第五条（特定業種に係る退職金の支給に関する経過措置）
The provisions of the proviso to Article 43, paragraph (1), Article 46, paragraph (2) and Article 55, paragraph (2) of the New SME Retirement Allowance Act apply to the payment of retirement allowances pertaining to a person for whom the grounds for payment arise on or after the Effective Date, and the provisions then in force continue to govern the payment of retirement allowances pertaining to a person for whom the grounds for payment arose before the Effective Date.
新中退法第四十三条第一項ただし書、第四十六条第二項及び第五十五条第二項の規定は、施行日以後に支給事由が生じた者に係る退職金の支給について適用し、施行日前に支給事由が生じた者に係る退職金の支給については、なお従前の例による。
