Supplementary Provisions, Article 15Hiring of Employees of the Japan Organization for Employment of the Elderly, Persons with Disabilities and Job Seekers
第十五条（高齢・障害・求職者雇用支援機構の職員の採用）
The president of the Incorporated Administrative Agency Japan Organization for Employment of the Elderly and Persons with Disabilities (hereinafter referred to as the "Japan Organization for Employment of the Elderly and Persons with Disabilities" in this Article) is to recruit employees of the Japan Organization for Employment of the Elderly, Persons with Disabilities and Job Seekers by presenting, through the Employment and Human Resources Development Organization of Japan, to the employees of the Employment and Human Resources Development Organization of Japan the working conditions of the employees of the Japan Organization for Employment of the Elderly, Persons with Disabilities and Job Seekers and the criteria for hiring them.
独立行政法人高齢・障害者雇用支援機構（以下この条において「高齢・障害者雇用支援機構」という。）の理事長は、雇用・能力開発機構を通じ、その職員に対し、高齢・障害・求職者雇用支援機構の職員の労働条件及び高齢・障害・求職者雇用支援機構の職員の採用の基準を提示して、高齢・障害・求職者雇用支援機構の職員の募集を行うものとする。
When the working conditions of the employees of the Japan Organization for Employment of the Elderly, Persons with Disabilities and Job Seekers and the criteria for hiring them have been presented to the employees of the Employment and Human Resources Development Organization of Japan pursuant to the provisions of the preceding paragraph, the Employment and Human Resources Development Organization of Japan is to ascertain the intentions of its employees concerning becoming employees of the Japan Organization for Employment of the Elderly, Persons with Disabilities and Job Seekers, select from among those who have expressed the intention to become such employees, in accordance with the criteria for hiring those employees, the persons who are to become employees of the Japan Organization for Employment of the Elderly, Persons with Disabilities and Job Seekers, prepare a roster of them, and submit it to the president of the Japan Organization for Employment of the Elderly and Persons with Disabilities.
雇用・能力開発機構は、前項の規定によりその職員に対し、高齢・障害・求職者雇用支援機構の職員の労働条件及び高齢・障害・求職者雇用支援機構の職員の採用の基準が提示されたときは、高齢・障害・求職者雇用支援機構の職員となることに関する雇用・能力開発機構の職員の意思を確認し、高齢・障害・求職者雇用支援機構の職員となる意思を表示した者の中から、当該高齢・障害・求職者雇用支援機構の職員の採用の基準に従い、高齢・障害・求職者雇用支援機構の職員となるべき者を選定し、その名簿を作成して高齢・障害者雇用支援機構の理事長に提出するものとする。
Among the employees of the Employment and Human Resources Development Organization of Japan listed in the roster referred to in the preceding paragraph, a person who has received notice from the president of the Japan Organization for Employment of the Elderly and Persons with Disabilities that the person is to be hired, and who is an employee of the Employment and Human Resources Development Organization of Japan on the day preceding the Effective Date, is hired as an employee of the Japan Organization for Employment of the Elderly, Persons with Disabilities and Job Seekers on the Effective Date.
前項の名簿に記載された雇用・能力開発機構の職員のうち、高齢・障害者雇用支援機構の理事長から採用する旨の通知を受けた者であって施行日の前日において雇用・能力開発機構の職員であるものは、施行日において、高齢・障害・求職者雇用支援機構の職員として採用される。
The matters that are to constitute the content of the working conditions to be presented pursuant to the provisions of paragraph (1), the method of presentation pursuant to the provisions of that paragraph, the method of confirming the intentions of employees pursuant to the provisions of paragraph (2), and other matters necessary for the implementation of the provisions of the preceding three paragraphs are specified by Order of the Ministry of Health, Labour and Welfare.
Supplementary Provisions, Article 18Hiring of Employees of the Organization for Workers' Retirement Allowance Mutual Aid
第十八条（勤労者退職金共済機構の職員の採用）
The provisions of Article 15 of the Supplementary Provisions apply mutatis mutandis to the hiring of employees of the Employment and Human Resources Development Organization of Japan as employees of the Organization for Workers' Retirement Allowance Mutual Aid.
附則第十五条の規定は、雇用・能力開発機構の職員の勤労者退職金共済機構の職員としての採用について準用する。
Supplementary Provisions, Article 21Transitional Measures Concerning Penal Provisions
第二十一条（罰則に関する経過措置）
With regard to the application of penal provisions to acts committed before the Effective Date and to acts committed on or after the Effective Date in the cases where the provisions then in force continue to govern pursuant to the provisions of Article 10 of the Supplementary Provisions, the provisions then in force continue to govern.
施行日前にした行為及び附則第十条の規定によりなお従前の例によることとされる場合における施行日以後にした行為に対する罰則の適用については、なお従前の例による。
Supplementary Provisions, Article 22Delegation to Cabinet Order
第二十二条（政令への委任）
Beyond what is provided for in these Supplementary Provisions, transitional measures necessary in connection with the enforcement of this Act are specified by Cabinet Order.
この附則に規定するもののほか、この法律の施行に関し必要な経過措置は、政令で定める。
