Article 1Purpose

第一条(目的)

The purpose of this Act is to promote the prompt and appropriate resolution, adapted to their actual circumstances, of individual disputes between individual workers and employers on working conditions and other matters concerning labor relationships (including disputes between individual job applicants and employers on matters concerning the recruitment and employment of workers; hereinafter referred to as "individual labor-related disputes") through the establishment of a system of mediation, etc.

この法律は、労働条件その他労働関係に関する事項についての個々の労働者と事業主との間の紛争(労働者の募集及び採用に関する事項についての個々の求職者と事業主との間の紛争を含む。以下「個別労働関係紛争」という。)について、あっせんの制度を設けること等により、その実情に即した迅速かつ適正な解決を図ることを目的とする。

Article 2Voluntary Resolution of Disputes

第二条(紛争の自主的解決)

If an individual labor-related dispute arises, the parties to the individual labor-related dispute must endeavor to achieve a voluntary resolution promptly and in good faith.

個別労働関係紛争が生じたときは、当該個別労働関係紛争の当事者は、早期に、かつ、誠意をもって、自主的な解決を図るように努めなければならない。

Article 3Provision of Information to Workers and Employers

第三条(労働者、事業主等に対する情報提供等)

The Director of the Prefectural Labour Bureau, in order to prevent the occurrence of individual labor-related disputes and to promote the voluntary resolution of individual labor-related disputes, is to provide workers, job applicants and employers with information on matters concerning labor relationships and matters concerning the recruitment and employment of workers and give consultations and other assistance.

都道府県労働局長は、個別労働関係紛争を未然に防止し、及び個別労働関係紛争の自主的な解決を促進するため、労働者、求職者又は事業主に対し、労働関係に関する事項並びに労働者の募集及び採用に関する事項についての情報の提供、相談その他の援助を行うものとする。

Article 4Advice and Guidance to the Parties

第四条(当事者に対する助言及び指導)

In a case where the Director of the Prefectural Labour Bureau is requested by one or both parties to an individual labor-related dispute (except disputes which are labor disputes prescribed in Article 6 of the Labor Relations Adjustment Act (Act No. 25 of 1946) and disputes prescribed in ) for assistance in the resolution thereof, the Director may give necessary advice or guidance to the parties to the individual labor-related dispute.

都道府県労働局長は、個別労働関係紛争(労働関係調整法(昭和二十一年法律第二十五号)第六条に規定する労働争議に当たる紛争及びに規定する紛争を除く。)に関し、当該個別労働関係紛争の当事者の双方又は一方からその解決につき援助を求められた場合には、当該個別労働関係紛争の当事者に対し、必要な助言又は指導をすることができる。

If the Director of the Prefectural Labour Bureau finds it necessary in order to provide the advice or guidance prescribed in the preceding paragraph, the Director is to hear the opinions of persons who have broad knowledge of industrial society and have expert knowledge of labor issues.

都道府県労働局長は、前項に規定する助言又は指導をするため必要があると認めるときは、広く産業社会の実情に通じ、かつ、労働問題に関し専門的知識を有する者の意見を聴くものとする。

An employer must not dismiss or otherwise treat a worker disadvantageously due to the reason that the worker has requested the assistance set forth in paragraph (1).

事業主は、労働者が第一項の援助を求めたことを理由として、当該労働者に対して解雇その他不利益な取扱いをしてはならない。

Article 5Delegation of Mediation

第五条(あっせんの委任)

In a case where one or both parties to an individual labor-related dispute (hereinafter referred to as "disputing parties") set forth in paragraph (1) of the preceding Article (except disputes on matters concerning the recruitment and employment of workers) files an application for mediation for the individual labor-related dispute, if the Director of the Prefectural Labour Bureau finds it necessary for the resolution of the individual labor-related dispute, the Director is to have the Dispute Coordinating Committee conduct mediation.

都道府県労働局長は、前条第一項に規定する個別労働関係紛争(労働者の募集及び採用に関する事項についての紛争を除く。)について、当該個別労働関係紛争の当事者(以下「紛争当事者」という。)の双方又は一方からあっせんの申請があった場合において当該個別労働関係紛争の解決のために必要があると認めるときは、紛争調整委員会にあっせんを行わせるものとする。

The provisions of paragraph 3 of the preceding Article apply mutatis mutandis to a case where a worker files the application set forth in the preceding paragraph.

前条第三項の規定は、労働者が前項の申請をした場合について準用する。

Article 6Establishment of Committee

第六条(委員会の設置)

A Dispute Coordinating Committee (hereinafter referred to as the "Committee") is to be established in Prefectural Labour Bureaus.

都道府県労働局に、紛争調整委員会(以下「委員会」という。)を置く。

The Committee is to be established as the organ that conducts the mediation set forth in paragraph (1) of the preceding Article.

委員会は、前条第一項のあっせんを行う機関とする。

Article 7Structure of the Committee

第七条(委員会の組織)

The Committee is to be composed of more than three persons but less than the number of persons specified by Cabinet Order.

委員会は、三人以上政令で定める人数以内の委員をもって組織する。

The Committee members are appointed by the Minister of Health, Labour and Welfare from among persons with relevant expertise.

委員は、学識経験を有する者のうちから、厚生労働大臣が任命する。

The Committee is to have a chairperson, who is elected from among the Committee members.

委員会に会長を置き、委員の互選により選任する。

The chairperson presides over the work of the Committee.

会長は会務を総理する。

If the chairperson is incapacitated, another Committee member elected from among the Committee members in advance acts in place of the chairperson.

会長に事故があるときは、委員のうちからあらかじめ互選された者がその職務を代理する。

Article 8Term of Office of Committee Members

第八条(委員の任期等)

The term of office of a Committee member is two years; provided, however, that the term of office of a member who fills a vacancy is the remaining term of the predecessor.

委員の任期は、二年とする。ただし、補欠の委員の任期は、前任者の残任期間とする。

A Committee member may be reappointed to office.

委員は、再任されることができる。

A Committee member carries out their duties until the successor is appointed.

委員は、後任の委員が任命されるまでその職務を行う。

A Committee member is to serve on a part-time basis.

委員は、非常勤とする。

Article 9Disqualification Clause of Committee Members

第九条(委員の欠格条項)

A person to whom any of the following items applies may not become a Committee member:

次の各号のいずれかに該当する者は、委員となることができない。

a person who is bankrupt whose rights have not been restored; or

破産者で復権を得ないもの

a person who has been sentenced to imprisonment or severer punishment and for whom five years has not passed since the completion of the sentence or the date on which the person ceased to be subject to the sentence.

拘禁刑以上の刑に処せられ、その執行を終わり、又はその執行を受けることがなくなった日から五年を経過しない者

If a Committee member comes to fall under any of the items of the preceding paragraph, the member loses their position as a matter of course.

委員が前項各号のいずれかに該当するに至ったときは、当然失職する。

Article 10Dismissal of Committee Members

第十条(委員の解任)

If a Committee member comes to fall under any of the following items, the Minister of Health, Labour and Welfare may dismiss the member:

厚生労働大臣は、委員が次の各号のいずれかに該当するときは、その委員を解任することができる。

the Committee member is found unable to perform his duties due to a mental or physical disorder; or

心身の故障のため職務の執行に堪えないと認められるとき。

the Committee member is found to have committed a violation of obligation in the course of their duties or other misconduct unbecoming for a member.

職務上の義務違反その他委員たるに適しない非行があると認められるとき。

Article 11Meetings and Resolutions

第十一条(会議及び議決)

The Chairperson convenes the meetings of the Committee.

委員会の会議は、会長が招集する。

The Committee may not hold a meeting and adopt a resolution unless in addition to the chairperson or the person who substitutes for the chairperson pursuant to the provisions of Article 7, paragraph (5), a majority of Committee members are present.

委員会は、会長又は第七条第五項の規定により会長を代理する者のほか、委員の過半数が出席しなければ、会議を開き、議決をすることができない。

The agenda items of meetings of the Committee are to be decided by a majority of Committee members present; and in the event of a tie, the chairperson decides.

委員会の議事は、出席者の過半数をもって決する。可否同数のときは、会長が決する。

Article 12Mediation

第十二条(あっせん)

Mediation by the Committee is to be conducted by three mediation members whom the chairperson designates for each case from among the Committee members.

委員会によるあっせんは、委員のうちから会長が事件ごとに指名する三人のあっせん委員によって行う。

Mediation members must conduct mediation between the disputing parties, confirm the main points of the claims of both parties, and endeavor so that the case is resolved in accordance with the actual circumstances of the case.

あっせん委員は、紛争当事者間をあっせんし、双方の主張の要点を確かめ、実情に即して事件が解決されるように努めなければならない。

Article 13

第十三条

In addition to hearing the opinions of the disputing parties, the mediation members may hear the opinions of witnesses, as necessary, or request that these persons submit written opinions, prepare a mediation plan necessary for the resolution of the case, and present it to the disputing parties.

あっせん委員は、紛争当事者から意見を聴取するほか、必要に応じ、参考人から意見を聴取し、又はこれらの者から意見書の提出を求め、事件の解決に必要なあっせん案を作成し、これを紛争当事者に提示することができる。

The mediation plan set forth in the preceding paragraph is to be prepared with the unanimous approval of all mediation members.

前項のあっせん案の作成は、あっせん委員の全員一致をもって行うものとする。

Article 14

第十四条

If it is found necessary based on the application of a disputing party, the mediation members are to hear the opinions on the case from the representatives of relevant workers or representatives of relevant employers who are designated by major labor organizations or employer organizations within the area of jurisdiction of the Prefectural Labour Bureau where the Committee is established.

あっせん委員は、紛争当事者からの申立てに基づき必要があると認めるときは、当該委員会が置かれる都道府県労働局の管轄区域内の主要な労働者団体又は事業主団体が指名する関係労働者を代表する者又は関係事業主を代表する者から当該事件につき意見を聴くものとする。

Article 15

第十五条

If the mediation members find that there is no prospect of resolving the dispute by mediation, they may discontinue mediation.

あっせん委員は、あっせんに係る紛争について、あっせんによっては紛争の解決の見込みがないと認めるときは、あっせんを打ち切ることができる。

In a case where mediation is discontinued pursuant to the provisions of the preceding Article, if the person who requested the mediation files a lawsuit with respect to the claim that was the subject of the mediation within 30 days from receiving notice to that effect, the lawsuit is deemed to be filed at the time of the application for mediation regarding the postponement of expiration of the prescription period.

前条の規定によりあっせんが打ち切られた場合において、当該あっせんの申請をした者がその旨の通知を受けた日から三十日以内にあっせんの目的となった請求について訴えを提起したときは、時効の完成猶予に関しては、あっせんの申請の時に、訴えの提起があったものとみなす。

Article 17Requests for Providing Materials

第十七条(資料提供の要求等)

If the Committee finds it necessary for the resolution of the case pending in the Committee, it may request the provision of materials and other necessary cooperation from the relevant administrative authorities.

委員会は、当該委員会に係属している事件の解決のために必要があると認めるときは、関係行政庁に対し、資料の提供その他必要な協力を求めることができる。

Article 18Reports on the Status of Mediation

第十八条(あっせん状況の報告)

The Committee, pursuant to the provisions of Order of the Ministry of Health, Labour and Welfare, must make a report to the Director of the Prefectural Labour Bureau with respect to the status of mediation.

委員会は、都道府県労働局長に対し、厚生労働省令で定めるところにより、あっせんの状況について報告しなければならない。

In addition to what is provided for in this Act, necessary matters concerning the Committee and the procedures of mediation are prescribed by Order of the Ministry of Health, Labour and Welfare.

この法律に定めるもののほか、委員会及びあっせんの手続に関し必要な事項は、厚生労働省令で定める。

Article 20Measures by Local Government

第二十条(地方公共団体の施策等)

In cooperation with the measures of the national government, local governments, in accordance with the actual circumstances of the relevant area, are to endeavor to promote the provision of information, consultations, mediation and other necessary measures for workers, job applicants or employers, in order to prevent the occurrence of individual labor-related disputes and promote the voluntary resolution of individual labor-related disputes.

地方公共団体は、国の施策と相まって、当該地域の実情に応じ、個別労働関係紛争を未然に防止し、及び個別労働関係紛争の自主的な解決を促進するため、労働者、求職者又は事業主に対する情報の提供、相談、あっせんその他の必要な施策を推進するように努めるものとする。

In order to support the measures taken by local governments set forth in the preceding paragraph, the national government is to provide information and take other necessary measures.

国は、地方公共団体が実施する前項の施策を支援するため、情報の提供その他の必要な措置を講ずるものとする。

In the case where a prefectural labor relations commission receives the delegation of the prefectural governor based on the provisions of and takes the measures prescribed in paragraph (1), the Central Labour Relations Commission may give the prefectural labor relations commission necessary advice and guidance.

第一項の施策として、の規定に基づく都道府県知事の委任を受けて都道府県労働委員会が行う場合には、中央労働委員会は、当該都道府県労働委員会に対し、必要な助言又は指導をすることができる。

Article 21Special Provisions Concerning Mariners

第二十一条(船員に関する特例)

Regarding mariners prescribed in and persons seeking to become mariners as prescribed in , the term "the Director of the Prefectural Labour Bureau" in Article 3, Article 4, paragraphs (1) and (2) and Article 5, paragraph (1) is deemed to be replaced with "the Director of the District Transport Bureau (including the Director of the Transport Supervision Department)," and the term "the Dispute Coordinating Committee" in the same paragraph is deemed to be replaced with "a mediator designated from among the persons entered in the list of mediator candidates set forth in Article 21, paragraph (3)".

に規定する船員及びに規定する船員になろうとする者に関しては、第三条、第四条第一項及び第二項並びに第五条第一項中「都道府県労働局長」とあるのは「地方運輸局長(運輸監理部長を含む。)」と、同項中「紛争調整委員会」とあるのは「第二十一条第三項のあっせん員候補者名簿に記載されている者のうちから指名するあっせん員」とする。

The provisions of Article 6 to Article 19 do not apply to mediation that a mediator conducts upon designation pursuant to the provisions of Article 5, paragraph (1) with the terms replaced pursuant to the provisions of the preceding paragraph.

前項の規定により読み替えられた第五条第一項の規定により指名を受けてあっせん員が行うあっせんについては、第六条から第十九条までの規定は、適用しない。

The Director of the District Transport Bureau (including the Director of the Transport Supervision Department) must, every two years, commission three or more mediator candidates from among persons with relevant expertise and prepare a list of mediator candidates, in order to have the mediators designated pursuant to the provisions of Article 5, paragraph (1) with the terms replaced pursuant to the provisions of paragraph (1) conduct mediation.

地方運輸局長(運輸監理部長を含む。)は、第一項の規定により読み替えられた第五条第一項の規定により指名するあっせん員にあっせんを行わせるため、二年ごとに、学識経験を有する者のうちからあっせん員候補者三人以上を委嘱し、あっせん員候補者名簿を作成しておかなければならない。

The provisions of Article 9 and Article 12 to Article 19 apply mutatis mutandis to the mediation set forth in paragraph (2). In this case, the term "Committee member" in Article 9, paragraph (1) is deemed to be replaced with "mediator candidate"; the term "Committee member" in paragraph (2) of that Article is deemed to be replaced with "mediator or mediator candidate", and the phrase "loses their position as a matter of course" is deemed to be replaced with "loses their status"; the term "mediation members" in the provisions of Article 12 to Article 15 and the term "Committee" in Article 12, paragraph (1), Article 18 and Article 19 are deemed to be replaced with "mediator"; the term "the Committee members" in Article 12, paragraph (1) is deemed to be replaced with "the persons entered in the list of mediator candidates", and the term "the chairperson" is deemed to be replaced with "the Director of the District Transport Bureau (including the Director of the Transport Supervision Department) who prepared that list of mediator candidates"; the phrase "the Prefectural Labour Bureau where the Committee is established" in Article 14 is deemed to be replaced with "the District Transport Bureau (including the Transport Supervision Department) where the Director of the District Transport Bureau (including the Director of the Transport Supervision Department) who designated that mediator is stationed"; the phrase "the Committee finds" in Article 17 is deemed to be replaced with "the mediator finds", and the phrase "pending in the Committee" is deemed to be replaced with "being handled by that mediator"; the term "the Director of the Prefectural Labour Bureau" in Article 18 is deemed to be replaced with "the Director of the District Transport Bureau (including the Director of the Transport Supervision Department)"; and the term "Order of the Ministry of Health, Labour and Welfare" in that Article and Article 19 is deemed to be replaced with "Order of the Ministry of Land, Infrastructure, Transport and Tourism".

第九条及び第十二条から第十九条までの規定は、第二項のあっせんについて準用する。この場合において、第九条第一項中「委員」とあるのは「あっせん員候補者」と、同条第二項中「委員」とあるのは「あっせん員又はあっせん員候補者」と、「当然失職する」とあるのは「その地位を失う」と、第十二条から第十五条までの規定中「あっせん委員」とあり、並びに第十二条第一項、第十八条及び第十九条中「委員会」とあるのは「あっせん員」と、第十二条第一項中「委員の」とあるのは「あっせん員候補者名簿に記載されている者の」と、「会長」とあるのは「当該あっせん員候補者名簿を作成した地方運輸局長(運輸監理部長を含む。)」と、第十四条中「当該委員会が置かれる都道府県労働局」とあるのは「当該あっせん員を指名した地方運輸局長(運輸監理部長を含む。)が置かれる地方運輸局(運輸監理部を含む。)」と、第十七条中「委員会は」とあるのは「あっせん員は」と、「当該委員会に係属している」とあるのは「当該あっせん員が取り扱っている」と、第十八条中「都道府県労働局長」とあるのは「地方運輸局長(運輸監理部長を含む。)」と、同条及び第十九条中「厚生労働省令」とあるのは「国土交通省令」と読み替えるものとする。

The authority of the Director of the District Transport Bureau (including the Director of Transport Supervision Department) prescribed in Article 3, Article 4, paragraphs (1) and (2), and Article 5, paragraph (1) with the terms replaced pursuant to the provisions of paragraph (1), and Article 18 with the terms replaced and applied mutatis mutandis pursuant to the provisions of the preceding paragraph may, pursuant to the provision of Order of the Ministry of Land, Infrastructure, Transport and Tourism, be delegated to the Director of the Transport Branch Office or the head of the office of District Transport Bureaus, Transport Supervision Departments, or Transport Branch Offices.

第一項の規定により読み替えられた第三条、第四条第一項及び第二項並びに第五条第一項並びに前項の規定により読み替えて準用される第十八条に規定する地方運輸局長(運輸監理部長を含む。)の権限は、国土交通省令で定めるところにより、運輸支局長又は地方運輸局、運輸監理部若しくは運輸支局の事務所の長に委任することができる。

Article 22Exclusions from Application

第二十二条(適用除外)

This Act does not apply to national public officers or local public officers; provided, however, that this does not apply to disputes concerning the working conditions of employees prescribed in , employees of municipal utility prescribed in , employees prescribed in , and local public officers who are in regular service positions hired to perform simple tasks as prescribed in , other than employees prescribed in .

この法律は、国家公務員及び地方公務員については、適用しない。ただし、の職員、の企業職員、の職員及びに規定する単純な労務に雇用される一般職に属する地方公務員であっての職員以外のものの勤務条件に関する事項についての紛争については、この限りでない。
