Article 61-2-10Revocation of Recognition of Refugee Status, etc.

第六十一条の二の十(難民の認定等の取消し)

If any of the facts set forth in the following items are found regarding a foreign national residing in Japan who has been recognized as a refugee, the Minister of Justice is to revoke the Recognition of Refugee Status in accordance with the procedures provided for by Ministry of Justice Order:

法務大臣は、本邦に在留する外国人難民の認定を受けているものについて、次の各号に掲げる事実のいずれかが判明したときは、法務省令で定める手続により、その難民の認定を取り消すものとする。

the foreign national has been granted Recognition of Refugee Status due to deceit or other wrongful means;

偽りその他不正の手段により難民の認定を受けたこと。

the foreign national has come to fall under any of the cases set forth in Article 1, C-(1) through (6) of the Refugee Convention; or

難民条約第一条C(1)から(6)までに掲げる場合のいずれかに該当することとなつたこと。

the foreign national has taken an action set forth in Article 1, F-(a) or (c) of the Refugee Convention after being granted Recognition of Refugee Status.

難民の認定を受けた後に、難民条約第一条F(a)又は(c)に掲げる行為を行つたこと。

If any of the facts set forth in the following items are found regarding a foreign national residing in Japan who has been recognized as a person eligible for complementary protection, the Minister of Justice is to revoke the recognition as a person eligible for complementary protection in accordance with the procedures provided for by Ministry of Justice Order:

法務大臣は、本邦に在留する外国人補完的保護対象者の認定を受けているものについて、次の各号に掲げる事実のいずれかが判明したときは、法務省令で定める手続により、その補完的保護対象者の認定を取り消すものとする。

the foreign national has received recognition as a person eligible for complementary protection due to deceit or other wrongful means;

偽りその他不正の手段により補完的保護対象者の認定を受けたこと。

the foreign national has come to fall under any of the cases set forth in Article 1, C-(1) through (4) of the Refugee Convention, the foreign national can no longer refuse to avail themselves of the protection of the country of their nationality because the circumstances on the basis of which they were recognized as a person eligible for complementary protection have ceased to exist, or, in the case where the foreign national has no nationality, the foreign national has become able to return to the country of their former habitual residence because the circumstances on the basis of which they were recognized as a person eligible for complementary protection have ceased to exist; or

難民条約第一条C(1)から(4)までに掲げる場合のいずれかに該当することとなつたこと、補完的保護対象者であると認められる根拠となつた事由が消滅したため、その者の国籍の属する国の保護を受けることを拒むことができなくなつたこと又はその者が国籍を有しない場合において、補完的保護対象者であると認められる根拠となつた事由が消滅したため、常居所を有していた国に戻ることができることとなつたこと。

the foreign national has taken an action set forth in Article 1, F-(a) or (c) of the Refugee Convention after receiving recognition as a person eligible for complementary protection.

補完的保護対象者の認定を受けた後に、難民条約第一条F(a)又は(c)に掲げる行為を行つたこと。

If the Minister of Justice revokes the Recognition of Refugee Status or the recognition as a person eligible for complementary protection pursuant to the provisions of the preceding two paragraphs, the Minister is to notify the foreign national to that effect in writing with the reason attached as well as publish in an official gazette the fact that the certificate of refugee status and the refugee travel document or the certificate of recognition as a person eligible for complementary protection pertaining to the foreign national have expired.

法務大臣は、前二項の規定により難民の認定又は補完的保護対象者の認定を取り消す場合には、当該外国人に対し、理由を付した書面をもつて、その旨を通知するとともに、当該外国人に係る難民認定証明書及び難民旅行証明書又は補完的保護対象者認定証明書がその効力を失つた旨を官報に告示する。

If a foreign national who was issued a certificate of refugee status and a refugee travel document or a certificate of recognition as a person eligible for complementary protection receives a notice of revocation of the Recognition of Refugee Status or the recognition as a person eligible for complementary protection pursuant to the provisions of the preceding paragraph, the foreign national must promptly return these certificates to the Commissioner of the Immigration Services Agency.

前項の規定により難民の認定又は補完的保護対象者の認定の取消しの通知を受けたときは、難民認定証明書及び難民旅行証明書又は補完的保護対象者認定証明書の交付を受けている外国人は、速やかに出入国在留管理庁長官にこれらの証明書を返納しなければならない。
