Supplementary Provisions, Article 18Transitional Measures Accompanying the Partial Amendment of the Public Assistance Act
第十八条（生活保護法の一部改正に伴う経過措置）
Pursuant to the provisions of Article 3, paragraph (1) of the Supplementary Provisions, long-term care assistance pertaining to care prevention services prescribed in Article 15-2, paragraph (1), item (v) of the Public Assistance Act as amended by the provisions of Article 14 (hereinafter referred to as the "New Public Assistance Act"), welfare equipment for care prevention prescribed in item (vi) of that paragraph and home renovation for care prevention prescribed in item (vii) of that paragraph is not provided, until the date specified by Prefectural or Municipal Ordinance within the period from the Effective Date to April 1, 2008, to a public assistance recipient (meaning a public assistance recipient prescribed in Article 6, paragraph (1) of the Public Assistance Act; the same applies hereinafter) who has a place of residence (or, where the person has no place of residence or it is unclear, the current location; the same applies in the following paragraph and the following Article) within the district of a municipality to which the provisions of Article 18, item (ii), Article 19, paragraph (2), Articles 32 through 34 and Chapter IV, Section 4 of the New Long-Term Care Insurance Act do not apply.
附則第三条第一項の規定により、施行日から平成二十年四月一日までの間において条例で定める日までの間、新介護保険法第十八条第二号、第十九条第二項、第三十二条から第三十四条まで及び第四章第四節の規定が適用されない市町村の区域内に居住地（居住地がないか、又は明らかでない場合にあっては、現在地とする。次項及び次条において同じ。）を有する被保護者（生活保護法第六条第一項に規定する被保護者をいう。以下同じ。）に対しては、第十四条の規定による改正後の生活保護法（以下「新生活保護法」という。）第十五条の二第一項第五号に規定する介護予防、同項第六号に規定する介護予防福祉用具及び同項第七号に規定する介護予防住宅改修に係る介護扶助は行わない。
In the case referred to in the preceding paragraph, with regard to a public assistance recipient who has a place of residence within the district of the municipality concerned, the provisions of Article 15-2 of the New Public Assistance Act apply by deeming a person who falls under a person requiring support prescribed in Article 7, paragraph (4) of the New Long-Term Care Insurance Act to be a person who falls under a person requiring long-term care prescribed in paragraph (3) of that Article.
前項の場合において、当該市町村の区域内に居住地を有する被保護者については、新介護保険法第七条第四項に規定する要支援者に該当する者を同条第三項に規定する要介護者に該当する者とみなして、新生活保護法第十五条の二の規定を適用する。
