Article 1042Devolution of the Statutory Reserved Share and the Proportion Thereof
第千四十二条（遺留分の帰属及びその割合）
Heirs other than siblings receive, as the statutory reserved share, the amount obtained by multiplying the value of the property for calculating the statutory reserved share prescribed in paragraph (1) of the following Article by the proportion specified in each of the following items according to the categories set forth in those items.
兄弟姉妹以外の相続人は、遺留分として、次条第一項に規定する遺留分を算定するための財産の価額に、次の各号に掲げる区分に応じてそれぞれ当該各号に定める割合を乗じた額を受ける。
if only lineal ascendants are the heirs: one-third;
直系尊属のみが相続人である場合 三分の一
in a case other than that set forth in the preceding item: one-half.
前号に掲げる場合以外の場合 二分の一
If there are two or more heirs, the proportions specified in the items of the preceding paragraph are the proportions obtained by multiplying them by each heir's share of the estate calculated pursuant to the provisions of Articles 900 and 901.
