The provisions of Article 398-9, paragraphs (3) through (5) and Article 398-10, paragraphs (1) and (2) of the Civil Code (Act No. 89 of 1896) and Article 26, paragraph (1) of the Act on the Promotion of Business Financing, etc. (Act No. 52 of 2024) apply mutatis mutandis to the case where a medical corporation conducts a split pursuant to the provisions of this Subsection. In this case, the term "the preceding two paragraphs" in Article 398-9, paragraph (3) of the Civil Code is replaced with "paragraph (1) or (2) of the following Article as applied mutatis mutandis pursuant to Article 62-2 of the Medical Care Act (Act No. 205 of 1948)", and the term "the preceding paragraph" is replaced with "the same paragraph".
民法（明治二十九年法律第八十九号）第三百九十八条の九第三項から第五項まで並びに第三百九十八条の十第一項及び第二項並びに事業性融資の推進等に関する法律（令和六年法律第五十二号）第二十六条第一項の規定は、この款の規定により医療法人が分割をする場合について準用する。この場合において、民法第三百九十八条の九第三項中「前二項」とあるのは「医療法（昭和二十三年法律第二百五号）第六十二条の二において準用する次条第一項又は第二項」と、「前項」とあるのは「同項」と読み替えるものとする。
