Except for the case referred to in the preceding Article, the court must serve a written petition of the case referred to in Article 41 on the other party.
The provisions of Article 43, paragraphs (4) through (6) of the Non-Contentious Case Procedures Act apply mutatis mutandis when it is not possible to serve a written petition (including the cases in which the necessary expenses for serving a written petition are not prepaid).
