第五章 罰則
第二十四条
A person who engages in recruitment of workers in violation of an order for suspension of business pursuant to the provisions of Article 41, paragraph (2) of the Employment Security Act, as applied mutatis mutandis pursuant to Article 16, paragraph (5) is subject to imprisonment for not more than one year or a fine of not more than one million yen.
第十六条第五項において準用する職業安定法第四十一条第二項の規定による業務の停止の命令に違反して、労働者の募集に従事した者は、一年以下の拘禁刑又は百万円以下の罰金に処する。
第二十五条
A person who falls under any of the following items is subject to imprisonment for not more than 6 months or a fine of not more than three hundred thousand yen:
次の各号のいずれかに該当する者は、六月以下の拘禁刑又は三十万円以下の罰金に処する。
a person who engages in recruitment of workers without submitting a notification under the provisions of Article 16, paragraph (4);
第十六条第四項の規定による届出をしないで、労働者の募集に従事した者
a person who fails to comply with the instructions under the provisions of Article 37, paragraph (2) of the Employment Security Act, as applied mutatis mutandis pursuant to Article 16, paragraph (5); or
第十六条第五項において準用する職業安定法第三十七条第二項の規定による指示に従わなかった者
a person who violates the provisions of Article 39 or Article 40 of the Employment Security Act, as applied mutatis mutandis pursuant to Article 16, paragraph (5).
第十六条第五項において準用する職業安定法第三十九条又は第四十条の規定に違反した者
第二十六条
A person who falls under any of the following items is subject to a fine of not more than three hundred thousand yen:
次の各号のいずれかに該当する者は、三十万円以下の罰金に処する。
a person who violates the provisions of Article 14, paragraph (2) (including as applied mutatis mutandis pursuant to Article 15-4, paragraph (2));
a person who fails to make a report under the provisions of Article 50, paragraph (1) of the Employment Security Act, as applied mutatis mutandis pursuant to Article 16, paragraph (5), or makes a false report;
第十六条第五項において準用する職業安定法第五十条第一項の規定による報告をせず、又は虚偽の報告をした者
a person who refuses, obstructs, or evades an entry or inspection under the provisions of Article 50, paragraph (2) of the Employment Security Act, as applied mutatis mutandis pursuant to Article 16, paragraph (5), or fails to answer a question under those provisions or makes a false statement;
第十六条第五項において準用する職業安定法第五十条第二項の規定による立入り若しくは検査を拒み、妨げ、若しくは忌避し、又は質問に対して答弁をせず、若しくは虚偽の陳述をした者
a person who divulges any secrets in violation of the provisions of Article 51, paragraph (1) of the Employment Security Act as applied mutatis mutandis pursuant to Article 16, paragraph (5); or
第十六条第五項において準用する職業安定法第五十一条第一項の規定に違反して秘密を漏らした者
a person who divulges any secrets in violation of the provisions of Article 20, paragraph (5).
第二十条第五項の規定に違反して秘密を漏らした者
第二十七条
When a representative of a corporation or an agent, employee, or any other worker of a corporation or an individual commits an act in violation of Article 24, Article 25, or items (i) through (iv) of the preceding Article in connection with the business of that corporation or individual, in addition to the offender being subject to punishment, that corporation or individual is subject to the fine referred to in the relevant Article.
法人の代表者又は法人若しくは人の代理人、使用人その他の従業者が、その法人又は人の業務に関し、第二十四条、第二十五条又は前条第一号から第四号までの違反行為をしたときは、行為者を罰するほか、その法人又は人に対しても、各本条の罰金刑を科する。
