If a third party makes the choice, that choice is made by manifesting intention to either the obligee or the obligor.
第三者が選択をすべき場合には、その選択は、債権者又は債務者に対する意思表示によってする。
In the case prescribed in the preceding paragraph, if the third party is unable to make the choice or has no intention to make the choice, the right to choose is transferred to the obligor.
前項に規定する場合において、第三者が選択をすることができず、又は選択をする意思を有しないときは、選択権は、債務者に移転する。
