第十二条（準備書面に関する経過措置）
With regard to an allegation, at oral arguments for which the adverse party is not present in court, of facts stated in a brief submitted before the New Act comes into effect, the provisions then in force continue to govern, notwithstanding the provisions of Article 161, paragraph (3) of the New Act (including as applied mutatis mutandis under the New Act).
新法の施行前に提出された準備書面に記載した事実についての相手方が在廷していない口頭弁論における主張については、新法第百六十一条第三項（新法において準用する場合を含む。）の規定にかかわらず、なお従前の例による。
