Order for Enforcement of the Health Insurance Act

The base amount for the combined long-term care calculation under paragraph (1) of the preceding Article (excluding where applied mutatis mutandis pursuant to paragraphs (3) and (4) of that Article) is, in accordance with the category of persons listed in the following items, the amount specified in each of those items.

a person other than those listed in the following item through item (v): 670,000 yen;

an insured person whose standard monthly remuneration for the month that includes the reference date is 830,000 yen or more: 2,120,000 yen;

an insured person whose standard monthly remuneration for the month that includes the reference date is 530,000 yen or more and less than 830,000 yen: 1,410,000 yen;

an insured person whose standard monthly remuneration for the month that includes the reference date is less than 280,000 yen (excluding a person listed in the following item): 600,000 yen;

an insured person who is a person exempt from municipal inhabitant tax (meaning a person on whom municipal inhabitant tax under the provisions of the Local Tax Act is not imposed for the previous fiscal year of the fiscal year that includes the reference date (or, where any day from August 1 of the previous year to March 31 is deemed to be the reference date pursuant to paragraph (1) of the following Article, the fiscal year that includes the day deemed to be the reference date) (including a person exempted from that municipal inhabitant tax as provided by a municipal ordinance, and excluding a person who has no domicile in the area in which that Act is in force on the assessment date of that municipal inhabitant tax); the same applies in item (v) of the following paragraph) (excluding persons listed in items (ii) and (iii)): 340,000 yen.

The base amount for the combined long-term care calculation for persons aged 70 or over under paragraph (2) of the preceding Article (excluding where applied mutatis mutandis pursuant to paragraphs (3) and (4) of that Article) is, in accordance with the category of persons listed in the following items, the amount specified in each of those items.

a person other than those listed in the following item through item (vi): 560,000 yen;

a person to whom item (iii) applies whose standard monthly remuneration for the month that includes the reference date is 830,000 yen or more: 2,120,000 yen;

a person to whom item (iii) applies whose standard monthly remuneration for the month that includes the reference date is 530,000 yen or more and less than 830,000 yen: 1,410,000 yen;

a person to whom item (iii) applies whose standard monthly remuneration for the month that includes the reference date is less than 530,000 yen: 670,000 yen;

an insured person who is a person exempt from municipal inhabitant tax (excluding a person listed in the preceding three items or the following item): 310,000 yen;

an insured person for whom neither the insured person nor any person who is a dependent of the insured person on the day specified by Order of the Ministry of Health, Labour and Welfare in the month that includes the reference date has any Income in Each Class prescribed in Article 2, paragraph (1), item (xxii) of the Income Tax Act relating to the total amount of income and forestry income prescribed in Article 313, paragraph (1) of the Local Tax Act, nor any amount of income calculated separately from other income, with respect to municipal inhabitant tax under the provisions of the Local Tax Act for the previous fiscal year of the fiscal year that includes the reference date (or, where any day from August 1 of the previous year to March 31 is deemed to be the reference date pursuant to paragraph (1) of the following Article, the fiscal year that includes the day deemed to be the reference date) (excluding persons listed in items (ii) through (iv)): 190,000 yen.

The provisions of paragraph (1) apply mutatis mutandis to the base amount for the combined long-term care calculation under paragraph (1) of the preceding Article as applied mutatis mutandis pursuant to paragraph (3) of that Article, and the provisions of the preceding paragraph apply mutatis mutandis to the base amount for the combined long-term care calculation for persons aged 70 or over under paragraph (2) of that Article as applied mutatis mutandis pursuant to paragraph (3) of that Article, respectively. In this case, the phrase "paragraph (1) of the preceding Article (excluding where applied mutatis mutandis pursuant to paragraphs (3) and (4) of that Article)" in paragraph (1) is deemed to be replaced with "paragraph (1) of the preceding Article as applied mutatis mutandis pursuant to paragraph (3) of that Article", the phrase "persons listed in the following items" with "insured persons listed in the following items who, on the reference date, support the person prescribed in paragraph (3) of that Article", the phrase "paragraph (2) of the preceding Article (excluding where applied mutatis mutandis pursuant to paragraphs (3) and (4) of that Article)" in the preceding paragraph with "paragraph (2) of the preceding Article as applied mutatis mutandis pursuant to paragraph (3) of that Article", and the phrase "persons listed in the following items" with "insured persons listed in the following items who, on the reference date, support the person prescribed in paragraph (3) of that Article".

The provisions of paragraph (1) apply mutatis mutandis to the base amount for the combined long-term care calculation under paragraph (1) of the preceding Article as applied mutatis mutandis pursuant to paragraph (4) of that Article, and the provisions of paragraph (2) apply mutatis mutandis to the base amount for the combined long-term care calculation for persons aged 70 or over under paragraph (2) of that Article as applied mutatis mutandis pursuant to paragraph (4) of that Article, respectively. In this case, the phrase "paragraph (1) of the preceding Article (excluding where applied mutatis mutandis pursuant to paragraphs (3) and (4) of that Article)" in paragraph (1) is deemed to be replaced with "paragraph (1) of the preceding Article as applied mutatis mutandis pursuant to paragraph (4) of that Article", the phrase "in accordance with the category of persons listed in the following items" with "for the person prescribed in paragraph (4) of that Article, where the person is, on the reference date, an insured person of the insurer of another health insurance, in accordance with the category of that person listed in the following items, and where the person is, on the reference date, a dependent of an insured person of the insurer of another health insurance, in accordance with the category of that insured person listed in the following items", the phrase "each of those items" with "each of those items, respectively", the phrase "paragraph (2) of the preceding Article (excluding where applied mutatis mutandis pursuant to paragraphs (3) and (4) of that Article)" in paragraph (2) with "paragraph (2) of the preceding Article as applied mutatis mutandis pursuant to paragraph (4) of that Article", the phrase "in accordance with the category of persons listed in the following items" with "for the person prescribed in paragraph (4) of that Article, where the person is, on the reference date, an insured person of the insurer of another health insurance, in accordance with the category of that person listed in the following items, and where the person is, on the reference date, a dependent of an insured person of the insurer of another health insurance, in accordance with the category of that insured person listed in the following items", and the phrase "each of those items" with "each of those items, respectively".

For the base amount for the combined long-term care calculation under paragraph (7) of the preceding Article, the provisions of Article 16-3, paragraph (1) and Article 16-4, paragraph (1) of the Order for Enforcement of the Act on Assurance of Medical Care for Elderly People (Cabinet Order No. 318 of 2007) apply mutatis mutandis. In this case, the necessary technical replacement of terms is specified by Order of the Ministry of Health, Labour and Welfare.
