第五条の規定の施行前にされた建物の賃貸借契約であって同条の規定による改正前の借地借家法（以下「旧法」という。）第三十八条第一項の定めがあるものについての賃借権の設定又は賃借物の転貸の登記に関しては、なお従前の例による。
