Article 3-13-10Replacement of Terms, Etc. in the Application of Special Provisions on Administrative Functions Connected with Disability Employees' Pensions, Etc. for a Person Who Has Spent Time as an Insured Person in Two or More Categories

①Where the disability employees' pension under Article 78-30 of the Act is a disability employees' pension listed in the following items, the day of initial examination prescribed in Article 78-33, paragraph (1) of the Act is the day of initial examination specified in each of those items.

②With regard to administrative functions relating to the payment of a survivors' employees' pension under Article 78-32, paragraph (1) of the Act (limited to one paid by reason of falling under Article 58, paragraph (1), item (i) of the Act), where Article 78-33, paragraph (1) of the Act is applied mutatis mutandis pursuant to Article 78-33, paragraph (2) of the Act, the phrase "the day of initial examination for the disability in question" in Article 78-33, paragraph (1) of the Act is deemed to be replaced with "the day of death".

③With regard to administrative functions relating to the payment of a survivors' employees' pension under Article 78-32, paragraph (1) of the Act (limited to one paid by reason of falling under Article 58, paragraph (1), item (ii) or (iii) of the Act), where Article 78-33, paragraph (1) of the Act is applied mutatis mutandis pursuant to Article 78-33, paragraph (2) of the Act, the phrase "the day of initial examination for the disability in question" in Article 78-33, paragraph (1) of the Act is deemed to be replaced with "the day of initial examination prescribed in Article 58, paragraph (1), item (ii), or the day of initial examination for the disability that became the ground for payment of the disability employees' pension prescribed in item (iii) of that paragraph".

④With regard to a survivors' employees' pension under Article 78-32, paragraph (1) of the Act, where the deceased person prescribed in that paragraph falls under two or more of Article 58, paragraph (1), items (i) through (iii) of the Act, notwithstanding Article 78-33, paragraph (2) of the Act, the administrative functions relating to the payment of that survivors' employees' pension are to be performed by the persons specified in each item of Article 2-5, paragraph (1) of the Act, in accordance with the insured category on the day specified in each of the following items for the case listed in that item.
