Supplementary Provisions, Article 1Effective Date
第一条（施行期日）
This Act comes into effect as of the date specified by Cabinet Order within a period not exceeding one year from the date of promulgation.
この法律は、公布の日から起算して一年を超えない範囲内において政令で定める日から施行する。
Supplementary Provisions, Article 2Repeal of the Act on the Protection of Buildings, etc.
第二条（建物保護に関する法律等の廃止）
The following Acts are repealed:
次に掲げる法律は、廃止する。
Act on the Protection of Buildings (Act No. 40 of 1909);
建物保護に関する法律（明治四十二年法律第四十号）
Land Lease Act (Act No. 49 of 1921);
借地法（大正十年法律第四十九号）
Building Lease Act (Act No. 50 of 1921).
借家法（大正十年法律第五十号）
Supplementary Provisions, Article 3Transitional Measures Concerning the Effect of the Former Land Lease Act
第三条（旧借地法の効力に関する経過措置）
For the purpose of applying the provisions of Article 9, paragraph (2) of the Act on Temporary Treatment of Land and Building Lease in Relation to Requisitioned Real Properties (Act No. 138 of 1956), the Land Lease Act prior to its repeal under the provisions of the preceding Article remains in force even after this Act comes into effect.
接収不動産に関する借地借家臨時処理法（昭和三十一年法律第百三十八号）第九条第二項の規定の適用については、前条の規定による廃止前の借地法は、この法律の施行後も、なおその効力を有する。
Supplementary Provisions, Article 4Principle for Transitional Measures
第四条（経過措置の原則）
Unless otherwise provided for in these Supplementary Provisions, the provisions of this Act also apply to matters that arose before this Act comes into effect; provided, however, that this does not preclude the effect that arose under the provisions of the Act on the Protection of Buildings, the Land Lease Act, and the Building Lease Act prior to their repeal under the provisions of Article 2 of the Supplementary Provisions.
この法律の規定は、この附則に特別の定めがある場合を除き、この法律の施行前に生じた事項にも適用する。ただし、附則第二条の規定による廃止前の建物保護に関する法律、借地法及び借家法の規定により生じた効力を妨げない。
Supplementary Provisions, Article 5Transitional Measures Concerning Decay of Buildings on Leased Land
第五条（借地上の建物の朽廃に関する経過措置）
With regard to a land leasehold right established before this Act comes into effect, the provisions then in force continue to govern the extinguishment of that land leasehold right due to the decay of a building on the land that is the object of the land leasehold right.
この法律の施行前に設定された借地権について、その借地権の目的である土地の上の建物の朽廃による消滅に関しては、なお従前の例による。
Supplementary Provisions, Article 6Transitional Measures Concerning Renewal of Land Lease Contracts
第六条（借地契約の更新に関する経過措置）
The provisions then in force continue to govern the renewal of a contract relating to a land leasehold right established before this Act comes into effect.
この法律の施行前に設定された借地権に係る契約の更新に関しては、なお従前の例による。
Supplementary Provisions, Article 7Transitional Measures Concerning Extension of Period of Land Leasehold Rights Due to Rebuilding of Buildings
第七条（建物の再築による借地権の期間の延長に関する経過措置）
With regard to a land leasehold right established before this Act comes into effect, the provisions then in force continue to govern the extension of the period of that land leasehold right due to the construction of a building after the loss of a building on the land that is the object of the land leasehold right.
この法律の施行前に設定された借地権について、その借地権の目的である土地の上の建物の滅失後の建物の築造による借地権の期間の延長に関しては、なお従前の例による。
The provisions of Article 8 do not apply to a land leasehold right established before this Act comes into effect.
Supplementary Provisions, Article 8Transitional Measures Concerning Perfection of Land Leasehold Rights
第八条（借地権の対抗力に関する経過措置）
The provisions of Article 10, paragraph (2) do not apply if a building on the land that is the object of a land leasehold right was lost before this Act comes into effect.
Supplementary Provisions, Article 9Transitional Measures Concerning the Right to Request Purchase of Buildings
第九条（建物買取請求権に関する経過措置）
The provisions of Article 13, paragraph (2) do not apply to a land leasehold right established before this Act comes into effect.
The provisions of Article 13, paragraph (3) do not apply to a land sublease right established before this Act comes into effect.
Supplementary Provisions, Article 10Transitional Measures Concerning Judicial Decisions on Changes to Land Lease Terms
第十条（借地条件の変更の裁判に関する経過措置）
The provisions then in force continue to govern cases of changes to land lease terms pertaining to a petition filed before this Act comes into effect.
この法律の施行前にした申立てに係る借地条件の変更の事件については、なお従前の例による。
Supplementary Provisions, Article 11Transitional Measures Concerning Judicial Decisions on Permission to Rebuild Buildings After Renewal of Land Lease Contracts
第十一条（借地契約の更新後の建物の再築の許可の裁判に関する経過措置）
The provisions of Article 18 do not apply to a land leasehold right established before this Act comes into effect.
Supplementary Provisions, Article 12Transitional Measures Concerning Refusal to Renew Building Lease Contracts, etc.
第十二条（建物賃貸借契約の更新拒絶等に関する経過措置）
The provisions then in force continue to govern a notice of refusal to renew a building lease contract and a notice of termination given before this Act comes into effect.
この法律の施行前にされた建物の賃貸借契約の更新の拒絶の通知及び解約の申入れに関しては、なお従前の例による。
Supplementary Provisions, Article 13Transitional Measures Concerning the Right to Demand Purchase of Interior Decorations and Fixtures
第十三条（造作買取請求権に関する経過措置）
The provisions of Article 33, paragraph (2) do not apply to a sublease of a building made before this Act comes into effect.
第三十三条第二項の規定は、この法律の施行前にされた建物の転貸借については、適用しない。
Supplementary Provisions, Article 14Transitional Measures Concerning Protection of Lessee of Buildings on Leased Land
第十四条（借地上の建物の賃借人の保護に関する経過措置）
The provisions of Article 35 do not apply if the duration of a land leasehold right expires before this Act comes into effect or within one year after it comes into effect.
