第一条（施行期日）

この法律は、昭和五十九年一月一日から施行する。

第二条（建物の区分所有等に関する法律の一部改正に伴う経過措置の原則）

第一条の規定による改正後の建物の区分所有等に関する法律（以下「新法」という。）の規定は、特別の定めがある場合を除いて、この法律の施行前に生じた事項にも適用する。ただし、同条の規定による改正前の建物の区分所有等に関する法律（以下「旧法」という。）の規定により生じた効力を妨げない。

第三条（建物の設置又は保存の瑕疵に関する推定に関する経過措置）

新法第九条の規定は、この法律の施行前に建物の設置又は保存の瑕疵により損害が生じた場合における当該瑕疵については、適用しない。

新法第二十二条から第二十四条までの規定は、この法律の施行の際現に存する専有部分及びその専有部分に係る敷地利用権（以下「既存専有部分等」という。）については、この法律の施行の日から起算して五年を超えない範囲内において政令で定める日から適用する。ただし、次条第一項の指定に係る建物の既存専有部分等については、同項に規定する適用開始日から適用する。

附則第六条第一項の指定に係る建物以外の建物の既存専有部分等は、附則第五条本文の政令で定める日に、新法第二十二条第一項ただし書の規定により規約で分離して処分することができることと定められたものとみなす。

この法律の施行の際現に効力を有する規約は、新法第三十一条又は新法第六十六条において準用する新法第三十一条第一項及び新法第六十八条の規定により定められたものとみなす。
