Act on Proper Technical Intern Training and Protection of Technical Intern Trainees
外国人の技能実習の適正な実施及び技能実習生の保護に関する法律

In this Act, the Minister of Justice (法務大臣) and the Minister of Health, Labour and Welfare (厚生労働大臣).

Technical intern training of either type: individual-enterprise-type (企業単独型技能実習), in which a Japanese organization takes in staff from its own offices abroad or those of a closely related foreign organization, or supervising-organization-type (団体監理型技能実習), in which a non-profit supervising organization (監理団体) takes the trainees in and supervises the employers they work for.

In this Act, an order (命令) issued by the competent ministers (主務大臣), who are the Minister of Justice (法務大臣) and the Minister of Health, Labour and Welfare (厚生労働大臣).

機構
The Organization for Technical Intern Training (外国人技能実習機構, OTIT), whose purpose under Article 57 is to ensure that technical intern training is carried out properly and trainees are protected, and to which the Commissioner of the Immigration Services Agency (出入国在留管理庁長官) and the Minister of Health, Labour and Welfare (厚生労働大臣) may entrust the work of accrediting technical intern training plans (Article 12).
A Japanese non-profit corporation licensed under Article 23, paragraph (1) to carry on the business of supervision (実習監理): arranging employment for supervising-organization-type technical intern trainees and supervising the organizations that train them.
監理許可（第二十三条第一項の許可（第三十二条第一項の規定による変更の許可があったとき、又は第三十七条第二項の規定による第二十三条第一項第二号に規定する特定監理事業に係る許可への変更があったときは、これらの変更後のもの）をいう。以下同じ。）を受けて実習監理を行う事業（以下「監理事業」という。）を行う本邦の営利を目的としない法人
An individual-enterprise-type technical intern trainee (企業単独型技能実習生) or a supervising-organization-type technical intern trainee (団体監理型技能実習生): a foreign national doing technical intern training of either type.

The business of carrying out supervision (実習監理) that a supervising organization (監理団体) carries on under its license (監理許可).
機構
The Organization for Technical Intern Training (外国人技能実習機構, OTIT), whose purpose under Article 57 is to ensure that technical intern training is carried out properly and trainees are protected, and to which the Commissioner of the Immigration Services Agency (出入国在留管理庁長官) and the Minister of Health, Labour and Welfare (厚生労働大臣) may entrust the work of accrediting technical intern training plans (Article 12).
実習監理
Arranging employment between organizations that carry out, or intend to carry out, supervising-organization-type technical intern training (団体監理型技能実習) and people who are, or want to become, its trainees, and supervising how those organizations carry out the training.

技能等
Skills, techniques or knowledge (技能、技術又は知識), whose transfer to developing regions through human resource development is the international cooperation this Act aims to promote.
Technical intern training that starts with a foreign national being taken in by a Japanese non-profit corporation, attending the necessary lectures and working, under an employment contract, at the offices in Japan of a public or private organization that the corporation supervises; it runs in three stages — (i) acquiring skills, (ii) increasing proficiency and (iii) attaining proficiency — each under the matching Technical Intern Training (技能実習) status of residence (在留資格).

An organization implementing individual-enterprise-type technical intern training (企業単独型実習実施者) or supervising-organization-type technical intern training (団体監理型実習実施者): the employer that has technical intern trainees train under an accredited technical intern training plan (技能実習計画).

An individual or corporation that carries out supervising-organization-type technical intern training (団体監理型技能実習) — training of foreign nationals taken in through a non-profit supervising organization (監理団体) — under a technical intern training plan (技能実習計画) accredited under Article 8, paragraph (1).
実習認定を受けた第八条第一項に規定する技能実習計画に基づき、団体監理型技能実習を行わせる者
Short name, in the supplementary provisions (附則) of Act No. 60 of 2024, for the Act on Proper Technical Intern Training and Protection of Technical Intern Trainees (Act No. 89 of 2016) as Article 2 of Act No. 60 of 2024 amends it, under its new title covering employment for skill development (育成就労) and skill development employees (育成就労外国人).

A plan for carrying out technical intern training that the Japanese individual or corporation intending to run it draws up for each trainee and submits to the Commissioner of the Immigration Services Agency (出入国在留管理庁長官) and the Minister of Health, Labour and Welfare (厚生労働大臣) for accreditation.
In Article 5 of the supplementary provisions (附則) of Act No. 60 of 2024, the Organization for Technical Intern Training (OTIT) of Article 57 of this Act as it stood before Article 2 of that Act amended it — the body set up to ensure that technical intern training is carried out properly and trainees are protected — which is treated as the Employment-for-Skill-Development Organization (外国人育成就労機構) when accreditation and license procedures are carried out, before that Act comes into effect, as Articles 12 and 24 of this Act as amended provide.
Stage (i) of supervising-organization-type technical intern training: a foreign national, under the matching Technical Intern Training (技能実習) status of residence (在留資格), is taken in by a Japanese non-profit corporation to attend the necessary lectures, and works under an employment contract at the offices in Japan of a Japanese public or private organization that the corporation supervises (実習監理), in order to acquire skills, techniques or knowledge (技能等).

Stage (ii) of supervising-organization-type technical intern training: a person who has completed stage (i) works, under the matching Technical Intern Training (技能実習) status of residence (在留資格) and an employment contract, at the offices in Japan of a Japanese public or private organization supervised (実習監理) by a Japanese non-profit corporation, in work that requires the skills, techniques or knowledge (技能等), in order to increase proficiency in them.

Stage (ii) of individual-enterprise-type technical intern training: a person who has completed stage (i) works, under the matching Technical Intern Training (技能実習) status of residence (在留資格) and an employment contract with a Japanese public or private organization, at its offices in Japan in work that requires the skills, techniques or knowledge (技能等), in order to increase proficiency in them.

The administrative work of accrediting technical intern training plans under Article 8, paragraph (1), including accrediting changes under Article 11, paragraph (1), all or part of which the Commissioner of the Immigration Services Agency (出入国在留管理庁長官) and the Minister of Health, Labour and Welfare (厚生労働大臣) may have the Organization for Technical Intern Training (外国人技能実習機構) carry out.

In Article 23, paragraph (7), Article 24 and Article 25, a person seeking the license under Article 23, paragraph (1) to carry on supervising business (監理事業).

基本方針
In Article 7, the basic policy on the proper implementation of technical intern training and the protection of technical intern trainees that the competent ministers (主務大臣) must set.
Supervising business (監理事業) of any kind other than specified supervising business (特定監理事業, supervision only of organizations that carry out nothing beyond stage (i) or stage (ii) of supervising-organization-type technical intern training); only a supervising organization licensed for this category can supervise stage (iii) training (Article 9, item (viii)).

In Article 5 of the supplementary provisions (附則) of Act No. 60 of 2024, the Employment-for-Skill-Development Organization (ESDO) of Article 57 of this Act as Article 2 of that Act amends it — the body set up to ensure that employment for skill development (育成就労) is carried out properly and skill development employees (育成就労外国人) are protected — as which the Organization for Technical Intern Training (外国人技能実習機構) is treated when accreditation and license procedures are carried out, before that Act comes into effect, as Articles 12 and 24 of this Act as amended provide.
In Articles 8, 9 and 52, an examination designated by an order of the competent ministry (主務省令) which, like a trade skills test (技能検定), a trainee can be set the goal of passing by the end of technical intern training.

A technical intern training plan (技能実習計画) that has received accreditation (実習認定).
Supervising business (監理事業) for organizations that carry out only stage (i) or stage (ii) of supervising-organization-type technical intern training (団体監理型技能実習).

In Article 54, a council that a minister with jurisdiction over the business (事業所管大臣) may set up, made up of that minister, bodies whose members are implementing organizations (実習実施者) or supervising organizations (監理団体) in an industry under that minister, and other parties concerned.
地域協議会
In Article 56, a council that a national government body handling technical intern training matters in a region may set up, made up of that body, local government bodies and other bodies concerned.
In Articles 3 and 4 of the supplementary provisions (附則) of this Act, a person staying in Japan, or who stayed before this Act came into effect, with the Technical Intern Training (技能実習) status of residence (在留資格) of the Immigration Control and Refugee Recognition Act as it stood before these supplementary provisions amended it — a status for acquiring, or becoming proficient in, skills, techniques or knowledge by working under an employment contract with a Japanese organization — or another person the competent ministers (主務大臣) find equivalent.
Technical intern training that starts with a Japanese public or private organization taking in foreign employees of its own offices abroad, or of a foreign organization closely related to it, to attend the necessary lectures and work at its offices in Japan under an employment contract; it runs in three stages — (i) acquiring skills, (ii) increasing proficiency and (iii) attaining proficiency — each under the matching Technical Intern Training (技能実習) status of residence (在留資格).

In Article 13, paragraph (1), Article 14, paragraph (1) and Article 35, paragraph (1), a current or former supervising organization (監理団体).
Personal information (個人情報): information about an individual that can identify a particular person, including information that can do so when matched against other information.

In Article 31, the period for which a license to carry on supervising business (監理事業) under Article 23, paragraph (1) is valid: a period that a Cabinet Order (政令) sets, of not less than three years from the date of the license (or, after a renewal, from the day after the previous period ends), taking into account the organization's ability and record in supervising business.
In Article 104, paragraph (2) and Article 105, the collection of reports, orders to submit or present books and documents, orders to appear, questioning and on-site inspections under Article 35, paragraph (1), limited to those carried out to enforce Article 40, paragraphs (3) to (5) — powers part of which the competent ministers (主務大臣) may delegate to the Minister of Land, Infrastructure, Transport and Tourism (国土交通大臣).
This Act as it stood before Article 2 of Act No. 60 of 2024 amended it.

In Article 47, a person who carries out supervision (実習監理), or an officer or employee of such a person.
In Article 93, the balance sheet, profit and loss statement and other documents an order of the competent ministry (主務省令) specifies, with their supporting schedules, that the Organization for Technical Intern Training (外国人技能実習機構) must prepare for each business year and submit for the competent ministers' (主務大臣) approval within three months after the year ends.
In Article 93, the financial statements (財務諸表) of the Organization for Technical Intern Training (外国人技能実習機構), together with its business report, report on the settlement of accounts and the auditors' (監事) written opinions, which it must keep at each office for public inspection for the period an order of the competent ministry (主務省令) sets.
The date this Act (Act No. 89 of 2016) itself comes into effect.
In Article 8, paragraph (2) and Article 9, the category a technical intern training plan falls in: stage (i), (ii) or (iii) of individual-enterprise-type technical intern training (企業単独型技能実習), or stage (i), (ii) or (iii) of supervising-organization-type technical intern training (団体監理型技能実習).

In Article 48, paragraph (1), a person who carries out supervision (実習監理): arranging employment for supervising-organization-type technical intern trainees and supervising the organizations that train them.
In Article 47, a technical intern trainee (技能実習生) or a person who wants to become one.

The residence card that the Immigration Services Agency issues to a mid- to long-term resident under Article 19-3 of the Immigration Control and Refugee Recognition Act.
入管法第十九条の三に規定する在留カード
In Article 48, paragraph (1) and Article 111, item (v), a technical intern trainee's passport as defined in Article 2, item (v) of the Immigration Control and Refugee Recognition Act: a passport, refugee travel document or other document in place of a passport issued by the Japanese government, a foreign government Japan recognizes or a competent international organization, or an equivalent document from the competent authority of a region that a Cabinet Order (政令) designates.

In Article 93, paragraphs (4) and (5), a record made in electronic, magnetic or any other form people cannot perceive directly, of a kind an order of the competent ministry (主務省令) specifies as used in computer processing.

The Immigration Control and Refugee Recognition Act as it stood before Article 12 of the supplementary provisions (附則) of this Act (Act No. 89 of 2016) amended it, as Article 13, paragraph (1) of those supplementary provisions keeps it applying.
基本方針
In Article 4 of the supplementary provisions (附則) of Act No. 60 of 2024, a basic policy on the proper implementation of employment for skill development (育成就労) and the protection of skill development employees (育成就労外国人) that the government may set and publish before that Act comes into effect, following Article 7 of this Act as Article 2 of that Act amends it, and that is then treated as set and published under that Article.

In Article 9, item (iv) as Article 4 of the supplementary provisions (附則) of this Act reads it for the time being, a plan an order of the competent ministry (主務省令) specifies for the activities of a holder of the former Technical Intern Training status of residence (旧技能実習在留資格者等), which takes the place of the stage (i) or stage (ii) technical intern training plan whose goal of passing a trade skills test or evaluation examination must have been met.
Short name for the Immigration Control and Refugee Recognition Act, used in the supplementary provisions (附則) of Act No. 60 of 2024, whose Article 1 amends that Act and whose Article 2 amends this one.
In Article 4, paragraph (2) of the supplementary provisions (附則) of Act No. 60 of 2024, a field-specific operation policy as defined in Article 7-2, paragraph (1) of this Act as Article 2 of that Act amends it — a policy on running employment for skill development (育成就労) in a particular industrial field — which the competent ministers (主務大臣) may set and publish before that Act comes into effect, once a basic policy (基本方針) has been set early, and which is then treated as set and published under that Article.
