Article 21Return of Retirement Allowances, etc.

①Where there is a person who has received payment of a retirement allowance, etc. by deceit or other wrongful conduct, the Organization may have that person return that retirement allowance, etc. In this case, where the payment was due to a false certification or notification by the mutual aid policyholder, the Organization may have the mutual aid policyholder return the retirement allowance, etc. jointly and severally with the person who received payment.

②Where the Organization is to pay a retirement allowance, etc. to a covered employee or the covered employee's bereaved family members and there is an amount to be returned to the Organization under the preceding paragraph, the Organization may set off that retirement allowance, etc. against the amount that that person is to return.
