第十条
A Designated In-Home Service Provider (excluding a person deemed to have received the designation under the main clause of Article 42-2, paragraph (1) of the New Long-Term Care Insurance Act pursuant to the provisions of the following paragraph), a Designated In-Home Long-Term Care Support Provider, an establisher of a Designated Facility Covered by Public Aid Providing Long-Term Care to the Elderly (excluding a person deemed to have received the designation under the main clause of Article 42-2, paragraph (1) of the New Long-Term Care Insurance Act pursuant to the provisions of paragraph (3)), or an establisher of a Designated Medical Long-Term Care Sanatorium, or an Establisher of a Long-Term Care Health Facility (hereinafter in this paragraph referred to as a "Designated In-Home Service Provider, etc."), who at the time of enforcement of this Act actually holds the designation under the main clause of Article 41, paragraph (1) of the Former Long-Term Care Insurance Act or under Article 46, paragraph (1) or Article 48, paragraph (1), item (i) or (iii) of the Long-Term Care Insurance Act, or the approval under Article 94, paragraph (1) of that Act, is deemed to have received, on the Effective Date, the designation under the main clause of Article 41, paragraph (1) of the New Long-Term Care Insurance Act or under Article 46, paragraph (1) or Article 48, paragraph (1), item (i) or (iii) of the Long-Term Care Insurance Act, or the approval under Article 94, paragraph (1) of that Act; provided, however, that this does not apply if said Designated In-Home Service Provider, etc. has made a different notification, as provided by Order of the Ministry of Health, Labour and Welfare, by the day before the Effective Date.
この法律の施行の際現に旧介護保険法第四十一条第一項本文若しくは介護保険法第四十六条第一項若しくは第四十八条第一項第一号若しくは第三号の指定又は同法第九十四条第一項の許可を受けている指定居宅サービス事業者（次項の規定により新介護保険法第四十二条の二第一項本文の指定を受けたものとみなされた者を除く。）、指定居宅介護支援事業者、指定介護老人福祉施設の開設者（第三項の規定により新介護保険法第四十二条の二第一項本文の指定を受けたものとみなされた者を除く。）若しくは指定介護療養型医療施設の開設者又は介護老人保健施設の開設者（以下この項において「指定居宅サービス事業者等」という。）は、施行日に、新介護保険法第四十一条第一項本文若しくは介護保険法第四十六条第一項若しくは第四十八条第一項第一号若しくは第三号の指定又は同法第九十四条第一項の許可を受けたものとみなす。ただし、当該指定居宅サービス事業者等が施行日の前日までに、厚生労働省令で定めるところにより別段の申出をしたときは、この限りでない。
A person that, at the time of enforcement of this Act, is currently designated under the main clause of Article 41, paragraph (1) of the Former Long-Term Care Insurance Act for the business of Communal Daily Long-Term Care for a Dementia Patient or Daily Life Long-Term Care for a Person Admitted to a Specified Facility (limited to that provided at a Fee-Based Home for the Elderly prescribed in Article 29, paragraph (1) of the Former Act on Social Welfare for the Elderly or any other facility specified by Order of the Ministry of Health, Labour and Welfare under Article 7, paragraph (16) of the Former Long-Term Care Insurance Act, the residents of which are limited to a Person Requiring Long-Term Care prescribed in paragraph (3) of that Article, his or her spouse or any other person specified by Order of the Ministry of Health, Labour and Welfare, and the capacity of residents of which is 29 or less) is deemed, on the Effective Date, to have received, from the head of the Municipality of the location of the Business Office that conducts the business (or, if on the day preceding the Effective Date an Insured Person of Long-Term Care Insurance provided by a Municipality other than that Municipality (hereinafter referred to in this Article as an "other Municipality") is using those services, from the head of that other Municipality), the designation under the main clause of Article 42-2, paragraph (1) of the New Long-Term Care Insurance Act pertaining to the Communal Daily Long-Term Care for a Dementia Patient prescribed in Article 8, paragraph (18) of the New Long-Term Care Insurance Act or the Daily Life Long-Term Care for a Person Admitted to a Community-Based Specified Facility prescribed in paragraph (19) of that Article; provided, however, that this does not apply if the person that conducts the business has made a different notification, as provided by Order of the Ministry of Health, Labour and Welfare, by the day preceding the Effective Date.
この法律の施行の際現に旧介護保険法第四十一条第一項本文の指定を受けている認知症対応型共同生活介護又は特定施設入所者生活介護（旧老人福祉法第二十九条第一項に規定する有料老人ホームその他旧介護保険法第七条第十六項の厚生労働省令で定める施設であって、その入居者が同条第三項に規定する要介護者、その配偶者その他厚生労働省令で定める者に限られるもののうち、その入居定員が二十九人以下であるものにおいて行うものに限る。）の事業を行う者については、施行日に、当該事業を行う事業所の所在地の市町村の長（施行日の前日において当該市町村以外の市町村（以下この条において「他の市町村」という。）が行う介護保険の被保険者がこれらのサービスを利用している場合には、当該他の市町村の長）から、新介護保険法第八条第十八項に規定する認知症対応型共同生活介護又は同条第十九項に規定する地域密着型特定施設入居者生活介護に係る新介護保険法第四十二条の二第一項本文の指定を受けたものとみなす。ただし、当該事業を行う者が施行日の前日までに、厚生労働省令で定めるところにより別段の申出をしたときは、この限りでない。
The establisher of a Designated Facility Covered by Public Aid Providing Long-Term Care to the Elderly that, at the time of enforcement of this Act, is currently designated under Article 48, paragraph (1), item (i) of the Long-Term Care Insurance Act and whose admission capacity is 29 or less is deemed, on the Effective Date, to have received, from the head of the Municipality of the location of that Designated Facility Covered by Public Aid Providing Long-Term Care to the Elderly (or, if on the day preceding the Effective Date an Insured Person of Long-Term Care Insurance provided by an other Municipality is admitted to that Designated Facility Covered by Public Aid Providing Long-Term Care to the Elderly, from the head of that other Municipality), the designation under the main clause of Article 42-2, paragraph (1) of the New Long-Term Care Insurance Act pertaining to the Daily Life Long-Term Care for a Person Admitted to a Community-Based Facility for the Elderly Covered by Public Aid Requiring Long-Term Care prescribed in Article 8, paragraph (20) of the New Long-Term Care Insurance Act.
この法律の施行の際現に介護保険法第四十八条第一項第一号の指定を受けている指定介護老人福祉施設であって、その入所定員が二十九人以下であるものの開設者は、施行日に、当該指定介護老人福祉施設の所在地の市町村の長（施行日の前日において他の市町村が行う介護保険の被保険者が当該指定介護老人福祉施設に入所している場合には、当該他の市町村の長）から、新介護保険法第八条第二十項に規定する地域密着型介護老人福祉施設入所者生活介護に係る新介護保険法第四十二条の二第一項本文の指定を受けたものとみなす。
