Article 2 · (Definitions)第二条(定義)

    the term "heads of each ministry and agency" means the President of the House of Representatives, the President of the House of Councillors, the Chief Justice of the Supreme Court, the President of the Board of Audit, and the Prime Minister and the Ministers of each ministry, who are the heads of each ministry and agency (meaning the House of Representatives, the House of Councillors, the court, the Board of Audit, the Cabinet (excluding the Cabinet Office , the Digital Agency, and the Digital Disaster Management Agency), the Cabinet Office, the Digital Agency, the Disaster Management Agency, and each ministry; the same applies below) to which the person who travels from Japan to a foreign country using an official passport belongs (when the person is a person accompanied by or is summoned as a spouse, child, or employee, the person who accompanies or summons that person); provided, however, that when the person does not belong to any ministry or agency, the Minister for Foreign Affairs is the head person;

    各省各庁の長 本邦から公用旅券によつて外国に渡航する者(その者が同伴され、又は呼び寄せられる配偶者、子又は使用人である場合には、その者を同伴し、又は呼び寄せる者)が所属する各省各庁(衆議院、参議院、裁判所、会計検査院並びに内閣(内閣府及び、デジタル庁及び防災庁を除く。)、内閣府、デジタル庁、防災庁及び各省をいう。以下同じ。)の長たる衆議院議長、参議院議長、最高裁判所長官、会計検査院長並びに内閣総理大臣及び各省大臣をいう。ただし、その者が各省各庁のいずれにも所属しない場合には、外務大臣とする。

Supplementary Provisions, Article 2 · Transitional Measures Concerning Dispositions, etc.附則第二条(処分等に関する経過措置)

  • AddedSupplementary Provisions, Article 2, paragraph (1)

    A disposition such as an approval, or a notice or other act, done by the former national organ pursuant to the provisions of the respective Acts before their amendment by this Act (including orders based on them; referred to as the "former laws and regulations" in this Article and the following Article) before this Act comes into effect is deemed, after this Act comes into effect, to be a disposition such as an approval, or a notice or other act, done by the equivalent national organ pursuant to the equivalent provisions of the respective Acts after their amendment by this Act (including orders based on them; referred to as the "new laws and regulations" in this Article and the following Article).

    この法律の施行前にこの法律による改正前のそれぞれの法律(これに基づく命令を含む。以下この条及び次条において「旧法令」という。)の規定により従前の国の機関がした認定等の処分又は通知その他の行為は、この法律の施行後は、この法律による改正後のそれぞれの法律(これに基づく命令を含む。以下この条及び次条において「新法令」という。)の相当規定により相当の国の機関がした認定等の処分又は通知その他の行為とみなす。

  • AddedSupplementary Provisions, Article 2, paragraph (2)

    An application, notification or other act that has actually been made to the former national organ pursuant to the provisions of the former laws and regulations at the time this Act comes into effect is deemed, after this Act comes into effect, to be an application, notification or other act made to the equivalent national organ pursuant to the equivalent provisions of the new laws and regulations.

    この法律の施行の際現に旧法令の規定により従前の国の機関に対してされている申請、届出その他の行為は、この法律の施行後は、新法令の相当規定により相当の国の機関に対してされた申請、届出その他の行為とみなす。

  • AddedSupplementary Provisions, Article 2, paragraph (3)

    With regard to a matter for which an application, notification or other procedure must be made to the former national organ pursuant to the provisions of the former laws and regulations before this Act comes into effect, and for which that procedure has not been made to the former national organ before this Act comes into effect, the provisions of the new laws and regulations apply after this Act comes into effect by deeming that procedure not to have been made to the equivalent national organ pursuant to the equivalent provisions of the new laws and regulations.

    この法律の施行前に旧法令の規定により従前の国の機関に対して申請、届出その他の手続をしなければならない事項で、この法律の施行前に従前の国の機関に対してその手続がされていないものについては、この法律の施行後は、これを、新法令の相当規定により相当の国の機関に対してその手続がされていないものとみなして、新法令の規定を適用する。

Supplementary Provisions, Article 3 · Transitional Measures Concerning the Effect of Orders附則第三条(命令の効力に関する経過措置)

    A Cabinet Office Order under Article 7, paragraph (3) of the Act for Establishment of the Cabinet Office or a Ministerial Order under Article 12, paragraph (1) of the National Government Organization Act issued pursuant to the provisions of the former laws and regulations is to have effect, after this Act comes into effect, as the equivalent Cabinet Office Order under Article 7, paragraph (3) of the Act for Establishment of the Cabinet Office, Disaster Management Agency Order under Article 7, paragraph (3) of the Act for Establishment of the Disaster Management Agency, or Ministerial Order under Article 12, paragraph (1) of the National Government Organization Act issued based on the equivalent provisions of the new laws and regulations.

    旧法令の規定により発せられた内閣府設置法第七条第三項の内閣府令又は国家行政組織法第十二条第一項の省令は、この法律の施行後は、新法令の相当規定に基づいて発せられた相当の内閣府設置法第七条第三項の内閣府令、防災庁設置法第七条第三項の防災庁令又は国家行政組織法第十二条第一項の省令としての効力を有するものとする。

Supplementary Provisions, Article 4 · Transitional Measures Concerning Application of Penal Provisions附則第四条(罰則の適用に関する経過措置)

    With regard to the application of penal provisions to acts committed before this Act comes into effect, the provisions then in force continue to govern.

    この法律の施行前にした行為に対する罰則の適用については、なお従前の例による。
