If there has been an act in violation of the provisions of Article 3 and the Prefectural Public Safety Commission (hereinafter referred to as the "Public Safety Commission") finds that the person who committed the act is likely to commit the act again repeatedly, the Public Safety Commission may, at the request of the person targeted by the act or ex officio, issue to the person who committed the act, as provided by the National Public Safety Commission Rules, an order concerning the matters listed below:
都道府県公安委員会(以下「公安委員会」という。)は、第三条の規定に違反する行為があった場合において、当該行為をした者が更に反復して当該行為をするおそれがあると認めるときは、その相手方の申出により、又は職権で、当該行為をした者に対し、国家公安委員会規則で定めるところにより、次に掲げる事項を命ずることができる。
that the person not commit the act again repeatedly;
更に反復して当該行為をしてはならないこと。
any matter necessary to prevent the act from being committed again repeatedly.
更に反復して当該行為が行われることを防止するために必要な事項
When the Public Safety Commission intends to issue an order under the preceding paragraph (hereinafter referred to as a "prohibition order, etc."), the Public Safety Commission must hold a hearing, notwithstanding the categories of procedures for hearing statements of opinions under the provisions of Article 13, paragraph (1) of the Administrative Procedure Act (Act No. 88 of 1993).
公安委員会は、前項の規定による命令(以下「禁止命令等」という。)をしようとするときは、行政手続法(平成五年法律第八十八号)第十三条第一項の規定による意見陳述のための手続の区分にかかわらず、聴聞を行わなければならない。
In the case referred to in paragraph (1), if the Public Safety Commission finds that there is an urgent need to prevent the bodily safety, the peace of the residence, etc. or the reputation of the person targeted by the act in violation of the provisions of Article 3 from being harmed, or that person's freedom of action from being significantly harmed, the Public Safety Commission may, notwithstanding the provisions of the preceding paragraph and Article 13, paragraph (1) of the Administrative Procedure Act, issue a prohibition order, etc. without holding a hearing or granting an opportunity for explanation, at the request of the person targeted (or, if it finds that there is an urgent need to prevent the bodily safety of the person targeted from being harmed, at the request of the person targeted or ex officio). In such a case, the Public Safety Commission that issued the prohibition order, etc. must conduct a hearing of opinions within 15 days counting from the day on which it issued the prohibition order, etc. (or, if it has given notice of the hearing of opinions under the provisions of Article 15, paragraph (3) of that Act as applied mutatis mutandis pursuant to the following paragraph within 15 days counting from the day on which it issued the prohibition order, etc., within 14 days from the day on which that notice is deemed to have reached the person).
公安委員会は、第一項に規定する場合において、第三条の規定に違反する行為の相手方の身体の安全、住居等の平穏若しくは名誉が害され、又は行動の自由が著しく害されることを防止するために緊急の必要があると認めるときは、前項及び行政手続法第十三条第一項の規定にかかわらず、聴聞又は弁明の機会の付与を行わないで、当該相手方の申出により(当該相手方の身体の安全が害されることを防止するために緊急の必要があると認めるときは、その申出により、又は職権で)、禁止命令等をすることができる。この場合において、当該禁止命令等をした公安委員会は、意見の聴取を、当該禁止命令等をした日から起算して十五日以内(当該禁止命令等をした日から起算して十五日以内に次項において準用する同法第十五条第三項の規定により意見の聴取の通知を行った場合にあっては、当該通知が到達したものとみなされる日から十四日以内)に行わなければならない。
The provisions of Chapter III, Section 2 of the Administrative Procedure Act (excluding Article 28) apply mutatis mutandis to cases where the Public Safety Commission conducts a hearing of opinions under the provisions of the second sentence of the preceding paragraph. In this case, the phrase "within a reasonable period of time before the date of the hearing" in Article 15, paragraph (1) of that Act is deemed to be replaced with "promptly", the phrase "When making a decision on rendering an adverse disposition" in Article 26 of that Act is deemed to be replaced with "When having conducted a hearing of opinions under the provisions of the second sentence of Article 5, paragraph (3) of the Anti-Stalking Act (Act No. 81 of 2000)", and the phrase "make the decision after fully taking into account" is deemed to be replaced with "fully take into account"; and any other necessary technical replacement of terms is specified by Cabinet Order.
If a Public Safety Commission has issued a prohibition order, etc., no other Public Safety Commission may issue a prohibition order, etc. to the person who received that prohibition order, etc. with regard to the act in violation of the provisions of Article 3 to which that prohibition order, etc. relates.
When the Public Safety Commission has issued a prohibition order, etc., the Public Safety Commission must promptly notify the person targeted by the act in violation of the provisions of Article 3 to which that prohibition order, etc. relates of the content and the date and time of that prohibition order, etc.; provided, however, that this does not apply if the Public Safety Commission is unable to notify the person targeted because the whereabouts of the person targeted are unknown or for any other reason.
If the Public Safety Commission has received a request under paragraph (1) or (3) and has not issued a prohibition order, etc., the Public Safety Commission must promptly notify the person who made the request, in writing, of that fact and the reasons for it.
A prohibition order, etc. is effective for one year counting from the day on which the prohibition order, etc. was issued.
禁止命令等の効力は、禁止命令等をした日から起算して一年とする。
If the Public Safety Commission has issued a prohibition order, etc. and finds it necessary to continue that prohibition order, etc. after the period referred to in the preceding paragraph has elapsed, the Public Safety Commission may, at the request of the person targeted by the act in violation of the provisions of Article 3 to which that prohibition order, etc. relates or ex officio, extend the period of validity of that prohibition order, etc. by one year. The same applies when the Public Safety Commission intends to extend it further after the extended period has elapsed.
The provisions of paragraphs (2), (6) and (7) apply mutatis mutandis to a disposition extending the period of validity of a prohibition order, etc. under the preceding paragraph. In this case, the phrase "paragraph (1) or (3)" in paragraph (7) is deemed to be replaced with "paragraph (9)".
A prohibition order, etc. or a disposition extending the period of validity of a prohibition order, etc. under paragraph (9) is made by serving a document specified by the National Public Safety Commission Rules; provided, however, that it may be made orally if, because of urgency, there is no time to serve that document.
If the domicile and residence of the person to be served with a document to be served under the preceding paragraph are unknown, the Public Safety Commission issuing the prohibition order, etc. or making the disposition may effect service by publication in lieu of that service.
Service by publication is effected by making the name of the document to be served, the name of the person to be served, and a statement that the Public Safety Commission will deliver the document to the person to be served at any time (hereinafter referred to as the "particulars of the public notice" in this paragraph) available for viewing by an unspecified large number of persons by a method specified by the National Public Safety Commission Rules, and by taking measures to post a document stating the particulars of the public notice on the bulletin board of that Public Safety Commission, or to make the particulars of the public notice, as displayed on the screen of a computer installed at the office of that Public Safety Commission, available for viewing.
公示送達は、送達すべき書類の名称、その送達を受けるべき者の氏名及び公安委員会がその書類をいつでも送達を受けるべき者に交付する旨(以下この項において「公示事項」という。)を国家公安委員会規則で定める方法により不特定多数の者が閲覧することができる状態に置くとともに、公示事項が記載された書面を当該公安委員会の掲示板に掲示し、又は公示事項を当該公安委員会の庁舎に設置した電子計算機の映像面に表示したものの閲覧をすることができる状態に置く措置をとることにより行う。
In the case referred to in the preceding paragraph, when two weeks have elapsed counting from the day on which the measures under that paragraph were commenced, the document is deemed to have been served.
Beyond what is provided for in the preceding paragraphs, necessary matters concerning the implementation of prohibition orders, etc., the hearing of opinions under the provisions of the second sentence of paragraph (3), and the service under the provisions of paragraph (11) are specified by the National Public Safety Commission Rules.
