第一条(目的)
The purpose of this Act is to promote the prompt and appropriate resolution, adapted to their actual circumstances, of individual disputes between individual workers and employers on working conditions and other matters concerning labor relationships (including disputes between individual job applicants and employers on matters concerning the recruitment and employment of workers; hereinafter referred to as "individual labor-related disputes") through the establishment of a system of mediation, etc.
この法律は、労働条件その他労働関係に関する事項についての個々の労働者と事業主との間の紛争(労働者の募集及び採用に関する事項についての個々の求職者と事業主との間の紛争を含む。以下「個別労働関係紛争」という。)について、あっせんの制度を設けること等により、その実情に即した迅速かつ適正な解決を図ることを目的とする。
Article 2Voluntary Resolution of Disputes
第二条(紛争の自主的解決)
If an individual labor-related dispute arises, the parties to the individual labor-related dispute must endeavor to achieve a voluntary resolution promptly and in good faith.
個別労働関係紛争が生じたときは、当該個別労働関係紛争の当事者は、早期に、かつ、誠意をもって、自主的な解決を図るように努めなければならない。
Article 3Provision of Information to Workers and Employers
第三条(労働者、事業主等に対する情報提供等)
The Director of the Prefectural Labour Bureau, in order to prevent the occurrence of individual labor-related disputes and to promote the voluntary resolution of individual labor-related disputes, is to provide workers, job applicants and employers with information on matters concerning labor relationships and matters concerning the recruitment and employment of workers and give consultations and other assistance.
都道府県労働局長は、個別労働関係紛争を未然に防止し、及び個別労働関係紛争の自主的な解決を促進するため、労働者、求職者又は事業主に対し、労働関係に関する事項並びに労働者の募集及び採用に関する事項についての情報の提供、相談その他の援助を行うものとする。
Article 4Advice and Guidance to the Parties
第四条(当事者に対する助言及び指導)
In a case where the Director of the Prefectural Labour Bureau is requested by one or both parties to an individual labor-related dispute (except disputes which are labor disputes prescribed in Article 6 of the Labor Relations Adjustment Act (Act No. 25 of 1946) and disputes prescribed in Article 26, paragraph (1) of the Act on Labor Relations of Agency Engaged in Administrative Execution (Act No. 257 of 1948)) for assistance in the resolution thereof, the Director may give necessary advice or guidance to the parties to the individual labor-related dispute.
都道府県労働局長は、個別労働関係紛争(労働関係調整法(昭和二十一年法律第二十五号)第六条に規定する労働争議に当たる紛争及び行政執行法人の労働関係に関する法律(昭和二十三年法律第二百五十七号)第二十六条第一項に規定する紛争を除く。)に関し、当該個別労働関係紛争の当事者の双方又は一方からその解決につき援助を求められた場合には、当該個別労働関係紛争の当事者に対し、必要な助言又は指導をすることができる。
If the Director of the Prefectural Labour Bureau finds it necessary in order to provide the advice or guidance prescribed in the preceding paragraph, the Director is to hear the opinions of persons who have broad knowledge of industrial society and have expert knowledge of labor issues.
都道府県労働局長は、前項に規定する助言又は指導をするため必要があると認めるときは、広く産業社会の実情に通じ、かつ、労働問題に関し専門的知識を有する者の意見を聴くものとする。
An employer must not dismiss or otherwise treat a worker disadvantageously due to the reason that the worker has requested the assistance set forth in paragraph (1).
事業主は、労働者が第一項の援助を求めたことを理由として、当該労働者に対して解雇その他不利益な取扱いをしてはならない。
Article 5Delegation of Mediation
第五条(あっせんの委任)
In a case where one or both parties to an individual labor-related dispute (hereinafter referred to as "disputing parties") set forth in paragraph (1) of the preceding Article (except disputes on matters concerning the recruitment and employment of workers) files an application for mediation for the individual labor-related dispute, if the Director of the Prefectural Labour Bureau finds it necessary for the resolution of the individual labor-related dispute, the Director is to have the Dispute Coordinating Committee conduct mediation.
The provisions of paragraph 3 of the preceding Article apply mutatis mutandis to a case where a worker files the application set forth in the preceding paragraph.
Article 6Establishment of Committee
第六条(委員会の設置)
A Dispute Coordinating Committee (hereinafter referred to as the "Committee") is to be established in Prefectural Labour Bureaus.
都道府県労働局に、紛争調整委員会(以下「委員会」という。)を置く。
The Committee is to be established as the organ that conducts the mediation set forth in paragraph (1) of the preceding Article.
Article 7Structure of the Committee
第七条(委員会の組織)
The Committee is to be composed of more than three persons but less than the number of persons specified by Cabinet Order.
委員会は、三人以上政令で定める人数以内の委員をもって組織する。
The Committee members are appointed by the Minister of Health, Labour and Welfare from among persons with relevant expertise.
委員は、学識経験を有する者のうちから、厚生労働大臣が任命する。
The Committee is to have a chairperson, who is elected from among the Committee members.
委員会に会長を置き、委員の互選により選任する。
The chairperson presides over the work of the Committee.
会長は会務を総理する。
If the chairperson is incapacitated, another Committee member elected from among the Committee members in advance acts in place of the chairperson.
会長に事故があるときは、委員のうちからあらかじめ互選された者がその職務を代理する。
Article 8Term of Office of Committee Members
第八条(委員の任期等)
The term of office of a Committee member is two years; provided, however, that the term of office of a member who fills a vacancy is the remaining term of the predecessor.
委員の任期は、二年とする。ただし、補欠の委員の任期は、前任者の残任期間とする。
A Committee member may be reappointed to office.
委員は、再任されることができる。
A Committee member carries out their duties until the successor is appointed.
委員は、後任の委員が任命されるまでその職務を行う。
A Committee member is to serve on a part-time basis.
委員は、非常勤とする。
A person to whom any of the following items applies may not become a Committee member:
次の各号のいずれかに該当する者は、委員となることができない。
a person who is bankrupt whose rights have not been restored; or
破産者で復権を得ないもの
a person who has been sentenced to imprisonment or severer punishment and for whom five years has not passed since the completion of the sentence or the date on which the person ceased to be subject to the sentence.
拘禁刑以上の刑に処せられ、その執行を終わり、又はその執行を受けることがなくなった日から五年を経過しない者
If a Committee member comes to fall under any of the items of the preceding paragraph, the member loses their position as a matter of course.
委員が前項各号のいずれかに該当するに至ったときは、当然失職する。
Article 10Dismissal of Committee Members
第十条(委員の解任)
If a Committee member comes to fall under any of the following items, the Minister of Health, Labour and Welfare may dismiss the member:
厚生労働大臣は、委員が次の各号のいずれかに該当するときは、その委員を解任することができる。
the Committee member is found unable to perform his duties due to a mental or physical disorder; or
心身の故障のため職務の執行に堪えないと認められるとき。
the Committee member is found to have committed a violation of obligation in the course of their duties or other misconduct unbecoming for a member.
職務上の義務違反その他委員たるに適しない非行があると認められるとき。
