①In the case where, at the time this Act comes into effect, a posting under the provisions of Article 14, paragraph (1) of the Hot Spring Act prior to its amendment by this Act (hereinafter referred to as "the former Act") has been made, pursuant to the application of the provisions of Article 5 of the Supplementary Provisions of the Act Partially Amending the Hot Spring Act (Act No. 72 of 2001), not based on the results of the composition analysis of hot spring referred to in Article 14, paragraph (2) of the former Act conducted by a registered analytical facility referred to in that paragraph, and that posting has been made based on the results of an analysis and inspection of the compositions of a hot spring specified by the Order of the Ministry of the Environment as having reliability equal to or greater than that of the composition analysis of hot spring referred to in that paragraph conducted by a registered analytical facility referred to in that paragraph, the provisions of Article 18, paragraphs (2) and (3) of the Hot Spring Act as amended by this Act (hereinafter referred to as "the new Act") apply by deeming that analysis and inspection to be the composition analysis of hot spring referred to in that paragraph conducted by a registered analytical facility referred to in that paragraph.

②The provisions of Article 18, paragraph (3) of the new Act do not apply to a person that, at the time this Act comes into effect, provides a hot spring for public bathing or drinking and that would be required under the provisions of that paragraph to undergo the composition analysis of hot spring referred to in paragraph (2) of that Article by December 31, 2009, until that date.
