①A person who intends to engage in specified automated operation must obtain permission from the public safety commission with jurisdiction over the place where the person intends to engage in specified automated operation.

②A person seeking the permission under the preceding paragraph must submit to the public safety commission a written application stating the following matters:

③A document stating the recorded matters of the motor vehicle inspection certificate of the motor vehicle for specified automated operation (meaning the recorded matters of the motor vehicle inspection certificate prescribed in Article 58, paragraph (2) of the Road Transport Vehicle Act) and other documents prescribed by Cabinet Office Order must be attached to the written application under the preceding paragraph.

①When the public safety commission intends to grant the permission under paragraph (1) of the preceding Article, it must do so after examining whether the specified automated operation plan stated in the written application submitted under paragraph (2) of that Article conforms to the following standards:

②When the public safety commission intends to grant the permission under paragraph (1) of the preceding Article, it must, for each of the matters set forth in the following items, hear the opinion of the person specified in the relevant item concerning that matter.

The public safety commission must not grant the permission under Article 75-12, paragraph (1) if the person seeking it falls under any of the following items:

①When granting the permission under Article 75-12, paragraph (1), the public safety commission may, if it finds it necessary, attach to the permission the conditions necessary to prevent hazards on roads and otherwise ensure the safety and fluidity of traffic.

②When a special need arises to prevent hazards on roads and otherwise ensure the safety and fluidity of traffic, the public safety commission may change the conditions attached under the preceding paragraph or attach new conditions.

①A person who has obtained the permission under Article 75-12, paragraph (1) (hereinafter referred to as a "specified automated operation provider") must, when intending to change the specified automated operation plan, obtain permission from the public safety commission pursuant to Cabinet Office Order; provided, however, that this does not apply to minor changes prescribed by Cabinet Office Order.

②The provisions of Article 75-13 and the preceding Article apply mutatis mutandis to the permission under the preceding paragraph.

③When a specified automated operation provider intends to make a minor change prescribed by Cabinet Office Order as referred to in the proviso to paragraph (1), the provider must notify the public safety commission to that effect pursuant to Cabinet Office Order.

④When a specified automated operation provider has changed the matters set forth in Article 75-12, paragraph (2), item (i), the provider must notify the public safety commission within 30 days from the date of the change, pursuant to Cabinet Office Order.

When the public safety commission has granted the permission under Article 75-12, paragraph (1) or paragraph (1) of the preceding Article, it must give public notice to that effect pursuant to Cabinet Office Order.

Specified automated operation must be carried out in accordance with the specified automated operation plan for which permission was obtained under Article 75-12, paragraph (1) (or, where a change has been permitted or notified under Article 75-16, paragraph (1) or (3), the plan as changed; the same applies in Article 75-27, paragraph (1), item (ii)) and the conditions attached under Article 75-15, paragraph (1) (including as applied mutatis mutandis pursuant to Article 75-16, paragraph (2)) (including conditions changed or newly attached under Article 75-15, paragraph (2) (including as applied mutatis mutandis pursuant to Article 75-16, paragraph (2))).

①A specified automated operation provider must provide education, pursuant to Cabinet Office Order, to the specified automated operation supervisor designated under the following paragraph, the person in charge of on-site measures designated under paragraph (3), and other persons used for specified automated operation (hereinafter referred to as "specified automated operation workers"), so that they will smoothly and reliably implement the measures that specified automated operation workers must implement under the provisions of this Act, the provisions of orders under this Act, and dispositions under the provisions of this Act, including the measures under Article 75-21, Article 75-22, and Article 75-23, paragraphs (1) through (3).

②When engaging in specified automated operation, a specified automated operation provider must designate a specified automated operation supervisor from among persons who satisfy the requirements that Cabinet Office Order prescribes regarding the aptitude necessary for taking the measures, so as to have that supervisor take the measures that the specified automated operation supervisor must implement under the provisions of this Act, the provisions of orders under this Act, and dispositions under the provisions of this Act, including the measures under Article 75-21, Article 75-22, and Article 75-23, paragraphs (1) and (3).

③When a specified automated operation provider engages in specified automated operation having taken the measures prescribed in paragraph (1), item (i) of the following Article, the provider must designate a person in charge of on-site measures, so as to have that person take the measures under Article 75-23, paragraphs (1) and (2).

①A specified automated operation provider must take one of the measures set forth in the following items with respect to a motor vehicle for specified automated operation that is engaged in specified automated operation:

②A specified automated operation provider that is carrying out specified automated operation must, as prescribed by Cabinet Office Order, display in a conspicuous place on the motor vehicle for specified automated operation a notice that specified automated operation is in progress.

①A specified automated operation supervisor assigned pursuant to paragraph (1), item (i) of the preceding Article must monitor the operating status of the device prescribed in that item while the motor vehicle for specified automated operation is engaged in specified automated operation. In this case, if the specified automated operation supervisor finds that the device is not operating normally, the specified automated operation supervisor must immediately take measures to end that specified automated operation.

②When specified automated operation has ended on a road, a specified automated operation supervisor must immediately confirm whether there are grounds for taking measures that the specified automated operation supervisor is required to carry out under the provisions of this Act, orders based on this Act, and dispositions made under the provisions of this Act, including measures under the following Article or Article 75-23, paragraph (1) or (3).

①When specified automated operation has ended, if any of the measures or orders set forth in the following items has been taken or given in relation to the motor vehicle for specified automated operation or the specified automated operation supervisor, the specified automated operation supervisor must immediately take the measures necessary to have the motor vehicle for specified automated operation proceed in accordance with that measure or order:

②When specified automated operation has ended, if an emergency motor vehicle or fire-services vehicle is approaching the motor vehicle for specified automated operation or is in the vicinity of it, the specified automated operation supervisor must immediately take the measures necessary to prevent the motor vehicle for specified automated operation from keeping that emergency motor vehicle or fire-services vehicle from proceeding.

③When specified automated operation has ended, if the motor vehicle for specified automated operation is found to have been parked illegally, the specified automated operation supervisor must immediately take the measures necessary to change the manner of parking the motor vehicle for specified automated operation or to move it from that place.

①When, in specified automated operation (including the case where specified automated operation has ended on a road; the same applies in paragraphs (3) and (6) and Article 117, paragraph (3)), there is a traffic accident involving a motor vehicle for specified automated operation (limited to one for which the measure prescribed in Article 75-20, paragraph (1), item (i) has been taken), the specified automated operation supervisor assigned pursuant to that item must take the measures of immediately notifying the fire-services organization nearest to the scene of the traffic accident and of sending a person in charge of on-site measures to the scene of the traffic accident (or, where it is clear that no person has been killed or injured in the traffic accident, the measure of sending a person in charge of on-site measures to the scene of the traffic accident). In this case, the specified automated operation supervisor of the motor vehicle for specified automated operation must immediately report the particulars of the traffic accident to a police officer at the police station nearest to the scene of the traffic accident (including a police box or residential police box; the same applies in paragraphs (3) and (4)).

②A person in charge of on-site measures who has arrived at the scene of the traffic accident prescribed in the preceding paragraph must take the measures necessary to prevent road hazards at the scene of that traffic accident.

③When, in specified automated operation, there is a traffic accident involving a motor vehicle for specified automated operation (limited to one for which the measure prescribed in Article 75-20, paragraph (1), item (ii) has been taken), the specified automated operation supervisor or other staff member who was made to ride in the motor vehicle for specified automated operation involved in the traffic accident pursuant to that item (referred to in paragraph (5) as the "specified automated operation supervisor or other staff member") must immediately aid injured persons, prevent road hazards, and otherwise take the necessary measures. In this case, the specified automated operation supervisor of the motor vehicle for specified automated operation (or, where it is unavoidable because the specified automated operation supervisor has died or been injured, another staff member; the same applies in the following paragraph) must report the particulars of the traffic accident to a police officer if one is at the scene, or, if no police officer is at the scene, immediately to a police officer at the nearest police station.

④On finding it to be necessary to do so in order to aid an injured person or prevent a road hazard, a police officer at the nearest police station who receives a report pursuant to the second sentence of the preceding paragraph may order the specified automated operation supervisor giving the report not to leave the scene until a police officer arrives.

⑤In a case as referred to in the preceding three paragraphs, a police officer at the scene of the traffic accident may give a person in charge of on-site measures or a specified automated operation supervisor or other staff member at the scene of the traffic accident the instructions necessary to aid injured persons, prevent road hazards, or otherwise ensure the safety and fluidity of traffic.

⑥The provisions of Article 72-2 and Article 73 apply mutatis mutandis to the case where there is a traffic accident in specified automated operation. In this case, in Article 72-2, paragraph (1), the phrase "paragraph (3) of the preceding Article" is deemed to be replaced with "Article 75-23, paragraph (5)", the phrase "the driver or staff member of" with "the person in charge of on-site measures (meaning a person in charge of on-site measures prescribed in Article 75-19, paragraph (3); the same applies hereinafter) or the specified automated operation supervisor or other staff member (meaning a specified automated operation supervisor or other staff member prescribed in Article 75-23, paragraph (3); the same applies hereinafter) for", the phrase "that paragraph" with "paragraph (5) of that Article", and the phrase "the scene" with "the scene of the traffic accident"; and in Article 73, the phrase "other than the driver or staff member" is deemed to be replaced with "other than the specified automated operation supervisor or other staff member", the phrase "the driver's or staff member's taking the measures prescribed in the first sentence of Article 72, paragraph (1)" with "the taking, by the person in charge of on-site measures for the vehicle or streetcar, of the measures prescribed in Article 75-23, paragraph (2), or the taking, by the specified automated operation supervisor or other staff member, of the measures prescribed in the first sentence of paragraph (3) of that Article", and "又は" (or) with "若しくは" (or, joining a smaller group of alternatives).

①A public safety commission may, so far as is necessary to enforce the provisions of this Chapter, ask a specified automated operation provider to report or submit materials on its specified automated operation, or have a police official enter the place prescribed in Article 75-12, paragraph (2), item (ii), (c) or another office of the specified automated operation provider to inspect books, documents and other items or to question relevant persons.

②When a police official enters premises pursuant to the preceding paragraph, the official must carry identification showing the official's status and present it to relevant persons.

③The authority for an on-site inspection under paragraph (1) must not be construed as authorizing a criminal investigation.

④If a public safety commission finds it necessary to do so to enforce the provisions of this Chapter, it may make inquiries with, or ask for cooperation from, government agencies, public bodies, and other persons.

①If a specified automated operation provider or its specified automated operation worker violates, in connection with specified automated operation, a provision of this Act, a provision of an order under this Act, a disposition based on a provision of this Act, or a provision of other laws and regulations, and a public safety commission finds it necessary to do so in order to prevent hazards on roads or otherwise ensure the safety and fluidity of traffic, it may instruct the specified automated operation provider to take the necessary measures in connection with specified automated operation (including not conducting specified automated operation until the measures are taken).

②If a public safety commission intends to give an instruction under the preceding paragraph and the specified automated operation by the specified automated operation provider subject to the instruction is conducted as motor carrier services as prescribed in Article 2, paragraph (2) of the Road Transportation Act (excluding light motor vehicle cargo transportation services as prescribed in Article 2, paragraph (4) of the Motor Truck Transportation Business Act) or as Type II cargo transportation services as prescribed in Article 2, paragraph (8) of the Consigned Freight Forwarding Business Act, it must hear the opinion of the supervising administrative agency for those services.

①A public safety commission may, if any of the following items applies, revoke the permission for specified automated operation of the specified automated operation provider concerned, or suspend its validity for a period that the commission specifies, not exceeding six months.

②The provisions of paragraph (2) of the preceding Article apply mutatis mutandis to the revocation of permission, or the suspension of its validity, under the preceding paragraph.

③If a public safety commission has revoked the permission for specified automated operation pursuant to paragraph (1), it must give public notice to that effect, as provided by Cabinet Office Order.

①If any of the following items applies and there is an urgent need to prevent hazards on roads, the chief of the police station having jurisdiction over the place where the fact occurred may, with regard to the specified automated operation provider concerned, suspend the validity of the permission for specified automated operation until the day on which 30 days have elapsed, counting from the date on which the fact occurred (hereinafter referred to in this Article as a "provisional suspension").

②Having made a provisional suspension, the chief of the police station must provide the specified automated operation provider subject to that disposition with an opportunity for explanation within five days, counting from the date on which the disposition was made.

③The chief of the police station who has made a provisional suspension must promptly report the matters that Cabinet Office Order prescribes to the public safety commission.

④A provisional suspension loses its effect if the public safety commission that has received a report under the preceding paragraph makes a disposition on the case under Article 75-26, paragraph (1) or paragraph (1) of the preceding Article within the period of that provisional suspension.

⑤If a person subject to a provisional suspension has been subject to a suspension of the validity of the permission under paragraph (1) of the preceding Article on the case, the period during which the provisional suspension was in effect is to be counted toward the period of suspension of the validity of that permission.

If a public safety commission has made a disposition under Article 75-26, paragraph (1) or Article 75-27, paragraph (1), or has received a report under paragraph (3) of the preceding Article, it must report the matters that Cabinet Office Order prescribes to the National Public Safety Commission. In such a case, the National Public Safety Commission is to notify each public safety commission of the matters pertaining to the report.
