Supplementary Provisions, Article 1Effective Date

第一条(施行期日)

This Act comes into effect as of the day on which three months have elapsed from the date of promulgation; provided, however, that the provision amending and the provisions of Article 3 of the Supplementary Provisions come into effect as of the day on which 20 days have elapsed from the date of promulgation.

この法律は、公布の日から起算して三月を経過した日から施行する。ただし、の改正規定及び附則第三条の規定は、公布の日から起算して二十日を経過した日から施行する。

Supplementary Provisions, Article 2Transitional Measures Concerning Notification

第二条(通知に関する経過措置)

The provisions of Article 4, paragraphs (3) and as amended by this Act (hereinafter referred to as "the new Act") apply to warnings in the case where a request under paragraph (1) of that Article has been received after this Act comes into effect.

この法律による改正後のストーカー行為等の規制等に関する法律(以下「新法」という。)第四条第三項及び第四項の規定は、この法律の施行後に同条第一項の申出を受けた場合における警告について適用する。

Supplementary Provisions, Article 3Relationship with Ordinances

第三条(条例との関係)

With regard to any provision of an ordinance of a local public entity that provides for the punishment of an act regulated by the new Act, the part concerning that act is to cease to be effective at the same time as the provision amending comes into effect.

地方公共団体の条例の規定で、新法で規制する行為を処罰する旨を定めているものの当該行為に係る部分については、の改正規定の施行と同時に、その効力を失うものとする。

In the case where a provision of an ordinance ceases to be effective pursuant to the provisions of the preceding paragraph, if the local public entity concerned does not provide otherwise by ordinance, with regard to the punishment of violations committed before the provision ceases to be effective, the provisions then in force continue to govern even after it ceases to be effective.

前項の規定により条例の規定がその効力を失う場合において、当該地方公共団体が条例で別段の定めをしないときは、その失効前にした違反行為の処罰については、その失効後も、なお従前の例による。

Supplementary Provisions, Article 4Delegation to Cabinet Order

第四条(政令への委任)

Beyond what is provided for in the preceding two Articles, transitional measures necessary in connection with the enforcement of this Act are specified by Cabinet Order.

前二条に規定するもののほか、この法律の施行に伴い必要な経過措置は、政令で定める。

Supplementary Provisions, Article 5Review

第五条(検討)

With regard to the appropriate form of the regulation, etc. of stalking, etc. and of other acts committed, for the purpose of satisfying a feeling of romantic affection or any other feeling of affection toward a specific person, or a feeling of resentment at that feeling not having been reciprocated, in a manner that would cause that specific person, etc. to feel anxiety, a general review, including any necessary amendment of laws, is to be conducted in light of the facts that the number of cases relating to those acts has remained at a high level in recent years, that those acts have become diversified, and other circumstances, and necessary measures are to be taken promptly.

ストーカー行為等その他の特定の者に対する恋愛感情その他の好意の感情又はそれが満たされなかったことに対する怨恨の感情を充足する目的で当該特定の者等に不安を覚えさせるような方法による行為の規制等の在り方については、近年、当該行為に係る事案の数が高い水準で推移していること、当該行為が多様化していること等を踏まえ、所要の法改正を含む全般的な検討が加えられ、速やかに必要な措置が講ぜられるものとする。

In light of its being in a position to ascertain the actual circumstances, etc. of the acts referred to in the preceding paragraph, the Government is to play an appropriate role in the review referred to in that paragraph by establishing a council for reviewing the appropriate form of the regulation, etc. referred to in that paragraph, hearing the opinions of private organizations, etc. engaged in activities, etc. concerning the prevention of those acts, and taking other measures.

政府は、前項の行為の実情等を把握することができる立場にあることを踏まえ、同項の規制等の在り方について検討するための協議会の設置、当該行為の防止に関する活動等を行っている民間の団体等の意見の聴取その他の措置を講ずることにより、同項の検討に当たって適切な役割を果たすものとする。
