第十三条
With regard to the establisher of a hospital, clinic or pharmacy that, at the time of enforcement of this Act, is currently designated as a medical facility that provides insured services or a pharmacy that provides insured services pursuant to Article 63, paragraph (3), item (i) of the Health Insurance Act (Act No. 70 of 1922), or a hospital or clinic that is currently approved as a specially approved medical facility that provides insured services pursuant to Article 86, paragraph (1), item (i) of that Act, the designation under the main clause of Article 53, paragraph (1) of the New Long-Term Care Insurance Act is deemed to have been made, on the Effective Date, pertaining to the Preventive Long-Term Care Service prescribed in Article 8-2, paragraph (1) of the New Long-Term Care Insurance Act that is provided by that hospital, clinic or pharmacy (limited, for a hospital or clinic, to Management and Guidance for In-Home Medical Service for Preventive Long-Term Care (meaning the Management and Guidance for In-Home Medical Service for Preventive Long-Term Care prescribed in paragraph (6) of that Article; the same applies below in this Article) and other types of Preventive Long-Term Care Service prescribed in Article 8-2, paragraph (1) of the New Long-Term Care Insurance Act that are specified by Order of the Ministry of Health, Labour and Welfare, and, for a pharmacy, limited to Management and Guidance for In-Home Medical Service for Preventive Long-Term Care); provided, however, that this does not apply if the establisher of that hospital, clinic or pharmacy has made a different notification, as provided by Order of the Ministry of Health, Labour and Welfare, by the day preceding the Effective Date.
この法律の施行の際現に健康保険法（大正十一年法律第七十号）第六十三条第三項第一号の規定による保険医療機関若しくは保険薬局の指定を受けている病院若しくは診療所若しくは薬局又は同法第八十六条第一項第一号の規定による特定承認保険医療機関の承認を受けている病院若しくは診療所の開設者については、施行日に、当該病院、診療所又は薬局により行われる新介護保険法第八条の二第一項に規定する介護予防サービス（病院又は診療所にあっては介護予防居宅療養管理指導（同条第六項に規定する介護予防居宅療養管理指導をいう。以下この条において同じ。）その他厚生労働省令で定める種類の新介護保険法第八条の二第一項に規定する介護予防サービスに限り、薬局にあっては介護予防居宅療養管理指導に限る。）に係る新介護保険法第五十三条第一項本文の指定があったものとみなす。ただし、当該病院、診療所又は薬局の開設者が施行日の前日までに、厚生労働省令で定めるところにより別段の申出をしたときは、この限りでない。
