. 24 of 2012, a designated medical institution (指定医療機関) as defined in Article 3(3)(ii) of the Child Allowance Act as amended by Article 2 of that Act.
新児童手当法第三条第三項第二号に規定する指定医療機関
In Articles 15 and 16 of the supplementary provisions (附則) of Act No. 24 of 2012, a child placed in a facility, etc. who has not completed lower secondary school (中学校修了前の施設入所等児童), as defined in Article 4(1)(iv) of the Child Allowance Act as amended by Article 2 of that Act.
新児童手当法第四条第一項第四号に規定する中学校修了前の施設入所等児童
In Article 13 of the supplementary provisions (附則) of Act No. 47 of 2024, Article 7(1) of the Child Allowance Act as applied under Article 2(4) of the supplementary provisions (附則) of the Child Allowance Act as it stood before Article 12 of that Act amended it, including as read under Article 17(1).
An infant home (乳児院), children's home (児童養護施設), psychological treatment facility for children (児童心理治療施設) or children's self-reliance support facility (児童自立支援施設), as defined in Articles 37, 41, 43-2 and 44 of the Child Welfare Act, into which a child has been placed by a measure (措置) under that Act.
A medical institution, as defined in Article 7(2) of the Child Welfare Act, set up by the National Hospital Organization (独立行政法人国立病院機構) or the National Center of Neurology and Psychiatry (国立研究開発法人国立精神・神経医療研究センター) and designated by the Prime Minister, where children with disabilities (障害児) are admitted for protection, support and treatment.
A facility, as defined in Article 38 of the Child Welfare Act, that takes in women without a spouse, or in a similar situation, together with the children in their custody, protects them and supports their lives toward independence, and helps those who have left.
A facility, as defined in Article 42 of the Child Welfare Act, that takes in children with disabilities (障害児) and gives them protection and support toward daily living and independence, and, in the medical type (医療型), treatment as well.
A facility, as defined in Article 12(1) of the Act on Support for Women Facing Difficult Problems, that a prefecture may set up to take in women facing difficult problems, protect them, give them medical or psychological help to recover, support their lives toward independence, and help those who have left.
A facility, as defined in Article 30(1) of the Public Assistance Act, used for a type of social welfare business or otherwise, that the prefectural governor (都道府県知事) has found to meet the requirements a Ministry of Health, Labour and Welfare Order (厚生労働省令) sets for giving recipients of public assistance (被保護者) support in daily life.
一般受給資格者
A person who meets the requirements for payment of child allowance (児童手当) under items (i) to (iii) of Article 4(1) — a parent, a guardian of a minor (未成年後見人), a parent's designee (父母指定者) or another person who has custody of and supports a child who is not placed in a facility — and who must have the certification (認定) of Article 7(1) to be paid it.
A person up to the first 31 March on or after the day they turn 22 — other than a child (児童) and a person in extended care (延長者等) past the first 31 March on or after the day they turn 18 — whom an individual eligible recipient (個人受給資格者) looks after and largely supports as set by Cabinet Office Order (内閣府令), and who has an address (住所) in Japan or has none for study abroad or another reason set by Cabinet Office Order; Article 6 counts such persons in setting the amount.

施設等受給資格者

学校給食費
The cost of school lunches, as defined in Article 11(2) of the School Lunch Program Act, other than the facilities, equipment and running costs set by Cabinet Order (政令) that the school's founder (設置者) bears; the guardians (保護者) of the pupils who receive the lunches pay it.
In Article 22, the childcare charges the mayor of the municipality (市町村長) may collect out of a recipient's child allowance (児童手当): costs of the municipality's placing of a child in a nursery centre (保育所) or other childcare under Article 24(5) or (6) of the Child Welfare Act, collected under Article 56(2) of that Act, and unpaid childcare charges the municipality may recover under Article 56(6) or (7) of that Act in the way overdue local tax is recovered.
同条第二項の規定により徴収する費用(同法第五十一条第四号又は第五号に係るものに限る。)又は同法第五十六条第六項若しくは第七項の規定により地方税の滞納処分の例により処分することができる費用
子ども・子育て支援特例公債
Bonds (公債), as defined in Article 71-26(2) of the Act on Support for Children and Child-rearing, that the government may issue in each fiscal year from 2024 to 2028 to fund the costs the children and child-rearing support levy (子ども・子育て支援納付金) is to cover; Article 2 of the supplementary provisions (附則) funds part of the grants under Article 19 from their proceeds in those years.
子ども・子育て支援特例公債
Bonds (公債), as defined in Article 71-26(2) of the Act on Support for Children and Child-rearing, that the government may issue in each fiscal year from 2024 to 2028 to fund the costs the children and child-rearing support levy (子ども・子育て支援納付金) is to cover; Article 2 of the supplementary provisions (附則) funds part of the grants under Article 19 from their proceeds in those years.
This Act as it stood before Act No. 74 of 1985 amended it.
In the supplementary provisions of Act No. 87 of 1999, work of the State, of another local government or of another public body that an organ of a local government managed or carried out under an Act (法律) or a Cabinet Order (政令) before that Act comes into effect, which the local government then handles as its own affairs.
The government agency ranking above the one that made a decision, which hears administrative appeals against that decision.
In Article 2 of the supplementary provisions (附則) of Act No. 108 of 2004, a child aged three or over who has not completed the third grade of elementary school (三歳以上小学校第三学年修了前の児童), as defined in Article 7(1)(i)(a) of the supplementary provisions (附則) of the Child Allowance Act as amended by that Act.
In Article 3 of the supplementary provisions (附則) of Act No. 20 of 2006, a child aged three or over who has not completed elementary school (三歳以上小学校修了前の児童), as defined in Article 7(1)(i)(a) of the supplementary provisions (附則) of the Child Allowance Act as amended by Article 1 of that Act.
In the supplementary provisions (附則) of Act No. 24 of 2012, the benefits under Article 6(1), Article 7(1) and Article 8(1) of the supplementary provisions (附則) of the Child Allowance Act as it stood before Article 1 of that Act amended it.

In Article 22(2), the collection of childcare fees (保育料) out of a recipient's child allowance (児童手当) when it is paid, as Article 22(1) allows the mayor of the municipality (市町村長) to do.
In Article 22(2), a person whose childcare fees (保育料) are to be collected out of their child allowance (児童手当) by special collection (特別徴収).
