Supplementary Provisions, Article 10Transitional Measures Concerning Enforcement Against a Claim Arising from a Small Claims Action
第十条（少額訴訟債権執行に関する経過措置）
The provisions of Chapter II, Section 2, Subsection 4, Division 2 of the New Civil Enforcement Act do not apply to judicial enforcement against a monetary claim based on a title of obligation arising from a small claims action stated in any of the items of Article 167-2, paragraph (1) of the New Civil Enforcement Act that was established before this Act comes into effect.
新民事執行法第二章第二節第四款第二目の規定は、この法律の施行前に成立した新民事執行法第百六十七条の二第一項各号に掲げる少額訴訟に係る債務名義による金銭債権に対する強制執行については、適用しない。
If the date on which this Act comes into effect is before the date on which the Act on the Maintenance of Related Acts Accompanying the Enforcement of the Real Property Registration Act (Act No. 124 of 2004) comes into effect, with regard to the application of the provisions of Article 167-14 of the New Civil Enforcement Act during the period up to the day preceding the date on which that Act comes into effect, the phrase "Article 164, paragraphs (5) and (6)" in that Article is deemed to be replaced with "Article 164, paragraphs (4) and (5)," and the phrase "Article 164, paragraph (5)" is deemed to be replaced with "Article 164, paragraph (4)."
