Article 3-5-2Amount to Be Added upon Deferral of Payment

①The amount specified by Cabinet Order as prescribed in Article 44-3, paragraph (4) of the Act (including where applied with replacement of terms pursuant to Article 87 of the Supplementary Provisions of the Act Partially Amending the Employees' Pension Insurance Act, etc. to Ensure the Soundness and Reliability of the Public Pension System (Act No. 63 of 2013; hereinafter referred to as the "2013 Amendment Act")) is the amount obtained by multiplying the amount calculated pursuant to Article 43, paragraph (1) of the Act on the basis of the insured period (hereinafter referred to in this Article as the "insured period before the month of acquiring the right to receive") up to the month preceding the month (hereinafter referred to in this paragraph as the "month of acquiring the right to receive") that includes the day of acquiring the right to receive an employees' old-age pension by the average payment rate (where Article 59, paragraph (2) of the Supplementary Provisions of the 1985 Amendment Act applies, the amount obtained by adding to the amount so multiplied the additional amount prescribed in that paragraph calculated on the basis of the insured period before the month of acquiring the right to receive) and then by the rate of increase (meaning the rate obtained by multiplying 7/1,000 by the number of months from the month of acquiring the right to receive up to the month preceding the month that includes the day on which the request under Article 44-3, paragraph (1) of the Act was made (including that request in the case where the request under paragraph (1) of that Article is deemed to have been made pursuant to paragraph (5) of that Article) (hereinafter referred to in the following paragraph as the "date of the request") (where that number of months exceeds 120, 120)).

②The average payment rate in the preceding paragraph is the rate obtained by dividing the rate obtained by adding together the payment rates for each month from the month following the month of acquiring the right to receive prescribed in that paragraph (or, where the period from that month of acquiring the right to receive to the month that includes the date of the request exceeds 10 years, the month that includes the day 10 years before that date of the request) through the month that includes the date of the request (where, among those months, the month is one prescribed in Article 46, paragraph (1) of the Act to which a person having the right to receive an employees' old-age pension belongs, the rate obtained by subtracting from 1 the rate obtained by dividing the amount whose payment is to be suspended pursuant to that paragraph by the amount calculated pursuant to Article 43, paragraph (1) of the Act on the basis of the insured period before the month of acquiring the right to receive, and where the month is not such a month, 1) by the number of months from the month following that month of acquiring the right to receive through the month that includes the date of the request.
