Article 7-3Application of Provisions on Liability for Damages of Officers to Third Parties
第七条の三（役員等の第三者に対する損害賠償責任の規定の適用）
With regard to the application of the provisions of Article 429, paragraph (2), item (i), (d) (Liability for Damages of Officers to Third Parties) of the Companies Act to the directors and executive officers of a bank, the phrase "including the measures provided for in Article 440, paragraph (3)" in (d) of that item is deemed to be replaced with "including the measures provided for in Article 440, paragraph (3), and the posting under the provisions of Article 16, paragraph (1) of the Banking Act and the measures to make it available for public inspection under the provisions of paragraph (2) of that Article, the posting under the provisions of Article 38, paragraph (1) of that Act and the measures to make it available for public inspection under the provisions of paragraph (2) of that Article, and the posting under the provisions of Article 52-2-9, paragraph (2) of that Act and the measures to make it available for public inspection under the provisions of paragraph (3) of that Article".
銀行の取締役及び執行役に対する会社法第四百二十九条第二項第一号ニ（役員等の第三者に対する損害賠償責任）の規定の適用については、同号ニ中「を含む」とあるのは、「並びに銀行法第十六条第一項の規定による掲示及び同条第二項の規定による閲覧に供する措置、同法第三十八条第一項の規定による掲示及び同条第二項の規定による閲覧に供する措置並びに同法第五十二条の二の九第二項の規定による掲示及び同条第三項の規定による閲覧に供する措置を含む」とする。
