第五条
The provisions of Article 70, paragraph (2) of the New Long-Term Care Insurance Act (including the case where applied mutatis mutandis pursuant to Article 70-2, paragraph (4) of that Act (including the case where applied mutatis mutandis pursuant to Article 78-12, Article 115-11, Article 115-21 and Article 115-31 of that Act)), Article 77, paragraph (1), Article 78-2, paragraph (4) (including the case where applied mutatis mutandis pursuant to Article 78-14, paragraph (3) of that Act), Article 78-10 (including the case where applied with the terms replaced pursuant to Article 78-17 of that Act), Article 79, paragraph (2) (including the case where applied mutatis mutandis pursuant to Article 79-2, paragraph (4) of that Act), Article 84, paragraph (1), Article 86, paragraph (2) (including the case where applied mutatis mutandis pursuant to Article 86-2, paragraph (4) of that Act), Article 92, paragraph (1), Article 94, paragraph (3) (including the case where applied mutatis mutandis pursuant to Article 94-2, paragraph (4) of that Act), Article 104, paragraph (1), Article 115-2, paragraph (2), Article 115-9, paragraph (1), Article 115-12, paragraph (2), Article 115-19, Article 115-22, paragraph (2) and Article 115-29 of that Act do not apply to a person who has been sentenced to a penalty, on the basis of an act committed before the Effective Date, under any provision of laws relating to labor prescribed in those provisions that is specified by Cabinet Order.
新介護保険法第七十条第二項（新介護保険法第七十条の二第四項（新介護保険法第七十八条の十二、第百十五条の十一、第百十五条の二十一及び第百十五条の三十一において準用する場合を含む。）において準用する場合を含む。）、第七十七条第一項、第七十八条の二第四項（新介護保険法第七十八条の十四第三項において準用する場合を含む。）、第七十八条の十（新介護保険法第七十八条の十七の規定により読み替えて適用される場合を含む。）、第七十九条第二項（新介護保険法第七十九条の二第四項において準用する場合を含む。）、第八十四条第一項、第八十六条第二項（新介護保険法第八十六条の二第四項において準用する場合を含む。）、第九十二条第一項、第九十四条第三項（新介護保険法第九十四条の二第四項において準用する場合を含む。）、第百四条第一項、第百十五条の二第二項、第百十五条の九第一項、第百十五条の十二第二項、第百十五条の十九、第百十五条の二十二第二項及び第百十五条の二十九の規定は、施行日前にした行為によりこれらの規定に規定する労働に関する法律の規定であって政令で定めるものにより刑に処せられた者については、適用しない。
