Article 338Registration of Statutory Liens for Construction Work for Immovables
第三百三十八条（不動産工事の先取特権の登記）
In order to preserve the effectiveness of statutory liens for construction work for immovables, the budgeted expenses of the construction work must be registered before the commencement of the same. In this case, if the expenses of the construction work exceed the budgeted amount, a statutory lien does not exist with respect to the amount in excess of the same.
不動産の工事の先取特権の効力を保存するためには、工事を始める前にその費用の予算額を登記しなければならない。この場合において、工事の費用が予算額を超えるときは、先取特権は、その超過額については存在しない。
The amount of increase in value of immovables that resulted from construction work must be evaluated by an appraiser appointed by the court at the time of the participation in the distribution.
工事によって生じた不動産の増価額は、配当加入の時に、裁判所が選任した鑑定人に評価させなければならない。
