第五条の規定の施行前にされた建物の賃貸借契約であって同条の規定による改正前の借地借家法（以下「旧法」という。）第三十八条第一項の定めがあるものについての賃借権の設定又は賃借物の転貸の登記に関しては、なお従前の例による。

第五条の規定の施行前にされた居住の用に供する建物の賃貸借（旧法第三十八条第一項の規定による賃貸借を除く。）の当事者が、その賃貸借を合意により終了させ、引き続き新たに同一の建物を目的とする賃貸借をする場合には、当分の間、第五条の規定による改正後の借地借家法第三十八条の規定は、適用しない。

第四条（検討）

国は、この法律の施行後四年を目途として、居住の用に供する建物の賃貸借の在り方について見直しを行うとともに、この法律の施行の状況について検討を加え、その結果に基づいて必要な措置を講ずるものとする。
