Supplementary Provisions, Article 11Transitional Measures Concerning Seizure-Prohibited Movables

第十一条（差押禁止動産に関する経過措置）

With regard to movables that must not be seized in a case relating to a petition for enforcement against movables prescribed in Article 122, paragraph (1) of the Former Civil Enforcement Act or a petition for an auction of movables prescribed in Article 190 of the Former Civil Enforcement Act as the enforcement of a general statutory lien, which was filed before the Effective Date, the provisions then in force continue to govern, notwithstanding the provisions of Article 131 of the Civil Enforcement Act as amended by the provisions of Article 3.

施行日前に申し立てられた旧民事執行法第百二十二条第一項に規定する動産執行又は一般の先取特権の実行としての旧民事執行法第百九十条に規定する動産競売の申立てに係る事件における差し押さえてはならない動産については、第三条の規定による改正後の民事執行法第百三十一条の規定にかかわらず、なお従前の例による。

動産競売（どうさんけいばい）
An auction of movables (動産) held to enforce a security interest over them, which begins only where the creditor gives the movables to a court enforcement officer (執行官), gives the officer a document showing that their possessor consents to the seizure, or gives the officer a copy of the court's permission under Article 190, paragraph (2) that has been served on the debtor no later than the search.
