If the partition of land creates a parcel of land that has no access to public roads, the owner of that parcel of land may pass to the public roads only through the lands owned by another person that participated in the partition. In this case, it is necessary to pay compensation.
分割によって公道に通じない土地が生じたときは、その土地の所有者は、公道に至るため、他の分割者の所有地のみを通行することができる。この場合においては、償金を支払うことを要しない。
The provisions of the preceding paragraph apply mutatis mutandis if the owner of land transfers part of the land to another person.
前項の規定は、土地の所有者がその土地の一部を譲り渡した場合について準用する。
