Article 73-3Treatment of the Acquisition and Loss of Status as an Insured Person of an Insured Person under Article 8-3-2, Paragraph (2) of the Supplementary Provisions of the Act

第七十三条の三（法附則第八条の三の二第二項被保険者の被保険者資格の取得及び喪失についての取扱い）

In the case where an insured person under Article 8-3-2, paragraph (2) of the Supplementary Provisions of the Act (meaning an insured person under paragraph (2) of that Article prescribed in paragraph (5) of that Article; the same applies in the following paragraph) has continued to be employed at the same place of business from before the day on which the person came to fall under paragraph (6), item (ii) of that Article, and on that day does not fall under any of the items of Article 3, paragraph (1) of the Act, the main clause of Article 39, paragraph (1), Article 41, paragraph (3) and Article 42, paragraph (1) of the Act, and other provisions specified by Order of the Ministry of Health, Labour and Welfare (including cases where they are cited, applied mutatis mutandis, or applied by following them in other laws and regulations) do not apply.

法附則第八条の三の二第二項被保険者（法附則第八条の三の二第五項に規定する同条第二項の規定による被保険者をいう。次項において同じ。）が同条第六項第二号に該当するに至った日前から引き続き同一の事業所に使用され、かつ、同日において法第三条第一項各号のいずれにも該当しない場合においては、法第三十九条第一項本文、第四十一条第三項及び第四十二条第一項の規定その他厚生労働省令で定める規定（他の法令において、引用し、準用し、又はその例による場合を含む。）は、適用しない。

In the application of Article 48, Article 104, Article 105, paragraph (1), Article 106, Article 156, paragraph (3) and the main clause of Article 158 of the Act, and other provisions specified by Order of the Ministry of Health, Labour and Welfare (including cases where they are cited, applied mutatis mutandis, or applied by following them in other laws and regulations), to a case where an insured person under Article 8-3-2, paragraph (2) of the Supplementary Provisions of the Act has continued to be employed at the same place of business from before the day on which the person came to fall under Article 8-3-2, paragraph (6), item (ii) of the Supplementary Provisions of the Act, and on that day does not fall under any of the items of Article 3, paragraph (1) of the Act, the person is deemed not to have acquired or lost status as an insured person on the day on which the person came to fall under Article 8-3-2, paragraph (6), item (ii) of the Supplementary Provisions of the Act.

法附則第八条の三の二第二項被保険者が法附則第八条の三の二第六項第二号に該当するに至った日前から引き続き同一の事業所に使用され、かつ、同日において法第三条第一項各号のいずれにも該当しない場合における法第四十八条、第百四条、第百五条第一項、第百六条、第百五十六条第三項及び第百五十八条本文の規定その他厚生労働省令で定める規定（他の法令において、引用し、準用し、又はその例による場合を含む。）の適用については、法附則第八条の三の二第六項第二号に該当するに至った日に被保険者の資格を取得し、又は喪失しなかったものとみなす。
