Article 9Determination of the Successful Bidder in the Case of Identical Successful Bid Prices
第九条（落札価格が同じ場合の落札者の決定）
If there are two or more persons who made bids at the same price that should be successful, the successful bidder is to be determined by having them bid further. In this case, if those bids are at the same price, the successful bidder must be determined by lot.
落札となるべき同価の入札をした者が二人以上あるときは、更に入札をさせて落札者を定めるものとする。この場合において、その入札が同価のときは、くじで落札者を定めなければならない。
In the case of the latter sentence of the preceding paragraph, if, among the bidders, there is a person who does not attend the opening of bids or a person who does not draw lots, an official not involved in the bidding affairs may be made to draw lots in place of those persons.
前項後段の場合において、入札者のうち開札に出席しない者又はくじを引かない者があるときは、これらの者に代わり入札事務に関係のない職員にくじを引かせることができる。
