If three years have passed from the time of the creation of a revolving mortgage, the mortgagor of the revolving mortgage may request the fixing of the principal secured. In this case, the principal secured is fixed when two weeks have passed since the time of that request.
根抵当権設定者は、根抵当権の設定の時から三年を経過したときは、担保すべき元本の確定を請求することができる。この場合において、担保すべき元本は、その請求の時から二週間を経過することによって確定する。
A revolving mortgagee may request the fixing of the principal secured at any time. In this case, the principal secured is fixed on the request of the same.
根抵当権者は、いつでも、担保すべき元本の確定を請求することができる。この場合において、担保すべき元本は、その請求の時に確定する。
The provisions of the preceding two paragraphs do not apply if the date on which the principal secured is to be fixed is specified.
前二項の規定は、担保すべき元本の確定すべき期日の定めがあるときは、適用しない。
