(Measures in Terms of Employment Management) concerning Problems Attributable to Behavior that Constitutes Bullying in the Workplace
職場における優越的な関係を背景とした言動に起因する問題に関する雇用管理上の措置等
The national government must endeavor to take such measures as organizing public relations activities or enlightenment activities to inform employers and the general public that the behavior prescribed in paragraph (1) of the preceding Article as harmful to the work environment of workers is prohibited and to deepen their interest and understanding with respect to problems attributable to that behavior (hereinafter referred to as the "problems of behavior that constitutes bullying").
国は、労働者の就業環境を害する前条第一項に規定する言動を行つてはならないことその他当該言動に起因する問題(以下この条において「優越的言動問題」という。)に対する事業主その他国民一般の関心と理解を深めるため、広報活動、啓発活動その他の措置を講ずるように努めなければならない。
An employer must endeavor to deepen the interest and understanding of workers employed with respect to the problems of behavior that constitutes bullying, to provide training courses and give due consideration to ensure that those workers pay necessary attention to their behavior toward other workers, as well as cooperate in the national government's implementation of the measures referred to in the preceding paragraph.

In order for an employer to preclude any behavior in the workplace by customers, business counterparties, users of facilities, or other persons having a relationship with the business conducted by the employer (referred to as "customers, etc." in paragraph (5) of the following Article) which exceeds the scope permissible under generally accepted social norms in light of the nature of the duties in which the workers employed by the employer are engaged and other circumstances (hereinafter referred to as "behavior by customers, etc." in this paragraph and paragraph (1) of the following Article) from damaging the work environment of those workers, the employer must provide consultation to those workers and take measures necessary in terms of employment management, such as developing a necessary system for appropriately handling such behavior, and taking measures to deter behavior by customers, etc. that is harmful to the work environment of workers, which are necessary for ensuring the effectiveness of the response to that behavior.
事業主は、職場において行われる顧客、取引の相手方、施設の利用者その他の当該事業主の行う事業に関係を有する者(次条第五項において「顧客等」という。)の言動であつて、その雇用する労働者が従事する業務の性質その他の事情に照らして社会通念上許容される範囲を超えたもの(以下この項及び次条第一項において「顧客等言動」という。)により当該労働者の就業環境が害されることのないよう、当該労働者からの相談に応じ、適切に対応するために必要な体制の整備、労働者の就業環境を害する当該顧客等言動への対応の実効性を確保するために必要なその抑止のための措置その他の雇用管理上必要な措置を講じなければならない。
It is prohibited for any employer to dismiss any worker, or otherwise treat any worker in a disadvantageous manner, on the grounds that the worker received the consultation referred to in the preceding paragraph or stated facts when cooperating in the employer's response to that consultation.
事業主は、労働者が前項の相談を行つたこと又は事業主による当該相談への対応に協力した際に事実を述べたことを理由として、当該労働者に対して解雇その他不利益な取扱いをしてはならない。
If an employer is requested by another employer to provide necessary cooperation in connection with the implementation of the measures referred to in paragraph (1) that the other employer takes, the employer must endeavor to comply with the request.
事業主は、他の事業主から当該他の事業主が講ずる第一項の措置の実施に関し必要な協力を求められた場合には、これに応ずるように努めなければならない。
With respect to measures, etc. that employers should take under the provisions of the preceding three paragraphs, the Minister of Health, Labour and Welfare is to establish guidelines necessary for ensuring the proper and effective implementation of such measures, etc. (referred to as the "guidelines" in the following paragraph).
厚生労働大臣は、前三項の規定に基づき事業主が講ずべき措置等に関して、その適切かつ有効な実施を図るために必要な指針(次項において「指針」という。)を定めるものとする。

The provisions of Article 4, Article 5, and Articles 12 through 19 of the Act on Promoting the Resolution of Individual Labor-Related Disputes (Act No. 112 of 2001) do not apply to disputes between workers and employers with respect to the particulars prescribed in Article 30-231, paragraphs (1) and (2), and Article 33, paragraphs (1) and (2), and such disputes are as provided for in the following Article through Article 30-839.

In this case, the term "paragraph 1 of the preceding Article" in Article 1925, paragraph (1) of the same Act is deemed to be replaced with "Article 30-637, paragraph (1) of the Act on Comprehensively Advancing Labor Measures, and Stabilizing the Employment of Workers, and Enriching Workers' Vocational Lives (Act No. 132 of 1966)"; the term "workplace" in Article 2026 of the Act on Securing, Etc. of Equal Opportunity and Treatment between Men and Women in Employment is deemed to be replaced with "place of business"; and the term "Article 1824, paragraph 1" in Article 2531, paragraph (1) of the same Act is deemed to be replaced with "Article 30-435 of the Act on Comprehensively Advancing Labor Measures, and Stabilizing the Employment of Workers, and Enriching Workers' Vocational Lives."

The provisions of Articles 2026 through 2733 and Article 3137, paragraphs (3) and (4) of the Act on Securing, Etc. of Equal Opportunity and Treatment between Men and Women in Employment apply mutatis mutandis to conciliation conducted by a conciliator appointed pursuant to the provisions of Article 30-637, paragraph (1) applied following the deemed replacement of terms pursuant to the preceding paragraph. In this case, the term "Commission" in Articles 2026 through 2329 and Article 2632 of the same Act is deemed to be replaced with "conciliator"; the term "workplace" in Article 2026 of the same Act is deemed to be replaced with "place of business"; the term "Prefectural Labor Office where the relevant Commission is established" in Article 2127 of the same Act is deemed to be replaced with "district transport bureau (including the maritime traffic control division) to which the district transport bureau chief (including the chief of the maritime traffic control division) who appointed the conciliator is assigned"; the term "Article 1824, paragraph 1" in Article 2531, paragraph (1) of the same Act is deemed to be replaced with "Article 30-435 of the Act on Comprehensively Advancing Labor Measures, and Stabilizing the Employment of Workers, and Enriching Workers' Vocational Lives (Act No. 132 of 1966)"; the term "pending before the Commission" in Article 2632 of the Act on Securing, Etc. of Equal Opportunity and Treatment between Men and Women in Employment is deemed to be replaced with "being handled by the conciliator"; the terms "this section," "Conciliation," and "OrdinanceOrder of the Ministry of Health, LaborLabour and Welfare" in Article 2733 of the same Act are deemed to be replaced with "Article 2026 through the preceding Article and Article 3137, paragraphs (3) and (4) applied mutatis mutandis pursuant to Article 3847, paragraph (3) of the Act on Comprehensively Advancing Labor Measures, and Stabilizing the Employment of Workers, and Enriching Workers' Vocational Lives" "council and Conciliation," and "Order of the Ministry of Land, Infrastructure, Transport and Tourism," respectively; and the term "preceding paragraph" in Article 3137, paragraph (3) of the Act on Securing, Etc. of Equal Opportunity and Treatment between Men and Women in Employment is deemed to be replaced with "Article 30-637, paragraph (1) of the Act on Comprehensively Advancing Labor Measures, and Stabilizing the Employment of Workers, and Enriching Workers' Vocational Lives."
雇用の分野における男女の均等な機会及び待遇の確保等に関する法律第二十六条から第二十七三十三条まで並びに第三十一七条第三項及び第四項の規定は、前項の規定により読み替えて適用する第三十条の六七条第一項の規定により指名を受けて調停員が行う調停について準用する。この場合において、同法第二十六条から第二十三九条まで及び第二十六三十二条中「委員会は」とあるのは「調停員は」と、同法第二十六条中「事業場」とあるのは「事業所」と、同法第二十一七条中「当該委員会が置かれる都道府県労働局」とあるのは「当該調停員を指名した地方運輸局長(運輸監理部長を含む。)が置かれる地方運輸局(運輸監理部を含む。)」と、同法第二十五三十一条第一項中「第十八二十四条第一項」とあるのは「労働施策の総合的な推進並びに労働者の雇用の安定及び職業生活の充実等に関する法律(昭和四十一年法律第百三十二号)第三十条の四五条」と、同法第二十六三十二条中「当該委員会に係属している」とあるのは「当該調停員が取り扱つている」と、同法第二十七三十三条中「この節」とあるのは「労働施策の総合的な推進並びに労働者の雇用の安定及び職業生活の充実等に関する法律第三十八四十七条第三項において準用する第二十六条から前条まで並びに第三十一七条第三項及び第四項」と、「調停」とあるのは「合議体及び調停」と、「厚生労働省令」とあるのは「国土交通省令」と、同法第三十一七条第三項中「前項」とあるのは「労働施策の総合的な推進並びに労働者の雇用の安定及び職業生活の充実等に関する法律第三十条の六七条第一項」と読み替えるものとする。
The provisions of Articles 6 through 9, Chapter VI (excluding Article 27), Chapter VII, Articles 30-435 through 30-839, Article 3342, paragraph (1) (limited to the part pertaining to the enforcement of the provisions of Chapter X), paragraph (2), and Article 3645, paragraph (1) do not apply to national public employees and local public employees; the provisions of Chapter VIII and Articles 30-2 and 30-331 through 34 do not apply to national public employees in the regular service (excluding employees falling under Article 2, item (ii) of the Act on Labor Relations of Agency Engaged in Administrative Execution (Act No. 257 of 1948)), court officials to whom the Act on Temporary Measures concerning Court Officials (Act No. 299 of 1951) applies, the Diet officers prescribed in Article 1 of the Diet Officers Act (Act No. 85 of 1947), and the personnel prescribed in Article 2, paragraph (5) of the Self-Defense Forces Act (Act No. 165 of 1954).
第六条から第九条まで、第六章(第二十七条を除く。)、第七章、第三十条の四五条から第三十条の八九条まで、第三十三四十二条第一項(第十章の規定の施行に関するものに限る。)及び第二項並びに第三十六四十五条第一項の規定は国家公務員及び地方公務員について、第八章、及び第三十条の二及び一条から第三十条の三四条までの規定は一般職の国家公務員(行政執行法人の労働関係に関する法律(昭和二十三年法律第二百五十七号)第二条第二号の職員を除く。)、裁判所職員臨時措置法(昭和二十六年法律第二百九十九号)の適用を受ける裁判所職員、国会職員法(昭和二十二年法律第八十五号)第一条に規定する国会職員及び自衛隊法(昭和二十九年法律第百六十五号)第二条第五項に規定する隊員については、適用しない。
A person that has violated the provisions of Article 3241, paragraph (4) is punished by imprisonment for a term of not more than six months or a fine of not more than 500,000 yen.

第三十四四十三条第一項の規定による報告をせず、若しくは虚偽の報告をし、又は同項の規定による当該職員の質問に対して答弁せず、若しくは虚偽の陳述をし、若しくは同項の規定による検査を拒み、妨げ、若しくは忌避した者とき。

With respect to specified disputes (meaning disputes pertaining to the mediation under Article 5, paragraph (1) of the Act on Promoting the Resolution of Individual Labor-Related Disputes (Act No. 112 of 2001) (including as applied following the deemed replacement of terms pursuant to Article 21, paragraph (1) of the same Act) which, at the time this Act comes into effect, are pending before the dispute coordinating committee referred to in Article 6, paragraph (1) of the same Act or before a mediator appointed pursuant to the provisions of Article 5, paragraph (1) of the same Act as applied following the deemed replacement of terms pursuant to Article 21, paragraph (1) of the same Act; the same applies in the following Article), notwithstanding the provisions of Article 35 of the amended Act on Comprehensively Advancing Labor Measures, the provisions then in force continue to govern.
特定紛争(この法律の施行の際現に個別労働関係紛争の解決の促進に関する法律(平成十三年法律第百十二号)第六条第一項の紛争調整委員会又は同法第二十一条第一項の規定により読み替えて適用する同法第五条第一項の規定により指名するあっせん員に係属している同項(同法第二十一条第一項の規定により読み替えて適用する場合を含む。)のあっせんに係る紛争をいう。次条において同じ。)については、第二条改正後労働施策総合推進法第三十五条の規定にかかわらず、なお従前の例による。
When five years have elapsed after this Act comes into effect, the Government is to review the status of the enforcement of the provisions of each Act as amended by this Act, and if it finds it necessary, is to take required measures based on the results of that review.
政府は、この法律の施行後五年を経過した場合において、この法律による改正後のそれぞれの法律の規定の施行の状況について検討を加え、必要があると認めるときは、その結果に基づいて所要の措置を講ずるものとする。
