If a person seeking the registration referred to in Article 22, paragraph (1) falls under any of the following items, or if the application or its supporting documents referred to in Article 23, paragraph (1) contain a false statement on an important particular or omit important facts, the Minister of Land, Infrastructure, Transport and Tourism must deny the registration:
a person specified by Order of the Ministry of Land, Infrastructure, Transport and Tourism as being incapable of properly carrying out the private lodging management business due to a mental or physical disability;
心身の故障により住宅宿泊管理業を的確に遂行することができない者として国土交通省令で定めるもの
a person subject to an order commencing bankruptcy proceedings that has not been released from bankruptcy restrictions;
破産手続開始の決定を受けて復権を得ない者
a person whose registration has been revoked pursuant to Article 42, paragraph (1) or (4) if five years have not passed from the date of the revocation (or if the person whose registration has been revoked is a corporation, the person in question includes a person who was an officer of the corporation within 30 days before the date of the revocation if five years have not passed from the date of the revocation);
a person who has been sentenced to imprisonment or a heavier punishment or has been sentenced to a fine pursuant to the provisions of this Act, if five years have not passed from the date on which the execution of that sentence has been completed or the person ceased to be subject to execution of that sentence;
拘禁刑以上の刑に処せられ、又はこの法律の規定により罰金の刑に処せられ、その執行を終わり、又は執行を受けることがなくなった日から起算して五年を経過しない者
a person specified by Order of the Ministry of Land, Infrastructure, Transport and Tourism as being one that there are reasonable grounds to find likely to commit fraudulent or dishonest acts in relation to the private lodging management business;
住宅宿泊管理業に関し不正又は不誠実な行為をするおそれがあると認めるに足りる相当の理由がある者として国土交通省令で定めるもの
a minor who does not have the same capacity to act as an adult in relation to the business and whose legal representative falls under any of the preceding items;
営業に関し成年者と同一の行為能力を有しない未成年者でその法定代理人が前各号のいずれかに該当するもの
a corporation, one of whose officers falls under any of items (i) through (vi) above;
法人であって、その役員のうちに第一号から第六号までのいずれかに該当する者があるもの
a person whose business activities are controlled by a current or former organized crime group member;
暴力団員等がその事業活動を支配する者
a person that does not have a financial basis that conforms to the standards specified by Order of the Ministry of Land, Infrastructure, Transport and Tourism and is found necessary to carry out a private lodging management business; or
住宅宿泊管理業を遂行するために必要と認められる国土交通省令で定める基準に適合する財産的基礎を有しない者
a person specified by Order of the Ministry of Land, Infrastructure, Transport and Tourism as not having the necessary infrastructures in place to accurately carry out the private lodging management business.
住宅宿泊管理業を的確に遂行するための必要な体制が整備されていない者として国土交通省令で定めるもの
If the Minister of Land, Infrastructure and Transport denies registration pursuant to the preceding paragraph, the Minister must notify the applicant of this without delay, indicating the reasons for the denial.
国土交通大臣は、前項の規定により登録を拒否したときは、遅滞なく、その理由を示して、その旨を申請者に通知しなければならない。
