Long-Term Care Insurance Act

A prefectural governor is to endeavor to conduct investigation and analysis of, and to publish the contents of, the revenue and expenses of each Business Office or facility of a Long-Term Care Service Provider (excluding persons specified by Order of the Ministry of Health, Labour and Welfare; the same applies hereinafter in this Article) that has a Business Office or facility providing Long-Term Care Service within the area governed by said prefectural governor, and other matters specified by Order of the Ministry of Health, Labour and Welfare (referred to as "Long-Term Care Service Provider Management Information" in the following paragraph and paragraph (3)), in order to secure the Long-Term Care Service needed in the region.

A Long-Term Care Service Provider must, pursuant to the provisions of Order of the Ministry of Health, Labour and Welfare, report Long-Term Care Service Provider Management Information to the prefectural governor having jurisdiction over the location of said Business Office or facility.

The Minister of Health, Labour and Welfare is to implement necessary measures so as to be able to collect and organize Long-Term Care Service Provider Management Information and to promptly provide the results of analysis of the organized information to the public through the Internet or other advanced information and communications networks.

The Minister of Health, Labour and Welfare, when deeming it necessary in order to implement the measures in the preceding paragraph, may request a prefectural governor to provide information on the status of activities pertaining to the Business Offices or facilities of Long-Term Care Service Providers that have a Business Office or facility providing Long-Term Care Service within the area governed by said prefectural governor, and other matters specified by Order of the Ministry of Health, Labour and Welfare.

A prefectural governor, when providing information in response to the request of the Minister of Health, Labour and Welfare pursuant to the provisions of the preceding paragraph, is to do so by electromagnetic means or other methods specified by Order of the Ministry of Health, Labour and Welfare.

A prefectural governor, when a Long-Term Care Service Provider does not make the report pursuant to the provisions of paragraph (2) or submits a false report, may, setting a due date, order said Long-Term Care Service Provider to make that report or to correct the contents of that report.

A prefectural governor, when having taken a disposition pursuant to the provisions of the preceding paragraph against a Designated Community-Based Service Provider, Designated In-Home Long-Term Care Support Provider, Designated Provider of Community-Based Service for Preventive Long-Term Care, or Designated Preventive Long-Term Care Support Provider, must without delay provide notification of such fact to the mayor of the Municipality that provided appointment as service provider to said Designated Community-Based Service Provider, Designated In-Home Long-Term Care Support Provider, Designated Provider of Community-Based Service for Preventive Long-Term Care, or Designated Preventive Long-Term Care Support Provider.

A prefectural governor, when a Designated In-Home Service Provider, a Designated Provider of Preventive Long-Term Care Service, or an Establisher of a Designated Facility Covered by Public Aid Providing Long-Term Care to the Elderly, a Long-Term Care Health Facility, or an integrated facility for medical and long-term care does not act in compliance with an order pursuant to the provisions of paragraph (6), may rescind the appointment as service provider of said Designated In-Home Service Provider, Designated Provider of Preventive Long-Term Care Service, or Designated Facility Covered by Public Aid Providing Long-Term Care to the Elderly or the approval for a Long-Term Care Health Facility or integrated facility for medical and long-term care, or suspend the whole or a part of the effect of said appointment as service provider or approval within the period specified by a due date.

A prefectural governor, in a case when a Designated Community-Based Service Provider, Designated In-Home Long-Term Care Support Provider, Designated Provider of Community-Based Service for Preventive Long-Term Care, or Designated Preventive Long-Term Care Support Provider does not act in compliance with an order pursuant to the provisions of paragraph (6), and the prefectural governor determines it appropriate to rescind the appointment as service provider of said Designated Community-Based Service Provider, Designated In-Home Long-Term Care Support Provider, Designated Provider of Community-Based Service for Preventive Long-Term Care, or Designated Preventive Long-Term Care Support Provider, or to suspend the whole or a part of its effect within the period specified by a due date, must provide notification of said fact, indicating said reasons, to the mayor of the Municipality that provided said appointment as service provider.
