第四条
With regard to the dispositions on whether or not to grant a designation or renewal of designation, or an approval or renewal of approval, in response to an application for designation or renewal of designation or an application for approval or renewal of approval filed before the date of enforcement of this Act (hereinafter referred to as the "Effective Date") under Article 70, paragraph (1) (including the case where applied mutatis mutandis pursuant to Article 70-2, paragraph (4) (including the case where applied mutatis mutandis pursuant to Article 78-12, Article 115-11, Article 115-21 and Article 115-31)), Article 78-2, paragraph (1), Article 79, paragraph (1) (including the case where applied mutatis mutandis pursuant to Article 79-2, paragraph (4)), Article 86, paragraph (1) (including the case where applied mutatis mutandis pursuant to Article 86-2, paragraph (4)), Article 94, paragraph (1) (including the case where applied mutatis mutandis pursuant to Article 94-2, paragraph (4)), Article 115-2, paragraph (1), Article 115-12, paragraph (1) or Article 115-22, paragraph (1) of the Former Long-Term Care Insurance Act, for which no disposition on whether or not to grant the designation or renewal of designation, or the approval or renewal of approval, has been made at the time of enforcement of this Act, the provisions then in force continue to govern.
この法律の施行の日（以下「施行日」という。）前にされた旧介護保険法第七十条第一項（旧介護保険法第七十条の二第四項（旧介護保険法第七十八条の十二、第百十五条の十一、第百十五条の二十一及び第百十五条の三十一において準用する場合を含む。）において準用する場合を含む。）、第七十八条の二第一項、第七十九条第一項（旧介護保険法第七十九条の二第四項において準用する場合を含む。）、第八十六条第一項（旧介護保険法第八十六条の二第四項において準用する場合を含む。）、第九十四条第一項（旧介護保険法第九十四条の二第四項において準用する場合を含む。）、第百十五条の二第一項、第百十五条の十二第一項又は第百十五条の二十二第一項の指定若しくは指定の更新の申請又は許可若しくは許可の更新の申請であって、この法律の施行の際、指定若しくは指定の更新又は許可若しくは許可の更新をするかどうかの処分がなされていないものについてのこれらの処分については、なお従前の例による。
