Article 465-4Grounds for Fixing of Principal in Contract for Revolving Guarantee by Individual
第四百六十五条の四（個人根保証契約の元本の確定事由）
The principal of the principal obligation under a contract for revolving guarantee by an individual is fixed in the following cases; provided, however, that in the case stated in item (i), it is fixed only if the procedure for judicial enforcement or enforcement procedure of a security right is commenced:
if an obligee files a petition for judicial enforcement or enforcement of any security right for a claim for payment of money with regard to any property of the guarantor;
債権者が、保証人の財産について、金銭の支払を目的とする債権についての強制執行又は担保権の実行を申し立てたとき。
if the guarantor receives an order commencing bankruptcy proceeding; or
保証人が破産手続開始の決定を受けたとき。
the relevant principal obligor or guarantor has died.
主たる債務者又は保証人が死亡したとき。
Beyond the case prescribed in the preceding paragraph, the principal of the principal obligation under a contract for revolving guarantee by an individual for loans is fixed in the following cases; provided, however, that in the case stated in item (i), it is fixed only if the procedure for judicial enforcement or enforcement procedure of a security right is commenced:
前項に規定する場合のほか、個人貸金等根保証契約における主たる債務の元本は、次に掲げる場合にも確定する。ただし、第一号に掲げる場合にあっては、強制執行又は担保権の実行の手続の開始があったときに限る。
if the obligee files a petition for judicial enforcement or enforcement of a security right for a claim for payment of money with regard to property of the principal obligor; or
債権者が、主たる債務者の財産について、金銭の支払を目的とする債権についての強制執行又は担保権の実行を申し立てたとき。
if the principal obligor receives an order commencing bankruptcy proceeding.
主たる債務者が破産手続開始の決定を受けたとき。
