第五条
The provisions of Article 13 of the New Long-Term Care Insurance Act apply to an Insured Person Subject to Domicile Exception prescribed in paragraph (1) of that Article who is found to have changed his or her domicile, on or after the Effective Date, to the location where a Facility Subject to Domicile Exception prescribed in that paragraph (hereinafter in this Article and the following Article referred to as a "Facility Subject to Domicile Exception") is located by entering or moving into that facility (hereinafter in this Article and the following Article referred to as "Admission, etc."), and who is found to have had a domicile in a Municipality other than the Municipality where said Facility Subject to Domicile Exception is located at the time of Admission, etc., to said Facility Subject to Domicile Exception.
新介護保険法第十三条の規定は、同条第一項に規定する住所地特例対象施設（以下この条及び次条において「住所地特例対象施設」という。）に入所又は入居（以下この条及び次条において「入所等」という。）をすることにより、施行日以後に当該住所地特例対象施設の所在する場所に住所を変更したと認められる同項に規定する住所地特例対象被保険者であって、当該住所地特例対象施設に入所等をした際、当該住所地特例対象施設が所在する市町村以外の市町村の区域内に住所を有していたと認められるものについて、適用する。
