The right to collect insurance premiums and other monies to be collected under the provisions of this Act or to receive a refund of them is extinguished by prescription when two years have passed from the time when it becomes exercisable; the right to receive pension insurance benefits is extinguished by prescription when five years have passed from the day on which the grounds for their payment arose; the right to receive payment of pension insurance benefits that are to be paid in each payment month based on that right is extinguished by prescription when five years have passed from the first day of the month following the payment month prescribed in Article 36, paragraph (3), main clause that relates to the payment of those pension insurance benefits and arrives in or after the month following the month that includes that day; and the right to receive the return of pension insurance benefits is extinguished by prescription when five years have passed from the time when it becomes exercisable.
保険料その他この法律の規定による徴収金を徴収し、又はその還付を受ける権利は、これらを行使することができる時から二年を経過したとき、保険給付を受ける権利は、その支給すべき事由が生じた日から五年を経過したとき、当該権利に基づき支払期月ごとに支払うものとされる保険給付の支給を受ける権利は、当該日の属する月の翌月以後に到来する当該保険給付の支給に係る第三十六条第三項本文に規定する支払期月の翌月の初日から五年を経過したとき、保険給付の返還を受ける権利は、これを行使することができる時から五年を経過したときは、時効によつて、消滅する。
With regard to prescription of the right to collect insurance premiums and other monies to be collected under the provisions of this Act or to receive a refund of them, or of the right to receive the return of pension insurance benefits, it is not necessary to invoke prescription, and the benefit of it cannot be waived.
保険料その他この法律の規定による徴収金を徴収し、若しくはその還付を受ける権利又は保険給付の返還を受ける権利の時効については、その援用を要せず、また、その利益を放棄することができないものとする。
The period of prescription of the right to receive pension insurance benefits does not run during any time in which the payment of the entire amount of pension insurance benefits has been suspended.
年金たる保険給付を受ける権利の時効は、当該年金たる保険給付がその全額につき支給を停止されている間は、進行しない。
Payment notices for insurance premiums and other monies to be collected under the provisions of this Act and demands for payment under the provisions of Article 86, paragraph (1) have the effect of renewing prescription.
保険料その他この法律の規定による徴収金の納入の告知又は第八十六条第一項の規定による督促は、時効の更新の効力を有する。
The provisions of Article 31 of the Public Accounting Act (Act No. 35 of 1947) do not apply to the right to receive pension insurance benefits as provided in paragraph (1) or to the right to receive payment of pension insurance benefits that are to be paid in each payment month based on that right.
第一項に規定する保険給付を受ける権利又は当該権利に基づき支払期月ごとに支払うものとされる保険給付の支給を受ける権利については、会計法（昭和二十二年法律第三十五号）第三十一条の規定を適用しない。
