Article 5Responsibilities of the Local Governments

第五条（地方公共団体の責務）

Local governments are responsible for developing and implementing necessary measures to ensure the proper handling of personal information by local government organs, local incorporated administrative agencies, and businesses within their territory based on its characteristics in conformity with the purport of this Act while considering the consistency with the measures taken by the national government.

地方公共団体は、この法律の趣旨にのっとり、国の施策との整合性に配慮しつつ、その地方公共団体の区域の特性に応じて、地方公共団体の機関、地方独立行政法人及び当該区域内の事業者等による個人情報の適正な取扱いを確保するために必要な施策を策定し、及びこれを実施する責務を有する。

個人情報（こじんじょうほう）
Information about a living individual that either can identify that particular person by a name, date of birth or other identifier or the equivalent (記述等) it contains — including information that can easily be matched with other information and so identify the person — or contains an individual identification code (個人識別符号).

地方独立行政法人（ちほうどくりつぎょうせいほうじん）
A corporation that a local government (地方公共団体) sets up under the Local Independent Administrative Agency Act to carry out, efficiently and effectively, public work in its area that must be done reliably, that the local government need not do itself, and that it judges might not get done if left to the private sector, as Article 2(1) of that Act defines it.
