第二条（売却の手続に関する経過措置）
The provisions of Articles 65-2 and 68-4 (including where they apply mutatis mutandis or where a case is governed by their rules) of the Civil Enforcement Act as amended by the provisions of Article 1 (hereinafter referred to as the "New Civil Enforcement Act") do not apply to the sale procedure under a disposition by a court clerk to have a sale implemented, in the case where the court clerk made that disposition before the Effective Date.
With regard to grounds for not permitting a sale in the case where a court clerk made a disposition to have a sale implemented before the Effective Date, the provisions then in force continue to govern, notwithstanding the provisions of Article 71 of the New Civil Enforcement Act (including where they apply mutatis mutandis or where a case is governed by their rules).
施行日前に裁判所書記官が売却を実施させる旨の処分をした場合における売却不許可事由については、新民事執行法第七十一条（これを準用し、又はその例による場合を含む。）の規定にかかわらず、なお従前の例による。
