A person who commits any of the offenses set forth in paragraph (1), items (i) through (ii)-2, item (v) or (vii) or paragraph (2) of the preceding Article may be exempt from the penalty if it is proved that the person corresponds to the following items; provided however, that this is to be limited to cases in which, after having committed the act pertaining to the crime, a proposal was made without delay in the presence of an immigration inspector that the person falls under the following items:
前条第一項第一号から第二号の二まで、第五号若しくは第七号又は同条第二項の罪を犯した者については、次の各号に該当することの証明があつたときは、その刑を免除する。ただし、当該罪に係る行為をした後遅滞なく入国審査官の面前において、次の各号に該当することの申出をした場合に限る。
the person enters Japan directly from a territory in which their life, body or physical freedom was likely to be persecuted on the grounds prescribed in Article 1, paragraph A-(2) of the Refugee Convention; and
その者の生命、身体又は身体の自由が難民条約第一条Ａ（２）に規定する理由によつて害されるおそれのあつた領域から、直接本邦に入つたものであること。
the act pertaining to the crime was committed because there was a risk that the situation prescribed in the preceding item will occur.
前号のおそれがあることにより当該罪に係る行為をしたものであること。
