Supplementary Provisions, Article 7Special Provisions on Filing of Motion or Statement with the Court Through Electronic Data Processing Systems in Cases Concerning a Petition for Granting of a Special Attestation of Enforceability
第七条（特例執行文付与申立事件に関する裁判所に対する電子情報処理組織による申立て等の特例）
When the persons stated in the following items file a petition or other statement with the court in cases concerning a petition for granting of a special attestation of enforceability in relation to the cases provided in the respective items (including motion or statement filed with that court's presiding judge, authorized judge, commissioned judge, or court clerk; the same applies in the following Article), that motion or statement must be filed by the means prescribed in paragraph (1) of the preceding Article; provided, however, that this does not apply when motion or statement in cases concerning a petition for granting of a special attestation of enforceability that may be filed orally are, in fact, filed orally.
次の各号に掲げる者は、それぞれ当該各号に定める事件について、裁判所に対する特例執行文付与申立事件に関する申立て等（当該裁判所の裁判長、受命裁判官、受託裁判官又は裁判所書記官に対するものを含む。次条において同じ。）をするときは、前条第一項の方法により、これを行わなければならない。ただし、口頭ですることができる特例執行文付与申立事件に関する申立て等について、口頭でするときは、この限りでない。
a representative who has been delegated a case (excluding a person who became a representative with approval pursuant to the proviso to Article 54, paragraph (1) of the Code of Civil Procedure):the delegated case;
代理人のうち委任を受けたもの（民事訴訟法第五十四条第一項ただし書の許可を得て代理人となつたものを除く。） 当該委任を受けた事件
a person designated under Article 2, Article 5, paragraph (1), Article 6, paragraph (2), Article 6-2, paragraph (4) or (5), Article 6-3, paragraph (4) or (5), or Article 7, paragraph (3) of the Act on the Authority of the Minister of Justice over Suits Relating to the Interests of the State (including cases where these provisions apply mutatis mutandis pursuant to Article 9 of that Act):the case subject to the designation; and
国の利害に関係のある訴訟についての法務大臣の権限等に関する法律第二条、第五条第一項、第六条第二項、第六条の二第四項若しくは第五項、第六条の三第四項若しくは第五項又は第七条第三項の規定（これらの規定を同法第九条において準用する場合を含む。）による指定を受けた者 当該指定の対象となつた事件
an official delegated under Article 153, paragraph (1) of the Local Autonomy Act:the delegated case.
地方自治法第百五十三条第一項の規定による委任を受けた職員 当該委任を受けた事件
The provisions of Article 132-11, paragraph (2) of the Code of Civil Procedure apply mutatis mutandis to the person stated in the items of the preceding paragraph, and the provisions of paragraph (3) of that Article apply mutatis mutandis to motion or statement in cases concerning a petition for granting of a special attestation of enforceability specified in the main clause of the preceding paragraph, respectively.
民事訴訟法第百三十二条の十一第二項の規定は前項各号に掲げる者について、同条第三項の規定は前項本文の特例執行文付与申立事件に関する申立て等について、それぞれ準用する。
