Chapter I General Provisions
第一章 総則
第一条(目的)
The purpose of this Act is, in order to ensure the appropriate implementation of the child and child-rearing support prescribed in Article 7, paragraph (1) of the Act on Support for Children and Child-rearing (Act No. 65 of 2012), under the basic recognition that parents and other guardians have primary responsibility for child-rearing, to contribute to the stability of life in households, etc. and to promote the sound growth of children who will bear responsibility for the society of the next generation, by paying child allowance to persons who are raising children.
この法律は、子ども・子育て支援法(平成二十四年法律第六十五号)第七条第一項に規定する子ども・子育て支援の適切な実施を図るため、父母その他の保護者が子育てについての第一義的責任を有するという基本的認識の下に、児童を養育している者に児童手当を支給することにより、家庭等における生活の安定に寄与するとともに、次代の社会を担う児童の健やかな成長に資することを目的とする。
Article 2Responsibilities of Recipients
第二条(受給者の責務)
A person who has received payment of child allowance must use it in accordance with the purpose for which it is paid, in light of the fact that child allowance is paid in order to achieve the purpose set forth in the preceding Article.
児童手当の支給を受けた者は、児童手当が前条の目的を達成するために支給されるものである趣旨にかんがみ、これをその趣旨に従つて用いなければならない。
第三条(定義)
In this Act, "child" means a person who is in the period up to the first March 31 on or after the day on which the person reaches the age of eighteen, and who either has a domicile in Japan or does not have a domicile in Japan for a reason specified by Cabinet Office Order, such as study abroad.
この法律において「児童」とは、十八歳に達する日以後の最初の三月三十一日までの間にある者であつて、日本国内に住所を有するもの又は留学その他の内閣府令で定める理由により日本国内に住所を有しないものをいう。
The term "father" as used in this Act is to include a person who, at the time the mother conceived the child, had not filed a notification of marriage but was in circumstances equivalent to a de facto marital relationship with the mother.
この法律にいう「父」には、母が児童を懐胎した当時婚姻の届出をしていないが、その母と事実上婚姻関係と同様の事情にあつた者を含むものとする。
In this Act, "child placed in a facility, etc." means a child listed in the following:
この法律において「施設入所等児童」とは、次に掲げる児童をいう。
a child who is receiving child independent living assistance prescribed in Article 6-3, paragraph (1) of the Child Welfare Act (Act No. 164 of 1947) (excluding assistance for a period specified by Cabinet Office Order that is within two months; hereinafter referred to as "child independent living assistance") from a person who conducts the child independent living assistance project prescribed in that paragraph (hereinafter referred to as the "child independent living assistance project") pursuant to the provisions of Article 33-6, paragraph (1) of that Act;
児童福祉法(昭和二十二年法律第百六十四号)第三十三条の六第一項の規定により同法第六条の三第一項に規定する児童自立生活援助事業(以下「児童自立生活援助事業」という。)を行う者から同項に規定する児童自立生活援助(二月以内で内閣府令で定める期間以内のものを除く。以下「児童自立生活援助」という。)を受けている児童
a child who has been entrusted, pursuant to the provisions of Article 27, paragraph (1), item (iii) of the Child Welfare Act, to a person who conducts the small-scale residential child care project prescribed in Article 6-3, paragraph (8) of that Act (hereinafter referred to as the "small-scale residential child care project") or to a foster parent prescribed in Article 6-4 of that Act (hereinafter referred to as a "foster parent") (excluding a person who has been entrusted for a short period specified by Cabinet Office Order);
児童福祉法第二十七条第一項第三号の規定により同法第六条の三第八項に規定する小規模住居型児童養育事業(以下「小規模住居型児童養育事業」という。)を行う者又は同法第六条の四に規定する里親(以下「里親」という。)に委託されている児童(内閣府令で定める短期間の委託をされている者を除く。)
a child who is admitted to a maternal and child living support facility prescribed in Article 38 of the Child Welfare Act (hereinafter referred to as a "maternal and child living support facility") pursuant to the provisions of Article 23, paragraph (1) of that Act, who is admitted to a residential facility for children with disabilities prescribed in Article 42 of that Act (hereinafter referred to as a "residential facility for children with disabilities") after receiving payment of benefits for admission to a residential facility for children with disabilities pursuant to the provisions of Article 24-2, paragraph (1) of that Act or after a placement measure has been taken pursuant to the provisions of Article 27, paragraph (1), item (iii) of that Act, or who is hospitalized in a designated medical institution for developmental support prescribed in Article 7, paragraph (2) of that Act (referred to as a "designated medical institution for developmental support" in paragraph (1), item (iv) of the following Article) pursuant to the provisions of Article 27, paragraph (2) of that Act, or who is admitted to an infant home prescribed in Article 37 of that Act, a children's home prescribed in Article 41 of that Act, a psychological treatment facility for children prescribed in Article 43-2 of that Act or a children's self-reliance support facility prescribed in Article 44 of that Act (hereinafter referred to as an "infant home, etc.") after a placement measure has been taken pursuant to the provisions of Article 27, paragraph (1), item (iii) or Article 27-2, paragraph (1) of that Act (excluding a person who attends the psychological treatment facility for children or the children's self-reliance support facility and a person who is admitted for a short period specified by Cabinet Office Order, and, as for a child admitted to the maternal and child living support facility, limited to a child who belongs to a household composed solely of children);
児童福祉法第二十三条第一項の規定により同法第三十八条に規定する母子生活支援施設(以下「母子生活支援施設」という。)に入所し、同法第二十四条の二第一項の規定により障害児入所給付費の支給を受けて若しくは同法第二十七条第一項第三号の規定により入所措置が採られて同法第四十二条に規定する障害児入所施設(以下「障害児入所施設」という。)に入所し、若しくは同法第二十七条第二項の規定により同法第七条第二項に規定する指定発達支援医療機関(次条第一項第四号において「指定発達支援医療機関」という。)に入院し、又は同法第二十七条第一項第三号若しくは第二十七条の二第一項の規定により入所措置が採られて同法第三十七条に規定する乳児院、同法第四十一条に規定する児童養護施設、同法第四十三条の二に規定する児童心理治療施設若しくは同法第四十四条に規定する児童自立支援施設(以下「乳児院等」という。)に入所している児童(当該児童心理治療施設又は児童自立支援施設に通う者及び内閣府令で定める短期間の入所をしている者を除き、当該母子生活支援施設に入所しているものにあつては児童のみで構成する世帯に属しているものに限る。)
a child who is admitted to a facility designed to support persons with disabilities (meaning a facility designed to support persons with disabilities prescribed in Article 5, paragraph (11) of the Act on Providing Comprehensive Support for the Daily Life and Life in Society of Persons with Disabilities; the same applies hereinafter) or Nozominosono (meaning the facility established by the National Center for Persons with Severe Intellectual Disabilities, "Nozominosono," Independent Administrative Agency pursuant to the provisions of Article 11, item (i) of the Act on the National Center for Persons with Severe Intellectual Disabilities, "Nozominosono," Independent Administrative Agency (Act No. 167 of 2002); the same applies hereinafter) after receiving payment of benefits for nursing care, etc. prescribed in Article 19, paragraph (1) of the Act on Providing Comprehensive Support for the Daily Life and Life in Society of Persons with Disabilities (Act No. 123 of 2005) pursuant to the provisions of Article 29, paragraph (1) or Article 30, paragraph (1) of that Act, or after a placement measure has been taken pursuant to the provisions of Article 18, paragraph (2) of the Act on Welfare of Physically Disabled Persons (Act No. 283 of 1949) or Article 16, paragraph (1), item (ii) of the Act on Welfare of Mentally Retarded Persons (Act No. 37 of 1960) (excluding a person who is admitted for a short period specified by Cabinet Office Order, and limited to a child who belongs to a household composed solely of children);
障害者の日常生活及び社会生活を総合的に支援するための法律(平成十七年法律第百二十三号)第二十九条第一項若しくは第三十条第一項の規定により同法第十九条第一項に規定する介護給付費等の支給を受けて又は身体障害者福祉法(昭和二十四年法律第二百八十三号)第十八条第二項若しくは知的障害者福祉法(昭和三十五年法律第三十七号)第十六条第一項第二号の規定により入所措置が採られて障害者支援施設(障害者の日常生活及び社会生活を総合的に支援するための法律第五条第十一項に規定する障害者支援施設をいう。以下同じ。)又はのぞみの園(独立行政法人国立重度知的障害者総合施設のぞみの園法(平成十四年法律第百六十七号)第十一条第一号の規定により独立行政法人国立重度知的障害者総合施設のぞみの園が設置する施設をいう。以下同じ。)に入所している児童(内閣府令で定める短期間の入所をしている者を除き、児童のみで構成する世帯に属している者に限る。)
a child who is admitted to a relief facility prescribed in Article 38, paragraph (2) of the Public Assistance Act (Act No. 144 of 1950) (hereinafter referred to as a "relief facility"), a rehabilitation facility prescribed in paragraph (3) of that Article (hereinafter referred to as a "rehabilitation facility") or a residential facility for daily living support prescribed in the proviso to Article 30, paragraph (1) of that Act (referred to as a "residential facility for daily living support" in paragraph (1), item (iv) of the following Article) pursuant to the provisions of the proviso to Article 30, paragraph (1) of that Act, or who is admitted to a women's self-reliance support facility prescribed in Article 12, paragraph (1) of the Act on Support for Women Facing Difficult Problems (Act No. 52 of 2022) (referred to as a "women's self-reliance support facility" in that item) (excluding a person who is admitted for a short period specified by Cabinet Office Order, and limited to a child who belongs to a household composed solely of children).
生活保護法(昭和二十五年法律第百四十四号)第三十条第一項ただし書の規定により同法第三十八条第二項に規定する救護施設(以下「救護施設」という。)、同条第三項に規定する更生施設(以下「更生施設」という。)若しくは同法第三十条第一項ただし書に規定する日常生活支援住居施設(次条第一項第四号において「日常生活支援住居施設」という。)に入所し、又は困難な問題を抱える女性への支援に関する法律(令和四年法律第五十二号)第十二条第一項に規定する女性自立支援施設(同号において「女性自立支援施設」という。)に入所している児童(内閣府令で定める短期間の入所をしている者を除き、児童のみで構成する世帯に属している者に限る。)
Chapter II Payment of Child Allowance
第二章 児童手当の支給
Article 4Requirement for Payment
第四条(支給要件)
Child allowance is to be paid to a person who falls under any of the following items:
児童手当は、次の各号のいずれかに該当する者に支給する。
the father or mother of a child other than a child placed in a facility, etc. (hereinafter referred to as a "child under the requirements for payment") who raises that child and shares a livelihood with that child (or, if there is a guardian of a minor for that child under the requirements for payment, that guardian of a minor; hereinafter referred to as a "parent, etc." in this paragraph), and who has a domicile in Japan (if the guardian of a minor is a corporation, the domicile is the location of its principal office);
among persons who live with, raise, and share a livelihood with a child under the requirements for payment whose livelihood is maintained by a parent, etc. who does not have a domicile in Japan (or, if it is found difficult to live with that child under the requirements for payment, persons who raise, and share a livelihood with, that child under the requirements for payment), a person who is designated by the parent, etc. maintaining the livelihood of that child under the requirements for payment and who has a domicile in Japan (excluding the parent, etc. of that child under the requirements for payment; hereinafter referred to as a "parent's designee");
a person who has a domicile in Japan and who raises, and maintains the livelihood of, a child under the requirements for payment who is not raised by any parent, etc. or parent's designee, or who does not share a livelihood with any of them;
a person who conducts child independent living assistance for a child placed in a facility, etc., a person who conducts the small-scale residential child care project or a foster parent to whom a child placed in a facility, etc. has been entrusted, or the founder of a maternal and child living support facility, residential facility for children with disabilities, designated medical institution for developmental support, infant home, etc., facility designed to support persons with disabilities, Nozominosono, relief facility, rehabilitation facility, residential facility for daily living support or women's self-reliance support facility (hereinafter referred to as a "residential facility for children with disabilities, etc.") in which a child placed in a facility, etc. is admitted or hospitalized.
施設入所等児童に対し児童自立生活援助を行う者、施設入所等児童が委託されている小規模住居型児童養育事業を行う者若しくは里親又は施設入所等児童が入所若しくは入院をしている母子生活支援施設、障害児入所施設、指定発達支援医療機関、乳児院等、障害者支援施設、のぞみの園、救護施設、更生施設、日常生活支援住居施設若しくは女性自立支援施設(以下「障害児入所施設等」という。)の設置者
In the case of item (i) of the preceding paragraph, if there are several guardians of a minor who raise a child and share a livelihood with that child, that child is deemed to be raised by, and to share a livelihood with, whichever of those guardians of minors maintains the livelihood of that child to the higher degree.
In the case of item (i) or (ii) of paragraph (1), if two or more of the father and mother, a guardian of a minor, and a parent's designee raise a child who is a child of the father and mother and share a livelihood with that child, that child is deemed to be raised by, and to share a livelihood with, whichever of that father or mother, guardian of a minor or parent's designee maintains the livelihood of that child to the higher degree.
Notwithstanding the preceding two paragraphs, if any one of the father or mother, a guardian of a minor, or a parent's designee who raises a child and shares a livelihood with that child lives with that child (limited to the case where that one does not share a livelihood with any other father or mother, guardian of a minor or parent's designee who raises that child and shares a livelihood with that child), that child is deemed to be raised by, and to share a livelihood with, the father or mother, guardian of a minor, or parent's designee who lives with that child.

Article 6Amount of Child Allowance
第六条(児童手当の額)
Child allowance is to be paid on a monthly basis, and its amount per month is the amount specified in each of the following items according to the category of child allowance set forth in that item.
児童手当は、月を単位として支給するものとし、その額は、一月につき、次の各号に掲げる児童手当の区分に応じ、当該各号に定める額とする。
child allowance for an individual eligible recipient: the amount set forth in the column of the amount paid, according to the categories set forth in the column of the number of persons counted for the amount for third and later children and covered children in the following table;

child allowance for a corporate eligible recipient: the sum of the amount obtained by multiplying the amount for children aged three or over by the number of persons each of whom is a covered child aged three or over and the amount obtained by multiplying the amount for children under three by the number of persons each of whom is a covered child under three;
法人受給資格者の児童手当 三歳以上児童算定額に三歳以上支給対象児童の数を乗じた額と、三歳未満児童算定額に三歳未満支給対象児童の数を乗じた額を合算した額
child allowance for a facility eligible recipient: the sum of the amount obtained by multiplying the amount for children aged three or over by the number of persons each of whom is a child placed in a facility, etc. aged three or over and the amount obtained by multiplying the amount for children under three by the number of persons each of whom is a child placed in a facility, etc. under three.
施設等受給資格者の児童手当 三歳以上児童算定額に三歳以上施設入所等児童の数を乗じた額と、三歳未満児童算定額に三歳未満施設入所等児童の数を乗じた額を合算した額
In this Article, the meanings of the terms set forth in the following items are as prescribed in those items:
この条において、次の各号に掲げる用語の意義は、当該各号に定めるところによる。
"individual eligible recipient" means a general eligible recipient prescribed in paragraph (1) of the following Article (referred to as a "general eligible recipient" in item (vi)) other than a corporate eligible recipient;
"person counted for the amount for third and later children" means a person who is in the period up to the first March 31 on or after the day on which the person attains the age of 22 (excluding children and extended persons, etc. (meaning extended persons prescribed in Article 31, paragraph (4) of the Child Welfare Act and persons similar thereto specified by Cabinet Office Order, limited to those who have passed the first March 31 on or after the day on which they attained the age of 18)), who is specified by Cabinet Office Order as a person for whom an individual eligible recipient provides daily care equivalent to raising the person and necessary protection and bears a considerable part of the person's living expenses, and who has a domicile in Japan or does not have a domicile in Japan for a reason specified by Cabinet Office Order, such as study abroad;
"covered child" means a child under the requirements for payment pertaining to the certification under paragraph (1) of the following Article;
"covered child aged three or over" means a covered child aged three or over (in the case of a covered child born on the first day of a month, one for whom three years have passed from the day of birth);
三歳以上支給対象児童 三歳以上の支給対象児童(月の初日に生まれた支給対象児童にあつては、出生の日から三年を経過したもの)をいう。
"covered child under three" means a covered child under the age of three (in the case of a covered child born on the first day of a month, one for whom three years have not passed from the day of birth);
三歳未満支給対象児童 三歳未満の支給対象児童(月の初日に生まれた支給対象児童にあつては、出生の日から三年を経過しないもの)をいう。
"corporate eligible recipient" means a general eligible recipient (limited to a person falling under Article 4, paragraph (1), item (i)) who is a guardian of a minor and is a corporation;
"facility eligible recipient" means a facility eligible recipient prescribed in paragraph (2) of the following Article;
施設等受給資格者 次条第二項に規定する施設等受給資格者をいう。
"child placed in a facility, etc. aged three or over" means a child placed in a facility, etc. aged three or over pertaining to the certification under paragraph (2) of the following Article (in the case of a child placed in a facility, etc. born on the first day of a month, one for whom three years have passed from the day of birth);
"child placed in a facility, etc. under three" means a child placed in a facility, etc. under the age of three pertaining to the certification under paragraph (2) of the following Article (in the case of a child placed in a facility, etc. born on the first day of a month, one for whom three years have not passed from the day of birth).
The "amount for children under three" in paragraph (1) is 15,000 yen, the "amount for children aged three or over" is 10,000 yen, and the "amount for third and later children" is 30,000 yen.
第一項の「三歳未満児童算定額」は一万五千円とし、「三歳以上児童算定額」は一万円とし、「第三子以降算定額」は三万円とする。
If a significant change occurs in the standard of living of the people or other circumstances, the amount of child allowance must be promptly revised so as to respond to the circumstances after the change.
児童手当の額は、国民の生活水準その他の諸事情に著しい変動が生じた場合には、変動後の諸事情に応ずるため、速やかに改定の措置が講ぜられなければならない。
第七条(認定)
A person who satisfies the requirements for payment of child allowance (limited to those pertaining to Article 4, paragraph (1), items (i) to (iii); hereinafter referred to as a "general eligible recipient") must, when seeking to receive payment of child allowance, obtain certification of the person's eligibility and the amount of child allowance from the mayor of the municipality (including the head of a special ward; the same applies hereinafter) of the place of domicile (or, where the general eligible recipient is a guardian of a minor and is a corporation, the location of the principal office), as provided by Cabinet Office Order.
児童手当の支給要件に該当する者(第四条第一項第一号から第三号までに係るものに限る。以下「一般受給資格者」という。)は、児童手当の支給を受けようとするときは、その受給資格及び児童手当の額について、内閣府令で定めるところにより、住所地(一般受給資格者が未成年後見人であり、かつ、法人である場合にあつては、主たる事務所の所在地とする。)の市町村長(特別区の区長を含む。以下同じ。)の認定を受けなければならない。
A person who satisfies the requirements for payment of child allowance (limited to those pertaining to Article 4, paragraph (1), item (iv); hereinafter referred to as a "facility eligible recipient") must, when seeking to receive payment of child allowance, obtain certification of the person's eligibility and the amount of child allowance, as provided by Cabinet Office Order, from the person specified in each of the following items according to the category of persons set forth in the relevant item:
児童手当の支給要件に該当する者(第四条第一項第四号に係るものに限る。以下「施設等受給資格者」という。)は、児童手当の支給を受けようとするときは、その受給資格及び児童手当の額について、内閣府令で定めるところにより、次の各号に掲げる者の区分に応じ、当該各号に定める者の認定を受けなければならない。
A person who conducts a child independent living assistance project or a small-scale residential child care project: the mayor of the municipality of the place where child independent living assistance is provided or the location of the residence where the small-scale residential child care project is conducted;
児童自立生活援助事業又は小規模住居型児童養育事業を行う者 児童自立生活援助を行う場所又は小規模住居型児童養育事業を行う住居の所在地の市町村長
A foster parent: the mayor of the municipality of the place of domicile of the foster parent;
里親 当該里親の住所地の市町村長
The founder of a residential facility for children with disabilities, etc.: the mayor of the municipality of the location of the residential facility for children with disabilities, etc.
障害児入所施設等の設置者 当該障害児入所施設等の所在地の市町村長
If a person who has obtained the certification under the preceding two paragraphs changes the person's domicile (or, where the general eligible recipient is a guardian of a minor and is a corporation, the location of the principal office; where the facility eligible recipient is a person who conducts a child independent living assistance project or a small-scale residential child care project, the place where child independent living assistance is provided or the location of the residence where the small-scale residential child care project is conducted; and where the facility eligible recipient is the founder of a residential facility for children with disabilities, etc., the location of that residential facility for children with disabilities, etc.; the same applies in paragraph (3) of the following Article) to within the area of another municipality (including a special ward; the same applies hereinafter), and seeks to receive payment of child allowance for the period after the change, the same applies as in the preceding two paragraphs.
前二項の認定を受けた者が、他の市町村(特別区を含む。以下同じ。)の区域内に住所(一般受給資格者が未成年後見人であり、かつ、法人である場合にあつては主たる事務所の所在地とし、施設等受給資格者が児童自立生活援助事業又は小規模住居型児童養育事業を行う者である場合にあつては児童自立生活援助を行う場所又は小規模住居型児童養育事業を行う住居の所在地とし、障害児入所施設等の設置者である場合にあつては当該障害児入所施設等の所在地とする。次条第三項において同じ。)を変更した場合において、その変更後の期間に係る児童手当の支給を受けようとするときも、前二項と同様とする。
Article 8Payment and Disbursement
第八条(支給及び支払)
The mayor of the municipality is to pay child allowance to general eligible recipients and facility eligible recipients for whom certification has been given under the preceding Article (hereinafter referred to as "eligible recipients").
Payment of child allowance begins with the month following the month that includes the day on which the eligible recipient made the claim for certification under the provisions of the preceding Article, and ends with the month that includes the day on which the grounds for payment of child allowance ceased to exist.
If an eligible recipient has changed domicile, or was unable to make the claim for certification under the provisions of the preceding Article due to a disaster or other unavoidable reason, and makes the claim within 15 days after the eligible recipient changed domicile or after the unavoidable reason ceased, notwithstanding the provisions of the preceding paragraph, payment of child allowance begins with the month following the month that includes the day on which the eligible recipient changed domicile or the day on which the eligible recipient became unable to make the claim for certification due to the unavoidable reason.
Child allowance is paid in six periods, in February, April, June, August, October and December of each year, covering the portion up to the month preceding each of those months; provided, however, that child allowance that should have been paid in the preceding payment month, and child allowance for the period in the case where the grounds for payment have ceased to exist, are to be paid even in a month that is not a payment month.
児童手当は、毎年二月、四月、六月、八月、十月及び十二月の六期に、それぞれの前月までの分を支払う。ただし、前支払期月に支払うべきであつた児童手当又は支給すべき事由が消滅した場合におけるその期の児童手当は、その支払期月でない月であつても、支払うものとする。
Article 9Revision of the Amount of Child Allowance
第九条(児童手当の額の改定)
Where the amount of child allowance comes to be increased for a person receiving payment of child allowance, the revision of the amount of child allowance is made from the month following the month that includes the day on which the person made a claim for certification for the revised amount.
児童手当の支給を受けている者につき、児童手当の額が増額することとなるに至つた場合における児童手当の額の改定は、その者がその改定後の額につき認定の請求をした日の属する月の翌月から行う。
The provisions of paragraph (3) of the preceding Article apply mutatis mutandis to the revision under the preceding paragraph.
Where the amount of child allowance comes to be reduced for a person receiving payment of child allowance, the revision of the amount of child allowance is made from the month following the month that includes the day on which the grounds for it arose.
児童手当の支給を受けている者につき、児童手当の額が減額することとなるに至つた場合における児童手当の額の改定は、その事由が生じた日の属する月の翌月から行う。
Article 10Restriction on Payment
第十条(支給の制限)
Child allowance may be withheld in whole or in part if an eligible recipient, without a justifiable reason, fails to comply with an order under Article 27, paragraph (1) or fails to respond to questioning by the relevant official under that paragraph.
第十一条
If a person receiving payment of child allowance, without a justifiable reason, fails to submit a notification under Article 26 or fails to submit the documents under that Article, payment of child allowance may be temporarily suspended.
Article 12Unpaid Child Allowance
第十二条(未支払の児童手当)
If a general eligible recipient of child allowance dies, and there is child allowance payable to the deceased person (limited to the portion relating to a person who was a child raised by that person) that had not yet been paid to that person, the unpaid child allowance may be paid to the person who was that child.
If a child placed in a facility, etc. ceases to fall under the children set forth in the items of Article 3, paragraph (3), and there is child allowance payable to the facility eligible recipient that conducted child independent living assistance for that child placed in a facility, etc., the facility eligible recipient to whom that child placed in a facility, etc. had been entrusted, or the facility eligible recipient relating to the residential facility for children with disabilities, etc. in which that child placed in a facility, etc. had been admitted or hospitalized (limited to the portion relating to the person who was that child placed in a facility, etc.) that had not yet been paid to that person, the unpaid child allowance may be paid to the person who was that child placed in a facility, etc.
If payment has been made under the provisions of the preceding paragraph, the payment of child allowance concerned is deemed to have been made to the facility eligible recipient concerned.
Article 13Adjustment of Payments
第十三条(支払の調整)
If payment has been made as payment of child allowance even though child allowance should not have been paid, the child allowance so paid may be deemed to be an advance payment of child allowance to be paid thereafter. The same applies to the portion that should have been reduced of the child allowance, in the case where, although grounds for reducing and revising the amount of child allowance have arisen, child allowance of an amount not reduced has been paid as the portion for the month following the month that includes the day on which those grounds arose and thereafter.
児童手当を支給すべきでないにもかかわらず、児童手当の支給としての支払が行なわれたときは、その支払われた児童手当は、その後に支払うべき児童手当の内払とみなすことができる。児童手当の額を減額して改定すべき事由が生じたにもかかわらず、その事由が生じた日の属する月の翌月以降の分として減額しない額の児童手当が支払われた場合における当該児童手当の当該減額すべきであつた部分についても、同様とする。
Article 14Collection of Wrongful Gain
第十四条(不正利得の徴収)
If there is a person who has received payment of child allowance by deception or other wrongful means, the mayor of the municipality may collect from that person all or part of an amount equivalent to the amount received, in the same manner as for a disposition for delinquent local taxes.
偽りその他不正の手段により児童手当の支給を受けた者があるときは、市町村長は、地方税の滞納処分の例により、受給額に相当する金額の全部又は一部をその者から徴収することができる。
The order of priority of the statutory lien on money collected under the preceding paragraph is to rank next after national taxes and local taxes.
前項の規定による徴収金の先取特権の順位は、国税及び地方税に次ぐものとする。
Article 15Protection of the Right to Receive
第十五条(受給権の保護)
The right to receive payment of child allowance may not be transferred, offered as security, or seized.
児童手当の支給を受ける権利は、譲り渡し、担保に供し、又は差し押えることができない。
Article 16Prohibition of Public Charges
第十六条(公課の禁止)
Taxes and other public charges may not be imposed using money received as child allowance as the standard.
租税その他の公課は、児童手当として支給を受けた金銭を標準として、課することができない。
Article 17Special Provisions for Public Employees
第十七条(公務員に関する特例)
In the case of applying the provisions of this Chapter to a general eligible recipient who is a person set forth in the left column of the following table (hereinafter referred to as a "public employee"), the phrase "the mayor of the municipality (including the head of a special ward; the same applies hereinafter) of the place of domicile (or, where the general eligible recipient is a guardian of a minor and is a corporation, the location of the principal office)" in Article 7, paragraph (1), and the term "mayor of the municipality" in Article 8, paragraph (1) and Article 14, paragraph (1), are deemed to be replaced with the wording in the right column of that table, respectively.

The provisions of Article 7, paragraph (3) apply mutatis mutandis to the case where a person who has received the certification under paragraph (1) of that Article as deemed to be replaced under the preceding paragraph comes to have a different person who made that certification.
With regard to a person who has received the certification under Article 7, paragraph (1) as deemed to be replaced under the provisions of paragraph (1), the phrase "changed domicile" in Article 8, paragraph (3) is deemed to be replaced with "had a change in the person who makes that certification".
Chapter III Costs
第三章 費用
Article 18Burden of Costs Required for Child Allowance
第十八条(児童手当に要する費用の負担)
The costs required for payment of child allowance for children under three (meaning the portion of child allowance calculated on the basis of the number of covered children under three prescribed in Article 6, paragraph (2), item (v) or of children placed in a facility, etc. under three prescribed in item (ix) of that paragraph, or the amount for children under three prescribed in paragraph (3) of that Article; the same applies hereinafter in this Chapter) to an employee (meaning an insured person who is not a public employee and for whom a person set forth in the items of Article 69, paragraph (1) of the Act on Support for Children and Child-rearing is obliged to bear or pay insurance premiums; the same applies hereinafter) are to be covered, as to the entire amount, by the grant from the national government under paragraph (1) of the following Article.
The costs required for payment of child allowance for children under three to a person who is not an employee, etc. (meaning a person who is not an employee or a public employee (excluding a public employee who is a facility eligible recipient); the same applies hereinafter) are to be covered, as to the amount equivalent to thirteen-fifteenths thereof, by the grant from the national government under paragraph (2) of the following Article, and as to the amount equivalent to one-fifteenth thereof, by the grant from the prefecture under Article 19-2, paragraph (1), and the municipality bears the amount equivalent to one-fifteenth of those costs.
The costs required for payment of child allowance for children aged three or over (meaning child allowance excluding child allowance for children under three; the same applies hereinafter in this Chapter) to employees and persons who are not employees, etc. are to be covered, as to the amount equivalent to seven-ninths thereof, by the grant from the national government under paragraph (3) of the following Article, and as to the amount equivalent to one-ninth thereof, by the grant from the prefecture under Article 19-2, paragraph (2), and the municipality bears the amount equivalent to one-ninth of those costs.
The costs required for payment of child allowance set forth in the following are to be borne by the persons specified in the respective items:
次に掲げる児童手当の支給に要する費用は、それぞれ当該各号に定める者が負担する。

the costs required for payment of child allowance to a local public employee in respect of whom the governor of a prefecture or a person delegated by the governor has made the certification (if that local public employee is a facility eligible recipient, excluding the portion relating to the amount of child allowance for a child placed in a facility, etc.): the prefecture concerned;
the costs required for payment of child allowance to a local public employee in respect of whom the mayor of the municipality or a person delegated by the mayor has made the certification (if that local public employee is a facility eligible recipient, excluding the portion relating to the amount of child allowance for a child placed in a facility, etc.): the municipality concerned.
The National Treasury is to bear, each fiscal year within the limits of the budget, the costs required for the execution of administrative affairs relating to child allowance (excluding the costs necessary for processing the affairs of child allowance paid by the mayor of the municipality pursuant to the provisions of Article 8, paragraph (1)).
国庫は、毎年度、予算の範囲内で、児童手当に関する事務の執行に要する費用(市町村長が第八条第一項の規定により支給する児童手当の事務の処理に必要な費用を除く。)を負担する。
With regard to the bearing of costs under the provisions of paragraphs (1) through (3), for the period from the month following the month that includes the day on which a claim for certification under Article 7 was made until July of that year or of the following year (for a person who has submitted a notification under Article 26, paragraph (1) or (2), the period from August of that year until July of the following year), it is based on the category of employee or person who is not an employee, etc. at the time of making the claim for certification (for a person who has submitted a notification under Article 26, paragraph (1) or (2), on June 1).
Article 19Grants from the National Government to Municipalities
第十九条(国から市町村に対する交付)
The government is to grant to municipalities, as provided by Cabinet Order, in order to have it allocated to the portion of the costs required for payment of child allowance paid by the mayor of the municipality pursuant to the provisions of Article 8, paragraph (1) that relates to child allowance for children under three for employees, an amount equivalent to the full amount of that portion of the costs. In this case, of the grants made by the government, the amount equivalent to two-fifths is to be sourced from the contributions prescribed in Article 69, paragraph (1) of the Act on Support for Children and Child-rearing, and the amount equivalent to three-fifths from the children and child-rearing support levy prescribed in Article 71-3, paragraph (1) of that Act (hereinafter in this Article referred to as the "children and child-rearing support levy").
The government is to grant to a municipality, as provided by Cabinet Order, in order to have it allocated to the portion of the costs required for payment of child allowance paid by the mayor of the municipality under Article 8, paragraph (1) that relates to child allowance for children under three for persons who are not employees, etc., an amount equivalent to thirteen-fifteenths of that portion of the costs. In this case, of the grants made by the government, an amount equivalent to four-fifteenths of those costs is borne by the National Treasury, and an amount equivalent to three-fifths of those costs is to be sourced from the children and child-rearing support levy.
政府は、政令で定めるところにより、市町村に対し、市町村長が第八条第一項の規定により支給する児童手当の支給に要する費用のうち被用者等でない者の三歳未満児童手当に係る部分に充当させるため、その十五分の十三に相当する額を交付する。この場合において、政府が交付する交付金のうち、当該費用の十五分の四に相当する額は国庫が負担し、当該費用の五分の三に相当する額は子ども・子育て支援納付金を原資とする。

Article 19-2Grants from Prefectures to Municipalities
第十九条の二(都道府県から市町村に対する交付)
A prefecture is to bear, with respect to a municipality, an amount equivalent to one-fifteenth of the portion of the costs required for payment of child allowance paid by the mayor of the municipality under Article 8, paragraph (1) that relates to child allowance for children under three for persons who are not employees, etc., and is to grant that amount to the municipality to be allocated to those costs.
A prefecture is to bear, with respect to a municipality, an amount equivalent to one-ninth of the portion of the costs required for payment of child allowance paid by the mayor of the municipality under Article 8, paragraph (1) that relates to child allowance for children aged three or over for employees and persons who are not employees, etc., and is to grant that amount to the municipality to be allocated to those costs.
Chapter IV Miscellaneous Provisions
第四章 雑則
Article 20Donations Relating to Child Allowance
第二十条(児童手当に係る寄附)
If an eligible recipient, in order to support the healthy growth of children who will bear the responsibility for the next generation of society, before receiving payment of child allowance, states to the municipality that pays child allowance to the eligible recipient, as provided by Cabinet Office Order, that the eligible recipient will donate all or part of the amount of that child allowance to the municipality, the municipality may, as provided by Cabinet Office Order, in order to receive the donation, receive, in place of the eligible recipient, the portion pertaining to the donation of the amount of child allowance that the eligible recipient is to be paid.
A municipality must use a donation received under the preceding paragraph to support the healthy growth of a child who will bear the responsibility for the next generation of society.
Article 21Collection of School Lunch Fees, etc. at the Request of Eligible Recipients
第二十一条(受給資格者の申出による学校給食費等の徴収等)
If an eligible recipient, before receiving payment of child allowance, requests, as provided by Cabinet Office Order, that all or part of the amount of that child allowance be applied to payment of those of the school lunch fee prescribed in Article 11, paragraph (2) of the School Lunch Program Act (Act No. 160 of 1954) (referred to as the "school lunch fee" in the following paragraph) and other expenses necessary in connection with school education specified by Cabinet Office Order, or of the expenses collected pursuant to Article 56, paragraph (2) of the Child Welfare Act (limited to those pertaining to Article 51, item (iv) or (v) of that Act) and other expenses specified by Cabinet Office Order as being similar thereto, that are to be paid to the municipality in respect of a child concerning the eligible recipient, the mayor of the municipality may, as provided by Cabinet Office Order, collect the expenses pertaining to the request when paying child allowance to the eligible recipient.
市町村長は、受給資格者が、児童手当の支払を受ける前に、内閣府令で定めるところにより、当該児童手当の額の全部又は一部を、学校給食法(昭和二十九年法律第百六十号)第十一条第二項に規定する学校給食費(次項において「学校給食費」という。)その他の学校教育に伴つて必要な内閣府令で定める費用又は児童福祉法第五十六条第二項の規定により徴収する費用(同法第五十一条第四号又は第五号に係るものに限る。)その他これに類するものとして内閣府令で定める費用のうち当該受給資格者に係る児童に関し当該市町村に支払うべきものの支払に充てる旨を申し出た場合には、内閣府令で定めるところにより、当該受給資格者に児童手当の支払をする際に当該申出に係る費用を徴収することができる。
If an eligible recipient, before receiving payment of child allowance, requests, as provided by Cabinet Office Order, that all or part of the amount of that child allowance be applied to payment of those of the school lunch fee, the expenses provided for in each item of Article 56, paragraph (6) or each item of paragraph (7) of the Child Welfare Act, and other expenses specified by Cabinet Office Order as being similar thereto, that are to be paid in respect of a child concerning the eligible recipient, the mayor of the municipality may, as provided by Cabinet Office Order, pay the portion of the amount of that child allowance pertaining to the request to the person holding the claim for those expenses.
If payment has been made under the provisions of the preceding paragraph, payment of the child allowance (limited to the portion pertaining to the request under that paragraph) is deemed to have been made to the eligible recipient.
第二十二条
Where the mayor of the municipality collects expenses under Article 56, paragraph (2) of the Child Welfare Act (limited to those pertaining to Article 51, item (iv) or (v) of that Act) or collects expenses that may be disposed of in the manner of a disposition for delinquency of local taxes under Article 56, paragraph (6) or (7) of that Act, and an eligible recipient who has obtained certification under Article 7 (including where applied by replacing terms pursuant to Article 17, paragraph (1)) is a person obligated to provide support who is to pay the expenses collected under Article 56, paragraph (2) of that Act (limited to those pertaining to Article 51, item (iv) or (v) of that Act), or a guardian who is to pay the expenses that may be disposed of in the manner of a disposition for delinquency of local taxes under Article 56, paragraph (6) or (7) of that Act, the mayor of the municipality may, as provided by Cabinet Order, collect the childcare fee (meaning the expenses collected under paragraph (2) of that Article (limited to those pertaining to Article 51, item (iv) or (v) of that Act) or the expenses that may be disposed of in the manner of a disposition for delinquency of local taxes under Article 56, paragraph (6) or (7) of that Act; the same applies in the following paragraph) when paying child allowance to the person obligated to provide support or the guardian.
市町村長は、児童福祉法第五十六条第二項の規定により費用(同法第五十一条第四号又は第五号に係るものに限る。)を徴収する場合又は同法第五十六条第六項若しくは第七項の規定により地方税の滞納処分の例により処分することができる費用を徴収する場合において、第七条(第十七条第一項において読み替えて適用する場合を含む。)の認定を受けた受給資格者が同法第五十六条第二項の規定により徴収する費用(同法第五十一条第四号又は第五号に係るものに限る。)を支払うべき扶養義務者又は同法第五十六条第六項若しくは第七項の規定により地方税の滞納処分の例により処分することができる費用を支払うべき保護者である場合には、政令で定めるところにより、当該扶養義務者又は保護者に児童手当の支払をする際に保育料(同条第二項の規定により徴収する費用(同法第五十一条第四号又は第五号に係るものに限る。)又は同法第五十六条第六項若しくは第七項の規定により地方税の滞納処分の例により処分することができる費用をいう。次項において同じ。)を徴収することができる。
When the mayor of the municipality intends to collect the childcare fee by the method of collection under the preceding paragraph (hereinafter in this paragraph referred to as "special collection"), the mayor must notify the person who is to be subject to special collection (hereinafter in this paragraph referred to as the "person subject to special collection") in advance of the fact that the childcare fee pertaining to the person subject to special collection will be collected by the method of special collection, the amount of the childcare fee to be collected from the person subject to special collection by the method of special collection, and other matters specified by Cabinet Office Order.
第二十二条の二(施設等受給資格者が国又は地方公共団体である場合の児童手当の取扱い)
Where a facility eligible recipient is the national government or a local government, the mayor of the municipality is to pay child allowance, as provided by Cabinet Office Order, to a child placed in a facility, etc. who receives child independent living assistance from, is entrusted to, or is admitted to the residential facility for children with disabilities, etc. pertaining to, the facility eligible recipient. In this case, the facility eligible recipient may, as provided by Cabinet Office Order, keep the cash that the child placed in a facility, etc. has received as child allowance.
If payment has been made under the provisions of the preceding paragraph, the payment of child allowance concerned is deemed to have been made to the facility eligible recipient concerned.
第二十三条(時効)
The right to receive payment of child allowance and the right to collect money to be collected under Article 14, paragraph (1) are extinguished by prescription when two years have passed from the time when they became exercisable.
児童手当の支給を受ける権利及び第十四条第一項の規定による徴収金を徴収する権利は、これらを行使することができる時から二年を経過したときは、時効によつて消滅する。
A request for review of a disposition concerning payment of child allowance is deemed to be a judicial claim with regard to the postponement of the completion and renewal of prescription.
児童手当の支給に関する処分についての審査請求は、時効の完成猶予及び更新に関しては、裁判上の請求とみなす。
Notice of payment or demand for payment of money to be collected under Article 14, paragraph (1) has the effect of renewing prescription.
第十四条第一項の規定による徴収金の納入の告知又は督促は、時効の更新の効力を有する。
Article 24Calculation of Periods
第二十四条(期間の計算)
The provisions of the Civil Code (Act No. 89 of 1896) concerning periods apply mutatis mutandis to the calculation of periods prescribed in this Act or orders based on this Act.
この法律又はこの法律に基づく命令に規定する期間の計算については、民法(明治二十九年法律第八十九号)の期間に関する規定を準用する。

第二十六条(届出)
A general eligible recipient (limited to an individual) who is receiving payment of child allowance under Article 8, paragraph (1) must, as provided by Cabinet Office Order, notify the mayor of the municipality of the status of income in the previous year and whether the recipient is an employee or a person who is not an employee, etc. as of June 1 of that year.
A facility eligible recipient (limited to an individual) who is receiving payment of child allowance under Article 8, paragraph (1) must, as provided by Cabinet Office Order, notify the mayor of the municipality of whether the recipient is an employee or a person who is not an employee, etc. as of June 1 of that year.
A person receiving payment of child allowance must, as provided by Cabinet Office Order, in addition to the case of notification under the preceding two paragraphs, notify the mayor of the municipality (including the person who gives the certification under Article 7 as read with terms replaced pursuant to Article 17, paragraph (1); the same applies hereinafter) of matters specified by Cabinet Office Order, and submit documents specified by Cabinet Office Order.
第二十七条(調査)
If the mayor of the municipality finds it necessary, the mayor may order an eligible recipient to submit documents concerning matters relating to the presence or absence of eligibility, the amount of child allowance, and the category of employee or person who is not an employee, etc., or have the relevant official question the eligible recipient or other persons concerned about those matters.
The relevant official who asks questions under the preceding paragraph must carry an identification card showing the official's status and must present it when requested by the persons concerned.
前項の規定によつて質問を行なう当該職員は、その身分を示す証票を携帯し、かつ、関係者の請求があるときは、これを提示しなければならない。
Article 28Provision of Materials, etc.
第二十八条(資料の提供等)
If the mayor of the municipality finds it necessary in relation to a disposition concerning payment of child allowance, the mayor may request government and public offices to allow inspection of necessary documents or provide materials, or request banks, trust companies and other institutions, or employers of eligible recipients and other persons concerned, to report necessary matters.
市町村長は、児童手当の支給に関する処分に関し必要があると認めるときは、官公署に対し、必要な書類の閲覧若しくは資料の提供を求め、又は銀行、信託会社その他の機関若しくは受給資格者の雇用主その他の関係者に対し、必要な事項の報告を求めることができる。
第二十九条(報告等)
A person who gives the certification under Article 7 as read with terms replaced pursuant to Article 17, paragraph (1) is to report to the Prime Minister, as provided by Cabinet Office Order, on the status of payment of child allowance.
Prefectural governors and mayors of municipalities may, at the time of the report under the preceding paragraph, submit opinions to the Prime Minister, in light of local circumstances, on matters necessary for the smooth conduct of the affairs to be handled by prefectures or municipalities under the provisions of this Act.
都道府県知事及び市町村長は、前項の報告に際し、この法律の規定により都道府県又は市町村が処理することとされている事務を円滑に行うために必要な事項について、地域の実情を踏まえ、内閣総理大臣に対して意見を申し出ることができる。
Article 29-2Category of Administrative Affairs
第二十九条の二(事務の区分)
The affairs to be handled by municipalities under the provisions of this Act (excluding Articles 20 through 22-2 and Article 29), including the affairs to be handled by prefectures or municipalities under Article 7, paragraph (1), Article 8, paragraph (1) and Article 14, paragraph (1) as read with terms replaced pursuant to Article 17, paragraph (1), are Type 1 statutory entrusted affairs prescribed in Article 2, paragraph (9), item (i) of the Local Autonomy Act (Act No. 67 of 1947).

第三十条(実施命令)
Beyond what is specially provided for in this Act, detailed rules necessary for procedures for implementing this Act and for other matters concerning its execution are specified by Cabinet Office Order.
この法律に特別の規定があるものを除くほか、この法律の実施のための手続その他その執行について必要な細則は、内閣府令で定める。
第三十一条(罰則)
A person who has received payment of child allowance by deceit or other wrongful means is to be punished by imprisonment of three years or less or a fine of 300,000 yen or less; provided, however, that if there is a provision in the Penal Code (Act No. 45 of 1907), the Penal Code applies.
偽りその他不正の手段により児童手当の支給を受けた者は、三年以下の拘禁刑又は三十万円以下の罰金に処する。ただし、刑法(明治四十年法律第四十五号)に正条があるときは、刑法による。
